HomeMy WebLinkAbout1979-11-07 November 7, 1979 Bozeman, Montana I The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, November 7, 1979, at 1:15 o.clock p.m. Present were Mayor Sedivy, Com- missioner Ma0Nab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City Manager Gesko, City Attorney Planalp, and the Clerk. Commissioner Vollmer opened the meeting with a prayer whereupon the minutes of the regu- lar meeting held on Wednesday, October 31, 1979 were approved as submitted. Public Hearing - Conditional Use Permit - Everett Egbert - Construct electrical supply building - Bozeman Industrial Park This was the time and place set for a pUblic hearing to consider the Conditional Use Permit for Everett Egbert. The applicant seeks a conditional use permit which, if granted, would allow the construction of a wholesale electrical supply building on Lot 5B in the Bozeman Industrial Park. The Planning Director presented the staff report which recommended approval thereof with conditions. The applicant was present to answer any questions that might arise. The Mayor declared the hearing closed and a decision will be forthcoming on Wednesday Novem- ber 14, 1979. I Decision - Comm. Res. 2102 - Paving Koch Street - 20th to 23rd - SID 616 The decision on Commission Resolution No. 2102, SID NO. 616, paving and storm drainage con- struction on West Koch Street between South 20th and South 23rd Avenue having been delayed for a week was brought before the Commission. It was moved by Commissioner ~1acNab, seconded by Commissioner Vollmer, that the Commission approve the creation of Special Improvement District No. 616, and instruct the City Attorney to draw up a resolution creating the district to be brought in for action on November 14, 1979. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none. I Decision - Conditional Use Permit - Don Harrington - construct 8,000 sq. ft. addition to existing Pepsi Cola Warehouse in Bridger Center Subdivision The decision on the request of Don Harrington who seeks a Conditional Use Permit having been delayed for a period of one week, was brought back for action. The Commission concurred in the recommendation of the Zoning Commission, also concurred in by the City Manager, and it was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission approve the request for a conditional use permit to allow the con- struction of an 8,000 square foot addition to the existing Pepsi Cola warehouse on Lot 3 Block 3, in the Bridger Center Subdivision with the following conditions: 1. Signing shall be limited to the dimensions, locations, and numbers as detailed in the site plan submitted for this Zoning Commission hearing. Said signs shall not be illuminated nor blinking, flashing, or animated. No mobile, portable, or temporary signs shall be used on the site. No external lighting apparatus shall be attached to signs used in conjunction with the proposed uses. 2. All landscaped areas shall be enclosed by permanent concrete or asphaltic curbing at least six inches in height and/or split rail fence (per site plan) to prevent vehicular traffic across landscaped areas. The landscaped areas adjacent to Bridger Center Drive shall also have permanent curbing and/or fencing extending along this frontage. All parking spaces and ingress/egress areas shall be All on-site improvements (i.e., paving, landscaping, June 30, 1981. 5. The conditional use permit shall be valid on June 30, 1981, and the applicant shall petition the City Commission for renewal at that time. Failure of the applicant to satisfy all conditions within the designated time period may be grounds for terminating the conditional use permit. Kagy Boulevard The Technical Advisory Committee and the Policy Coordinating Committee had a special meeting , r, \ V ,~,.:) 380 on Monday, November 5, 1979. The compromise suggested by the Concerned Citizens Forum was discussed and considered in some detail by both the membership of the Technical Advisory Committee and the Policy Coordinating Committee. A revision of the compromise proposal was made and voted upon, and was narrowly defeated. Following much discussion the following resolution was approved by the Technical Advisory Committee and the Policy Coordinating Committee. liThe project will be built as presently designed with the understanding that the project will be maintained and operated as a two-lane facility and so specified in the Federal Aid Project Agreement. Any proposal by the City or State to con- vert the project to four-lane