HomeMy WebLinkAbout1979-10-31 1 h'l-l '_i oJ': October 31, 1979 Bozeman, Montana The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, October 31, 1979, at 1:15 o'clock p.m. Present were Mayor Sedivy, Com- missioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City Manager Gesko, City Attorney Planalp, and the Clerk. Commissioner MacNab opened the meeting with a prayer whereupon the minutes of the reg- ular meeting held on Wednesday, October 24, 1979 were approved as submitted. Public Hearing - Commission Resolution No. 2102 - SID 616 - Paving Koch South 20th to 23rd I This was the time and place set in Commission Resolution No. 2102, to hear the protests to the creation of Special Improvement District No. 616, paving and storm drainage construct- ion on West Koch Street between South 20th and South 23rd Avenue. Affidavit of publication of Notice and the Clerk's mailing certificate stating all prop- erty owners had been notified as required by law were presented. There were no protests on file and no one appeared to protest verbally. The Mayor declared the hearing closed and a decision will be forthcoming on Wednesday, November 7, 1979. Public Hearing - Don Harrington - Conditional Use Permit - construct 8000 sq. ft. addition to existing Pepsi-Cola Warehouse - Bridger Center Subdivision This was the time and place set for a public hearing to consider the Conditional Use Permit for Don Harrington. The applicant seeks a conditional use permit which, if granted, would allow the construction of an 8,000 square foot addition to the existing Pepsi Cola warehouse Lot 3, Block 3, in the Bridger Center Subdivision. The site is located adjacent to Bridger Drive and west of Zig's Building Materials Center. The Planning Director presented the staff report which recommended approval thereof with conditions. The Mayor declared the hearing closed and a decision will be forthcoming on Wednesday, November 7, 1979. Kagy Boulevard I The City Manager stated the City had received the letter from Harold Stewart of the U.S. Department of Transportation. The City Manager described the latest and most acceptable plan for Kagy Boulevard. The plans call for two seventeen (17) foot traffic lanes, striped to allow pedestrian and bike traffic, and a seventeen (l7) foot median. The plan would use only fifty-one (51) feet of the City's ninety (90) foot right-of-way along Kagy. The remaining thirty-nine (39) feet would be subgraded, however, to allow for the eventuality of constructing two more traffic lanes. The City Manager said the new plan could be adopted with only minor changes to the engineer's drawings already made. Mr. Gesko advised the Commission that Mr. Harold Stewart of the Federal Highway Admin- istration indicated that the new plan could be fulfilled without the Environmental Impact Study. This would save approximately $100,000 in federal funds which can then be used for more construction. Mr. Mazanec, president of the Concerned Citizens Forum appeared before the Commission in regard to the proposed compromise. He advised the Commission that the attorney for the Concerned Citizens Forum had been out of town and for that reason had not had enough time to prepare the letter suggesting and sketching the proposed compromise. The City Manager suggested that the Technical Advisory Committee and the Policy Co- ordinating Committee review the proposed compromise before it is approved by the Commission. The Valley View Country Club and persons living adjacent to the proposed roadway should also be made aware of the proposed compromise. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the latest and most acceptable plan for Kagy Boulevard be referred to the Technical Advisory Committee and the Policy Coordinating Committee for their review and a solution within the next week' or two. I . ; r r- ....} .j ;':1 Certified Mill Levy I The City Manager brought up for discussion, the Mill Levy recently received from the County Assessor. The revenue that one mill will raise is $20,132.00. This increased from the original calculation by $1,397.00. The City Attorney reported to the Commission that he has researched the various alter- natives and will report the results next week. Commission Resolution No. 2107 - Asses solid waste collection - $234,759.60 - Hearing Nov. 7 Commission Resolution No. 2107, levying the solid waste collection and disposal assess- ment in the amount of $234,759.60 was presented. COMMISSION RESOLUTION NO. 2107 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL REAL PROPERTY IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, SERVICED AND FROM WHICH GARBAGE WAS COLLECTED AND REMOVED DURING THE YEAR 1979, TO DEFRAY THE COST AND EXPENSE OF COLLECTING AND DISPOSING OF GARBAGE UNDER THE PROVISIONS OF ORDINANCE NO. 696 OF THE CITY OF BOZEMAN MUNICIPAL CODE. It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that Com- mission Resolution No. 2107 be provisionally passed and adopted, and Wednesday, November 7, 1979, be the date set for public hearing. Commission Resolution No. 2106 - Final Assessment SID 571 - Water - MSU - 19th - $32,000.00 Hearing November 7 COMMISSION RESOLUTION NO. 2106 I A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 571 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 571. Commission Resolution No. 2106 levying the final assessment for the installation of water mains in Lincoln Street and adjacent to the center for Veterinary research, SID No. 571 in the amount of $32,000.00 was presented. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that Commission Resolution No. 2106 be provisionally passed and adopted and Wednesday, November 7, 1979 be the date set for public hearing. Commission Resolution No. 2108 - Final Assessment SID 574 - Water Bozeman Creek - $l7,500.00 Hearing November 7, 1979 COMMISSION RESOLUTION NO. 2108 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 574 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 574. I Commission Resolution No. 2108 levying the final assessment for the installation of water mains at Bozeman Creek annexation, SID No. 574 in the amount of $17,500.00 was pre- sented. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that Commission Resolution No. 2108 be provisionally passed and adopted and Wednesday, November 7, 1979 be the date set for public hearing. Commission Resolution No. 2109 - Final Assessment SID 576 - Water main North 22nd between Beall & Durston - $44,650.87 - Hearing November 7, 1979 356 COMMISSION RESOLUTION NO. 2109 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 576 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 576. I Commission Resolution No. 2110 - Final Assessment SID 577 - Paving portion Beall North 22nd between Beall and Durston - $107,047.41 - Hearing November 7, 1979 Commission Resolution No. 2110 levying the final assessment for paving portion of Beall North 22nd between Beall & Durston, SID 577 in the amount of $107,047.41 was presented. Daniel R. McCloy - petition of intent to create SID - Lots 2 & 3 of amended plat of Tract 15 Homesite Subdivision I A letter received from Daniel R. McCloy petitioning the City to create a Special Im- provement District to install paving, curb, gutter, and storm drain on Lots 2 and 3 of Amended Plat of Tract 15, Homesites Subdivision was presented. It was moved by Commissioner Swanson, seconded by Commissioner Vollmer, that the Commission acknowledge receipt of the petition and refer it to the staff for research and a recommendation. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, and Mayor Sedivy, those voting No, none. Application - Gambling License - Sundance Saloon - $500.00 I The City Manager presented an application from the Sundance Saloon, along with the appro- priate fee for operating two card tables. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission concur in the recommendation of the Chief of Police, also concurred in by the City Manager, and approve the application for the issuance of the gambling license. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy, those voting No, none. Application - Gambling License - Hide-a-Way - $500.00 The City Manager presented an application from the Hide-a-Way along with the appropriate fee for operating two card tables. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Com- mission concur in the recommendation of the Chief of Police, also concurred in by the City Man- ager, and approve the application for the issuance of the gambling license. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Swanson, Commis- sioner Vandeventer, Commissioner MacNab, Commissioner Vollmer and Mayor Sedivy, those voting No, none. Application - Raffle License - Bozeman Senior Social Center - November 10 The City Manager presented an application from the Bozeman Senior Social Center, along with the appropriate fee for the purpose of holding a raffle on November 10. It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the Com- mission approve the application for the raffle license. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commis- sioner Vollmer, Commissioner Swanson and Mayor Sedivy, those voting No, none. I Application - Raffle License - Nordic Ski Patrol - November 11 The City Manager presented an application from the Nordic Ski Patrol, along with the appropriate fee for the purpose of holding a raffle on November 11. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commis- sion approve the application for the raffle license. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none. Campfire Girls - Fund Drive - November 2-16, 1979 A letter received from Vicki Frazier, Executive Director of the Headwaters Council of Camp Fire, requesting permission to hold its annual Candy Sale from November 2, 1979, through November 16, 1979 was presented. It was moved by Commissioner Vollmer seconded by Commissioner Swanson, that the Campfire Girls be granted permission to hold their fund drive as requested. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy, those voting No, none. Application - Solicitors Telephone License - Patsy Lou Wise I The City Manager presented an application from Patsy Lou Wise of the Treasure State Productions for a Solicitors Telephone license. Following discussion, the Commission recommended that the application for the Solicitors Telephone License be brought back for action if the Police Protective Association decided to hold the Policeman's Ball. Claims The General Claims and Payroll Claims for the month of October 1979 were presented. The City Manager had checked the claims and found them to be true and lawful claims against the City of Bozeman and recommended they be approved and the Director of Finance be instructed to issue warrants in payment. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the claims be approved.
