HomeMy WebLinkAbout1979-11-14 I 3G8 Bozeman, Montana November 14, 1979 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, November 14, 1979, at l:lS o'clock p.m. Present were Mayor Sedivy, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City Manager Gesko, City Attorney Planalp, and the Clerk. Commissioner Vandeventer opened the meeting with a prayer whereupon the minutes of the regular session held on Wednesday, November 7, 1979 were approved as submitted. Status report - Library Dick Prugh of Mattson, Prugh, and Lenon, Architects for the new Library, gave a status report on the plans for the library. He explained how the architecture maximized a southern exposure to utilize passive solar heating. Mr. Prugh advised the Commission that his firm was aiming for early February as the completion date for designs. Decision - Annexation of Allison property The Allison Annexation hearing was held on October 24, 1979 and any action was deferred for a period of at least twenty days for comments for or against the proposed annexation. The City Manager recommended that the Commission approve the Annexation as of April 1, 1980 in order to afford additional time to resolve the City's attempts to acquire additional water rights. It was moved by Commissioner MacNab, sAconded by Commissioner Vollmer, that the Commission approve the Allison Annexation with an effective date of April 1, 1980. The Commission directed the City Attorney to draw up an ordinance to be brought in on November 21, 1979 but that it not become effective until April 1, 1980. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. Decision - Conditional Use Permit - Everett Egbert - construct building Bozeman Industrial Park The decision on the request of Everett Egbert for a Conditional Use Permit, having been delayed for a period of one week, was brought before the Commission for a decision. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission concur in the recommendation of the Bozeman Zoning Commission, also concurred in by the City Manager, and approve the Conditional Use Permit with the following conditions: 1. Signing shall be limited to the dimensions, locations, and number as detailed in the site plan submitted for this Zoning Commission hearing. Said signs shall not be illuminated nor blinking, flashing, or animated. No mobile, portable, or temporary signs shall be used on the site. No external lighting apparatus shall be attached to signs used in conjunction with the proposed use. 2. All landscaped areas shall be enclosed by permanent concrete or asphaltic curb- ing at least six inches in height to prevent vehicular traffic across landscaped areas. The landscaped areas adjacent to Industrial Drive shall also have 'perm- anent curbing extending along this frontage. 3. A sidewalk, minimum of three feet in width, shall be provided south of and adjacent to the building, extending the full length of the building. 4. All parking spaces and ingress/egress areas shall be paved (asphalt). 5. All on-site improvements (i.e., paving, landscaping, etc) shall be completed by June 30, 1981. 6. The conditional use permit shall be valid to June 30, 1981, and the appl~.~ant shall petition the City Commission for renewal at that time. Failure of the applicant to satisfy all conditions within the designated time period may be ground for terminating the conditional use permit. If all required conditions have been satisfied, the permit shall be permanently renewed. Kagy Boulevard Ralph Zimmer of the Technical Advisory Committee appeared before the Commission to advise them that the Technical Advisory Committee had held a meeting on Friday, November 9, at which time they had a rather open, candid discussion. He further advised the Commission he had reason to believe that the Concerned Citizens Forum had taken action before the meeting. Mr. Zimmer thinks people are beginning to loose their objective as to the decision and asks that they make every effort to cut through the emotional aspect. I I I ( (f v 0":: consideration. Mr. Zimmer urged the Commission to delay their decision on Kagy Boulevard until December Mr. Zimmer stated relative safety merits of various alternative designs for Kagy Boulevard should be referred to the Bozeman Pedestrian Traffic Safety Committee for its I 12, 1979. A letter received from the Bozeman Chamber of Commerce was also read. They requested that the City Commission make their final decision at their December l2th meeting, and that The City Commission refer the latest proposals to the Technical Advisory Committee, the Policy Coordinating Committee, and the Pedestrian-Traffic Safety Committee for their consideration. Mr. Mazanec, President of the Concerned Citizens Forum, Inc., presented a compromise for the construction of Kagy Boulevard between Third Avenue and Highland Boulevard. He stated the Concerned Citizens Forum, Inc., will accept the proposal offered by Ralph Zimmer of the Technical Advisory Committee on the Kagy Boulevard with certain qualifications. Mr. Waver urged Mr. Gesko to check every compromise with Mr. Steward before any action is taken. David Wessel of 544 Kagy Boulevard indicated that he will be submitting a proposal to be considered by the various review committees and the City Commission. Mr. Gesko said he would like to have the proposal presented to the various persons for review before bringing it before the Commission for a decision. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Commission table their decision on Kagy Boulevard until Wednesday, December 12th or 19th. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, and Mayor Sedivy, those voting No, none. Comm. Res. 2112 - SID No. 579 - Pave Bozeman Creek Annexation - $11,226.25 Final passage This was the time and place set for a public hearing on levying the final assessment on Commission Resolution No. 2112, SID No. 579, paving portions of Hayes Street shown on the Sub- division Plat of Tract 12, Bozeman Creek Annexation, in the amount of $11,226.25 It was moved by Commissioner Vandeventer, seconded by Commissioner Swanson, that Comm- ission Resolution No. 2112 provisionally passed and adopted on November 7, 1979, be finally passed and adopted. Pump-n-Pak - re modification to original Conditional Use Permit A letter received from Galen L. Bykonen, owner of Pump-n-Pak, regarding modification to the original Conditional Use Permit, was presented. poles and one 4' X 6' gas price sign for the Pump-n-Pak located at 2020 North Seventh Avenue. The Planning Director advised the Commission, that Mr. Bykonen's development represented an excellent example of improved gas station design and hoped that it would serve as an example for other similar developments in the future. However, he indicated that a small landscaped area to the north of the property remains to be completed and that the gas price I I I vlJ merchandise signs could be integrated with the gas pump islands or the canopy at this location. He further indicated that the Commission had already approved this concept. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Comm- ission approve the signs Mr. Bykonen has now. Easement and Right of Way Agreement - between Don Weaver & City of Bozeman An Easement and Right of Way Agreement by and between Don Weaver and the City of Bozeman for the purpose of constructing and installing a waterline on the South portion of the City of Bozeman, and located on Kagy Boulevard, was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Comm- ission approve the Easement and Right of Way Agreement as presented. Certify Examination of Depository Bonds & Securities - September 30, 1979 In compliance with the provisions of Chapter 7-6-201 Montana Code Annotated, 1978, Mayor Sedivy and Commissioner Vollmer proceeded to examine the receipts of Depository Bonds and Sec- urities held by the Director of Finance as Security for City funds deposited in Bozeman banks. Revision of fines - Parking fines The City Manager suggested that the Commission increase the parking fines. He said the current fines do not cover the cost of processing them. He urged the Commission to increase overtime parking fines from $1.00 to $3.00, loading zone violations from $3.00 to $5~OO, and to remove postage paid from the envelopes attached to the parking tickets. The Commission agreed to consider the suggestion for a week before taking action because downtown merchants had not been contacted about the revised schedule. Death of Chris Schlecton - November 11, 1979 Mayor Sedivy extended his condolences to the family of Chris Schlecton. He also re- quested that a letter be sent on behalf of the City Commission, expressing their appreciation for Mr. Schlecton's contributions to the City of Bozeman. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission acknowledge all of Mr. Schlecton's contributions to the City of Bozeman.