operation will be supported by a study, including adequate public involvement to fully consider the engineering, safety, economic, social and environmental effects of the conversion to four-lane facility." The City Manager said the Concerned Citizens Forum had approved excavation of the entire ninety-foot right-of-way to accommodate the present plan. Further, they had approved installa- tion of sidewalks at the extremities of the right-of-way on each side. This amount of con- struction would have as much disruption as if a full four lanes were constructed on the surface. He felt that as long as that accommodation had been conceded, perhaps the present plan should be built. If assurance were given: through the above proposed resolution and its inclusion in the Federal Aid Project Agreement, that the City Commission alone could not change the format from two- to four-lane, perhaps this would satisfy this particular objection. Bing Mazanec, president of the Concerned Citizens Forum, was present and advised the Com- mission that he had already talked with his group, and they would not accept the Technical Advis- ory Committee plan. Don Weaver, a resident near Kagy, offered a plan that fell somwhere between the Technical Advisory Committee and the Concerned Citizens Forum. The plan called for a 17-foot median, a 12-foot driving lane, and an 8-foot emergency parking lane, and 5-feet of graveled shoulder. Mr. Weaver advised the Commission, that he had talked to the City Engineer and the Planning Director and they would accept the above plan. Members of the Commission would not accept the proposed compromise submitted by Mr. Weaver, and stated that if the Concerned Citizens Forum does not accept the City's plan with the cri- teria for a four-lane facility, the Commission will request an Environmental Impact Statement. Certified Mill Levy A letter received from the City Attorney, expressing his oplnlon concerning the legal duty of the City of Bozeman as it affects the recent receipt by the City of the new taxable valu- ations for the current fiscal year was presented. The City Attorney stated that in his opinion the current taxable valuation recently received from the County Assessor shall be used, and the tax levy shall be no higher than is necessary to raise the amount set out in the budget. Following discussion, it was moved by Commissioner Swanson, seconded by Commissioner Van- deventer, that Commission Resolution No. 2141 revising Commission Resolution No. 2105 setting the 1979-1980 tax levy at 95.43, as prepared by the Director of Finance be passed and adopted as set forth in full: Section 1 That for the purpose of providing and maintaining basic City services, the City Commission of the City of Bozeman, Montana, does hereby affix 60.49 mills to be levied for the All-Purpose General Fund for all sal- aries, operations and capital expenditures for general government pur- poses as provided by Section 7-6-4451, M.C.A., 1978. Section 2 That the City Commission of the City of Bozeman hereby affixes a 2.36 mill levy for the State-mandated Police Retirement System in order to maintain payments to the State-administered Police Retirement System in accordance with Section 19-9-704, M.C.A., 1978. Section 3 That the City Commission of the City of Bozeman, Montana, hereby affixes 3.79 mills to be levied for the purpose of maintaining the State-mandated City contribution for the Police Retirement Unfunded Liability, which provides for all actuarial costs established by the State Retirement System, as required by that body. Said 3.79 mill levy to be established in accordance with Section 19-9-704, M.C.A., 1978. I I I ';;' ." '..) 0 J.. I Section 4 The City Commission of the City of Bozeman, Montana, hereby establishes and affixes a 1.52 mill levy to provide for the total City payment of premiums for Firefighters and Police Officers Health/r1edical Insurance as required by the State of Montana. Said 1.52 mills to be affixed in accordance with Section 7-32-4117 and 7-33-4130, H.C.A., 1978. Section 5 The City Commission of the City of Bozeman, r1ontana, does hereby affix a 1.40 mill levy established to provide funds for the Firefighters dis- ability and Pensin Fund as required by the State of Montana. The a- forementioned 1.40 mill levy to be affixed in accordance with Section 19-11-503 and 19-11-504, M.C.A., 1978. Section 6 That the City Commission of the City of Bozeman, r1ontana, does hereby affix and establish a mill levy in the amount of 2.07 mills to provide