The Commission of the Cityof Bozeman met in regular session in the Commission Room, Municipal
Building, December 26, 1979, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner MacNab,
Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City Manager Gesko, City
Attorney Planalp, and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer whereupon the minutes of the
regular meeting held on Wednesday, December 19, 1979 were approved as submitted.
Bid opening - One ton truck - Cemetery Department
This was the time and place set for opening of bids for the purchase of a one-ton truck
for the Cemetery department. Affidavit of publication of "Notice to Bidders" was presented.
It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the bids be
opened and read. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer,
and Mayor Sedivy; those voting No, none.

It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission
concur with the recommendation of the City Manager, that the bids be referred to the Cemetery
Superintendent and the City staff for review and consideration. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Swanson,
Commissioner Vandeventer, Commissioner MacNab, and Mayor Sedivy; those voting No, none.
Public hearing - Zone Map Change from AS to M-l - John Mandeville, - to be continued
This was the time and place set for a public hearing to consider the Zone Map Change for
John Mandeville.
The applicant seeks an amendment to the Bozeman Area Master Plan on approximately thirteen
acres located west of and adjacent to the Burlington Northern Railroad and southwest of U.S.
Highway #lO. The property is approximately one-quarter mile northwest of Chuck's Welding busi-
ness on North Seventh Avenue.
The Planning Director recommended that the hearing be continued until the Zoning Commission
makes a decision.

Petition - Montana Bank of Bozeman - vacate alleyway from North Third to North Grand Avenue -
between West Main and West Mendenhall Streets
A petition received from the Montana Bank of Bozeman, requesting the City of Bozeman to
vacate the alley between North Third Avenue and North Grand Avenue, between West Main Street and
West Mendenhall Street, was presented.
The real property is more particularly described as Lots 1 through 20, Block "c" Tracy's
First Addition to the City of Bozeman.
Following discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner
MacNab, that the petition be referred to the City staff for research and a recommendation. The
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vande-
venter, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, and Mayor Sedivy; those
voting No, none.
Renewal of beer, wine and liquor license for 1980
The City Manager presented the following applications and appropriate fee for Beer, Liquor

It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commission
approve the application for Beer, Liquor and Wine licenses for the above, and that they approve
Lundy's Landing and the Slide Inn contingent upon receiving the appropriate fee, and that a
letter be enclosed with each license. The motion was carried by the following Aye and No vote;
Those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson,
Commissioner Vandeventer, and Mayor Sedivy; those voting No, none.
Home Builders Association of Southwestern Montana - re city building permit and plan check fees
Representatives of the Home Builders Association of Southwestern Montana appeared to pro-
test a 66 percent increase in Bozeman city building permit and plan check fees.
The new fees, which are the same as those listed in the state's Uniform Building Code, are
scheduled to go into effect January 1, 1980.
Speaking on behalf of the Home Builders Association, Clair Daines said the builders didn't
object to some fee increases, but requested that the City justify the 66 percent increase with
the cost of running the City building department.
The Building Inspector said that with two men to inspect approximately $10 million of con-
struction each year, the City is not providing the degree of inspection it should.
Mayor Sedivy advised the representatives present that local government has to make a dec-
ision between having self-supporting departments or using tax revenues to help support their

Mr. Daines said his main concern was that there wasn't enough information given out or
public comment before the fee increases were adopted.
The City Manager responded that the public doesn't get to review other building cost
increases, and the City did hold a public hearing before adopting the Uniform Building Code.
The representatives requested the City staff to compile a report on the building fees
and work the department does.
Statement of Completion - Thomas, Dean & Hoskins - SID 610 - Woodridge Subdivision - Water
& Sewer SID 612 - Westridge Meadows - Water
The engineers of Thomas, Dean & Hoskins, Inc., on Special Improvement District No. 610
and 612 stating the water main, sanitary sewer and storm drain improvements in the Woodridge
Subdivision and Westridge Meadows by Underground Construction has been completed in accordance
with the plans and specifications, was presented.
This final acceptance does not relieve the contractor of responsibility for negligence
or faulty materials or workmanship within the standard period provided for by law.
The Contractor has furnished a performance bond equal to the contract bid to guarantee
materials and workmanship for a one year period to commence upon final acceptance.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that as re-
commended, the project be accepted as completed. The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner
Vandeventer, Commissioner MacNab, and Mayor Sedivy; those voting No, none.
"Call for Bids" - Silicofluoride for Water department - Bid opening January 16, 1980
The Water department has need for 42,000 1bs. Sodium Silicofluoride and the City Manager
requested authorization to call for bids for the purchase of the Sodium Silicofluoride
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the
Commission approve the request for the Sodium Silicofluoride and the Clerk of the Commission
be authorized and directed to publish a "Call for Bids" to be opened on January 16, 1980.
The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Swanson, Commissioner Vandeventer, Commissioner Vollmer, Commissioner MacNab, and Mayor Sedivy;
those voting No, none.
Claims
The general claims for the month of December 1979 were presented.
The City Manager had checked the claims and found them to be true and lawful claims
against the City of Bozeman, and recommended they be approved and the Director of Finance be
instructed to issue the warrants in payment.
It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the
Commission approve the claims. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Comm-
issioner Swanson, and Mayor Sedivy; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved
by Commissioner MacNab, seconded by Commissioner Vollmer, that the meeting be adjourned. The
motion was carried by the following Aye and No vote: those voting Aye being Commissioner MacNab,
Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, and Mayor Sedivy; those
voting No, none.
