HomeMy WebLinkAbout1979-11-29 I I I " I 0(;<: Bozeman, Montana 28 November 1979 The Commission of the City of Bozeman met in regular session in the Commission Room, Muni- cipal Building, November 28, 1979, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City Manager Gesko, City Attorney Planalp, and the Clerk. Commissioner Vollmer, opened the meeting with a prayer whereupon the minutes of the re- gular session held on Wednesday, November 21, 1979, were approved as submitted. Absence of Commissioner MacNab - November 28, 1979 It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the absence of Commissioner MacNab, from this meeting, be authorized in compliance with Chapter 7-3-4319, Montana Codes Annotated 1978. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Comm- issioner MacNab, and Mayor Sedivy; those voting No, none. BPOE #463 - re off-street parking assessment Several trustees of the Bozeman Elks Lodge No. 463 were present to discuss the off-street parking assessment for 1979. Gene Murray acting as spokesman for the group, stated the Elks were willing to pay their fair share, but found a forty percent increase over last year's SID assessment. Mr. Murray said the Elks protest last year was made with hopes of reducing the $876.00 annual levy the- club pays toward acquisition and construction of off-street parking. Mr. Murray further stated the clubs complairrwas based on what it considered over-assessment of two houses south of its property on East Babcock Street. Mr. Murray said that instead of reconsidering that assessment~ the City engineer's office re-evaluated the whole Elks property for the impact its use has on ~rking in the downtown area. The result was a forty percent boost in the tax from $876.00 to $1,225.00. The City engineer explained that when his department reviewed the property, which includes the Elks Club, the parking facilities, and two multi-family rental units north of the complex, their assessment came out higher. The City engineer said the Elks showed no interest in a meeting after the reassessment was done. The City engineer said the City was willing to meet the club half way on the reassessment and hold the line on the taxes if the Elks Club could lease forty more parking stalls for joint use from the First National Bank. Mr. Voegele of the First National Bank was also present to discuss the assessment. In re- viewing the off-street parking with their legal people and the insurance carrier, the First National Bank was advised not to enter into lease agreement with the Elk's Club because of the liability involved. Mr. Voegele said they were aware that persons from the Elks Club, as well as other individuals parked in the First National Bank parking lot in the evenings and on weekends. The City Attorney asked how the Elks parking lot was computed which resulted in the $878.00 assessment. The City Manager suggested that the Elks Club pay the $1,225.00 assessment under protest and if there is a reduction it will be applied against the 1980 assessment. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the City Attorney, the City Manager, the City Engineer and representatives from the Elks Club meet and try to arrive at a decision. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commiss- ioner Vollmer, and Mayor Sedivy; those voting No, none. Public hearing - Comm. Res. 2144 - Uniform Building Code - Ord. No. 1043 This was the time and place set for a public hearing to consider the adoption of the 1979 Edition of the Uniform Building Code (and Uniform Building Code Appendix). The Notice of Intention as published by the Clerk of the Commission was presented. The Building Inspector appeared to explain the Uniform Building Code. There were no written protests on file and no one appeared to protest verbally. The Mayor declared the public hearing closed. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the Commiss- ion waive the one week waiting period and pass and adopt Ordinance No. 1043 enacting the 1979 3813 Uniform Building Code. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Swanson, and Mayor Sedivy; those voting No, none. Public hearing - Comm. Res. 2145 - Abatement of dangerous buildings -- Ordinance No. 1044 - final psge. This was the time and place set for a public hearing to consider adopting the Uniform Code for the Abatement of Dangerous Buildings, 1979 Edition. The Notice of Intention as published by the Clerk of the Commission was presented. The resolution deals with the abatement of dangerous buildings. Such buildings would be the result of catastrophic damage, caused by floods, winds, hail storms, etc. The Building Inspector appeared to explain the abatement of dangerous buildings, 1979 Edition. There were no written protests on file, and no one appeared to protest verbally The Mayor declared the hearing closed. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission waive the one week waiting period and pass and adopt Ordinance No. 1044 enacting the Uniform Code for the Abatement of Dangerous Buildings, 1979 Edition as prepared by the City Attorney. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. ""r Public hearing - estimated assessments for final passage - Res. 2124 - SID 594 - Paving Blk 5, Figgins Addition - $76,000.00 This was the time and place set for a public hearing on levying the estimated assessment on Commission Resolution No. 2124 - SID No. 594, paving Healy and Langohr Avenues, all in Block 5, Figgins Addition in the estimated amount of $76,000. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that Commission Resolution No. 2124 be finally passed and adopted. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner Vollmer, and Mayor Sedivy; those voting No, none. Public hearing - estimated assessment for final passage - Res. 2125 - SID 595 - Watermain - NorthwoodDr. (Wheat's Subdivision) - $40,000.00 This was the time and place set for a public hearing on levying the estimated assessment on Commission Resolution No. 2125 - SID No. 595, watermain construction on Northwood Drive in Wheat's Subdivision in the estimated amount of $40,000.00. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that Comm- ission Resolution No. 2125 be finally passed and adopted. This was the time and place set for a public hearing on levying the estimated assessment on Commission Resolution No. 2126 - SID No. 596, sanitary sewer construction on Meadow Lane South to Griffin Drive and on Griffin Drive, McChesney Subdivision in the estimated amount of $105,000.00 It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that Commission Resolution No. 2126 be finally passed and adopted. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that Commission Resolution No. 2127 be finally passed and adopted. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that Commission Resolution No. 2130 be finally passed and adopted. Commission Res. 2148 - Amend Budget - $11,000. Library gift from Mrs. Heeb Porter Commission Resolution No. 2148, amending the municipal budget of the City of Bozeman to reflect additional revenues of $11,000.00 from the donation received from Mrs. Dorothy Porter, as prepared by the City Attorney, was presented, entitiled: COMMISSION RESOLUTION NO. 2148 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA AMENDING THE MUNICIPAL BUDGET OF THE CITY OF BOZEMAN TO REFLECT IN- CREASED REVENUES OF $11,000.00 AND INCREASED EXPENSES FOR SALARY, WAGES, BENEFITS AND EQUIPMENT OF $11,000.00. The Library Board indicated how they want the $11,000.00 spent. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the Commission pass and adopt Commission Resolution No. 2l48, amending the municipal budget to reflect the increased revenue of $11,000. Application - Liquor license (1/2 yr.) Red Barn Specialty - M. Klabunde The City Manager presented an application from Maurice Klabunde of the Red Barn Specialty Foods, along with the appropriate fee for a liquor license, for one-half year, ending December 31, 1979. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the Commission approve the application for the liquor license. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that Commission Resolution No. 2140 be provisionally passed and adopted, and Wednesday, December 5, 1979, be the date set for public hearing. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the claims be approved. Reports - Director of Public Service for September Police Court - July & August The City Manager presented the report of the Director of Public Service and the Police Court for acknowledgement and filing on Wednesday, December 5, 1980.