for City contribution to the State retirement system for employees other than Firefighters and Police Officers, said money to be paid to the Public Employees' Retirement System. The above-referenced 2.07 mill levy to be affixed in accordance with Section 19-3-204, M.C.A., 1978. Section 7 The City Commission of the City of Bozeman, Montana, does hereby estab- lish and affix a mill levy in the amount of 2.01 mills to provide funds for Liability Insurance protection and coverage for the City of Bozeman, r.1ontana. Said mill levy amounting to 2.01 mills is herein affixed in accordance with Section 2-9-212, M.C.A., 1978. Section 8 That the City Commission of the City of Bozeman, Montana, does herein establish and affix a mill levy amounting to 1.86 mills to provide funds for the operation of the City-County Planning activity. Said Mill levy amounting to 1.86 mills is hereby established and affixed in accor- dance with Section 76-1-406, M.C.A., 1978. Section 9 That the City Commission of the City of Bozeman, Montana, does hereby establish a mill levy in the amount of 1.32 mills to provide for the principal and interest payments on outstanding City Hall General Ob- ligation Bonds. Said 1.32 mill levy established herein shall be affixed in accordance with Section 7-7-4265, M.C.A., 1978. Section 10 That the City Commission of the City of Bozeman, Montana, does hereby establish and affix 2.55 mills to provide for the existing principal and interest payments on outstanding Recreational Facilities General Obligation Bonds. Said 2.55 mills are hereby established and affixed in accordance with Section 7-7-4265, H.C.A., 1978. Section 11 That the City Commission of the City of Bozeman, Montana, does hereby establish and affix 1.71 mills to provide for the existing principal and interest payments on outstanding Senior Center General Obligation Bonds. That the 1.71 mill levy herein established is hereby affixed in accordance with Section 7-7-4265, M.C.A., 1978. I I Section 12 The City Commission of the City of Bozeman, Montana, does herewith establish a 6.50 mill levy to provide for principal and interest pay- ments on outstanding Library General Obligation Bonds. That the 6.50 mill levy established herein is hereby affixed in accordance with Section 7-7-4265, M.C.A., 1978. Section 13 The City Commission of the City of Bozeman, Montana, does hereby es- tablish and affix 7.85 mills to provide the necessary funds for the City to maintain its present employees and continue services at exist- ing levels, pursuant to an election held on September 11, 1979, at which time said 7.85 mill issue was duly passed and approved by the electorate of the City of Bozeman, in accordance with Section 7-6-4431, ~1.C.A., 1978, as amended by Senate Bill No. 235, passed during the 1979 State Legislative Session. The motion was carried by the following Aye and No vote, those voting Aye being Commiss- ioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, and Mayor Sedivy, those voting No, none. Senior Center Use Policies The proposed building use policies as drafted and approved by the Senior Citizen Ad- visory Council was presented. It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the Commission approve the rules, regulations, rental schedule, check-list for securing Senior Center and Senior Center use contract form, also to include the whole harmless liability I clause as recommended by the City Attorney. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, and Mayor Sedivy; those voting No, none. Senior Center Meals on Wheels Request The Bozeman Meals on Wheels requested permission to use the kitchen facilities in the Senior Center on North Tracy Avenue. The Senior Citizen Advisory Council, at their meeting held on November 6,1979 recommended approval of the Meals on Wheels program as proposed. The City Manager said that even though he did not disagree with the program, the provision of funds to cover such extensive utility costs is yet another matter. The Commission advised the citizens the power bill would be monitored and if it were too high the center would be billed. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commission approve the Meals on Wheels program as set forth in the original program with two minor changes. 1. The sponsoring organization of Meals on Wheels will be responsible for all expenses for maintaining the kitchen to meet health requirements, pre- paration and serving of meals, purchase and payment of food, and the hiring and termination of personnel to staff the program. 