The Commission of the City of Bozeman met in regular session in the Commission Room,
Municipal Building, November 21, 1979, at 1:15 o'clock p.m. Present were Mayor Sedivy, Comm-
issioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City
Manager Gesko, City Attorney Planalp, and the Clerk.
Commissioner MacNab opened the meeting with a prayer whereupon the minutes of the
regular meeting held on Wednesday, November 14, 1979, were approved as submitted.
Ordinance No. 1040 - Annexation of Allison property - effective April 1, 1980
Ordinance No. 1040 annexing a tract of land located in Section 24, T2S, R5E, M.P.M.,
Gallatin County, Montana, as prepared by the City Attorney was presented, entitled:

This was the time and place set for a public hearing on levying the estimated assess-
ment on Commission Resolution No. 2119, sanitary sewer construction on Bryant Street, Bond
Street, and Gold Avenue, Bomont Subdivision, in the estimated amount of $80,OOO.OQ.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that Commission
Resolution No. 2119 provisionally passed and adopted on November 14, 1979 be finally passed.
The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, and Mayor

Res. No. 2120 - SID 589 - estimated assessment -Watermain - Bomont Subdivision
This was the time and place set for a public hearing on levying the estimated assess-
ment on Commission Resolution No. 2120, watermain construction on Bryant Street, Bond Street,
and Gold Avenue, Bomont Subdivision, in the estimated amount of $32,000.00.
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that
Commission Resolution No. 2120 provisionally passed and adopted on November 14, 1979 be
finally passed. The motion was carried by the following Aye and No vote: those voting Aye
Being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner

Res. No. 2121- SID 591 - estimated assessment - Watermain - Northeast Annexation
This was the time and place set, for a public hearing on levying the estimated assess-
ment on Commission Resolution No. 2121, watermain construction in the North~ast, Nelson,
and McChesney Annexation SID No. 591, in the estimated amount of $440,000.00.
It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that
Commission Resolution No. 2121 provisionally passed and adopted on November 14, 1979, be
finally passed. The motion was carried by the following Aye and No vote: those voting Aye

Comm. Res. 2123 - SID 593 - estimated assessment - San. Se,w. - Figgins Addn.
This was the time and place set for a public hearing on levying the estimated assess-
ment on Commission Resolution No. 2123 - Sanitary Sewer construction on Langohr and Healy
Avenues in Figgins Addition SID No. 593 in the amount of $25,000.00.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that Comm-
ission Resolution No. 2123 provisionally passed and adopted on November l4, 1979 be finally
adopted. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab,
and the Mayor; those voting No, none.
Revision - Parking fines
Consideration of the revised schedule for parking fines having been continued for a
period of one week was brought back for discussion.
Mr. Gesko advised the Commission that he had no objections recorded with him since
the last meeting, and since the increased fine schedule was broached.
He advised the Commission that the City intends to aim at free parking--both on-and
off-street--as the ultimate goal for the downtown area. The parking lots initially are
intended to be free, with a two-hour limit. If the meters can ultimately (soon) be removed
as well, and a two-hour limit imposed on-street as well, this will again allow for free
parking. Unless someone abuses the "free" aspect, namely tht two hour limit, they will not
feel the brunt of any fine whatsoever. But if the parking--both on-and off-street--must be
monitored to observe the two-hour limit, and if this must be done by marking tires, it will
take a greater effort than the City presently has to monitor only on-street meters. The
present $1.00 fine (minus the cost of postage and handling) really does not cover the cost
of monitoring and collection--particularly if the fine becomes delinquent.
Commissioner MacNab recommended that the City go ahead with the proposed fine schedule.
Following discussion, it was moved by Commissioner MacNab, seconded by Commissioner
Vollmer, that the Commission instruct the City Attorney to draft au ordinance to change the
fine schedule as set forth in full:
Overtime parking fines from $1.00 to $3.00
Loading zone violations from $3.00 to $5.00
and to remove postage paid from the envelopes
attached to the parking tickets.
Those voting Aye being Commissioner MacNab and Commissioner Vollmer; those voting No
being Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy. The motion failed.
Big Brothers & Sisters - request for fund drive - request to use telephone for. fund drive
A letter received from the Big Brothers and Sisters requesting permission to sell its
Food, Fun, and Inflation Fighrers to the general public as a major fund raiser for the
organization was presented.
It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the
Big Brothers and Sisters be given permission to hold the fund drive.
A letter received from the Big Brothers and Sisters requesting permission to sell its
Food, Fun and Inflations Fightersto the general public by the use of telephones was presented.
The Commission advised the representatives of Big Brothers and Sisters that permission
for the use of telephone is not necessary under the existing ordinance.
Request for Sign Variance - Super Eight Motel
A request from the Super Eight Motel for a sign variance was presented.
The sign is proposed to be 32 feet high--which is OK-- and about 10 feet wide. The
basis for the variance is that the bottom of the sign (containing electrical apparatus) should
be 10 feet minimum above the grade. Theirs will be slightly less than that. However, the
electrical apparattls will be approximately 12 feet above grade.
The Commission concurred in the recommendation of the Building Inspector, also con-
curred in by the City Manager, and it was moved by Commissioner MacNab, seconded by Commissioner
Vollmer, that they approve the sign variance for the Super Eight Motel. The motion was carried
by the following Aye and No vote: those voting Aye being Commissioner MacNab, Commissioner
Vollmer, Commissioner Swanson, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none.

Site Location - Senior Transportation Garage
I
The City staff visited several City-owned sites, on which a senior transportation bus
garage could be built. They felt the bus garage could be built on the Humane Shelter site
without fear of settlement because of prior use of the land.
Following discussion, the City Manager requested permission to construct a senior bus
transportation garage on the Humane Shelter site.
The Senior Citizens had no objection to the Humane Shelter site as the site for the
construction of the garage.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the
property of the Humane Society be used for the purpose of constructing the senior transpor-
tation bus garage. The motion was carried by the following Aye and No vote: Those voting
Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner
MacNab, and Mayor Sedivy; those voting No, none.

Authorization to purchase 3,000' 3/4" K. Coppper Tubing - 86i per foot
The City Manager requested authorization to purchase 3,000 feet 3/4" K-Copper Tubing
for the Water department at 86i per foot.

Manager be granted permission to purchase 3,000 feet K-Copper Tubing for the Water Department.

on the landfill property, for exploration for oil and gas leases, was presented.
The Lease Agreement would allow the broker for AMOCO to buy oil and gas leases in this
area at $5.00 per acre to sign, $1,00 per acre per year rental on the ten year lease, and a
12 l/2% royalty on any oil or gas produced.
The land is in TIS, R6E, the Bozeman Refuse Disposal District in Section 30.
The City Attorney advised the Commission to refuse the Lease Agreement.
Complaint on bushes extending over public sidewalks
A letter received from Jerry Prescott of 1105 W. Curtiss Street was presented.
Mr. Prescott complained of bushes extending over public sidewalks.
The City Engineer suggested thattne City consider an Ordinance making it a violation
for a property owner to let his bushes grow out over a public sidewalk, street, or alley.
It was moved by Commissioner MacNab, seconded by Commissioner Swanson, that the City
Attorney be instructed to draw an ordinance to take care of this problem. The motion was
carried by the following Aye and No vote: those voting Aye being Commissioner MacNab, Commiss-
ioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, and Mayor Sedivy; those voting