2. The kitchen area, stoves, refrigerators, work tables, and cooking utensils will be made available Monday through Friday from 8:00 A.M. until 11:30 A.M. 3. The use of the kitchen telephone will be made available for local calls. Meals on Wheels to pay 10% of the cost. 4. Storage area which can be locked for groceries, supplies, TV dinner trays, I utensils, etc. will be arranged for. 5. Normal maintenance and repairs of equipment and appliances are the re- sponsibility of the owners. 6. A portion of the dining area will be made available for a future walk- in type meals program. 7. Utilities will be supplied by City. The changes are as follows: Meals on Wheels to provide insurance coverage on their own property and pro- duct/liability coverage if deisred. 352 Adequate provision for storage of money will be the responsibility of the Meals on Wheels. Ordinance No. 1039 - Jahnke Annexation (Valley Unit Development) Ordinance No. 1039 annexing the NE 1/4 of Section 10, T2S, R5E, M.P.M., Gallatin County, Montana, excepting therefrom a tract of land in the NE 1/4 NE 1/4 of Section 10, and the SE 1/4 of Section 10, T2S, R5E, M.P.M., Gallatin County, Montana, excepting therefrom the following described tract of land: beginning at the East 1/4 corner of Section 10 in T2S, R5E, M.P.M., and bearing North 88051' West along the North line of the SE 1/4, a distance of 320.0 feet, thence South 2028' West along the North line of the SE 1/4, a distance of 320.0 feet, thence South 20281 West and parallel to the East line of said Section 10, a distance of 204.18 feet thence South 88051' Ease and parallel to the North line fo said SE 1/4 a distance I of 320.0 feet, thence North 20281 East along the east line of said Section 10, a distance of 204.18 feet to the point of beginning, was presented as prepared by the City Attorney. ORDINANCE NO. 1039 AN ORDINANCE ANNEXING CERTAIN DESCRIBED LANDS SITUATE WEST OF THE CITY OF BOZEMAN, TO THE CITY OF BOZEMAN. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that Ordinance No. 1039 be passed and adopted to become effective April 1, 1980. I Zone Code Variance - Dale Fil1bach- replacing 14' x 681 Fleetwood trailer on property - City Water Reservoir A letter received from Gerry M. Higgins, representing Dale Fil1bach, requesting a variance to the Zoning regulations, was presented. Mr. Fillbach owns approximately ten acres of land which is presently zoned A-S. Mr. Fill- bach is requesting a variance to place a Fleetwood 1978 model trailer house, 14' x 681 on the property. The Commission acknowledged receipt of the request and recommended that it be referred to staff for research and a recommendation in a period of one week. Sign Variance ~ Willson school yard on Main Street A letter received from the Bozeman School District No.7, requesting approval to construct a marquee in front of the Willson School, was presented. The Willson School requested a variance to construct a 12.0' X 5.21 wood sign in Fire Zone 1 with an electrical sign only 1'4" above grade. The code requires that the electrical sign be 10'0' above grade. The Building Inspector recommended that the Commission approve the Wood sign in the Fire Zone 1 district, but that they deny the Electrical sign. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commission approve the 12.0' X 5.2' wood sign but deny the electrical sign. Easement & Right of Way Agreement - Sam C. Powell, Jr., & Carolyn S. Powell Waterline _ property at 307 and 311 North Church Avenue An Easement and Right of Way Agreement by and between Sam C. Powell, Jr., and Carolyn S. Powell parties of the first part and the City of Bozeman, the party of the second part was presented. The purpose of the Easement is to install a waterline thereto upon and across Block 1, Lot 3 of Babcock and Davis Addition to the City of Bozeman. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission approve the Easement and Right of Way Agreement as presented. Res. 2112 - 2112 - paving Bozeman Creek Annexation SID 579 - $11 ,226.25 - final assessment hearing November 14, 1979 Commission Resolution No. 2112 levying the final assessment for the installation of paving and storm drain pipe on portions of Hayes Street shown on the subdivision plat of Tract 12, Bozeman Creek Annexation, SID No. 579 in the amount of $11,226.25 was presented entitled: COMMISSION RESOLUTION NO. 2112 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 579 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 579.
