HomeMy WebLinkAbout1979-08-29 Tribute to City Manager Gesko I 300 August 29, 1979 Bozeman, Montana 59715 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, August 29, 1979, at 1:15 o'clock p.m. Present were Mayor Sedivy, Com- missioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City Manager Gesko, Ass't City Manager Smith, City Attorney P1analp and the Clerk. Commissioner Vandeventer opened the meeting with a prayer whereupon the minutes of the regular meeting held on Wednesday, August 22, 1979, were approved as submitted. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the letter paying tribute and supporting City Manager Gesko be made a part of the minutes as follows: On behalf of the Mayor and the three other Commissioners, I respectfully request a few minutes to address an important matter which we feel requires clarification. I wish to speak directly to all members of the press in atten- dance here today as well as those not in attendance, and also to all citizens of Bozeman. It was recently brought to our attention via the editorial in the Sunday, August 26, 1979, issue of the Bozeman Daily Chronicle that possibly our stand regarding the City Manager has been misunderstood by some citizens, including Chronicle Editor, Larry Wills. His editorial states that a meeting of the Com- missioners was held and a vote taken, the results of which were three to retain and two to dismiss Mr. Gesko as City Manager of Bozeman. Please let the record show that we, the present City Commission, have held no such meeting as was reported by Mr. Wills. Neither have we at any time en- gaged in a vote regarding Mr. Gesko's continued employment. There have been times and there will be more, we are certain, when we disagree among ourselves on various issues, and also when one or more of us disagrees with Mr. Gesko's views on certain matters. He provides us with the facts of a given situation--both pro and con. Always he advises us as to what he feels is in the best interests of the City. This is his job. Sometimes we agree with him--sometimes we disagree. The vote is taken and the majority rules. This is a healthy relationship between the City Manager and the Commission which results in good decision making on the part of the Commission. Mr. Wills also stated that Mr. Gesko has been campaigning around town to defend himself. This is entirely unfounded since we, the City Commissioners, requested Mr. Gesko to bring the problems involved and the solutions to the people via the printed media, radio, television and also personal appearances at service and other organizations. He was acting solely on our directives and in the best interest of the citizens who wanted to know the facts. It should also be noted that Mr. Wills himself asked Mr. Gesko to write the articles which have appeared in the Chronicle. I In talking with several City Hall employees, we do not find the morale as reported in the Chronicle. In contrast, the employees are glad that things are running as smoothly as they are considering the problems that have sur- faced recently. Some have even verbally given credit to Mr. Gesko for bring- ing every think out in the open and finding the solutions to put the City back in the black. Yesterday afternoon, I personally received two telephone ca11s--one from Mac Bryant, Executive Director of the Chamber of Commerce, and the other from Sherman Veltkamp, representing the Downtown Development Corporation and the Bozeman Merchants Association. Both sympathized with the bad press the City has been getting for they, too, stated that they have been misrepresented by the Bozeman Daily Chronicle. Both individuals expressed that their groups are largely behind and support the City Manager, which is contrary to what the ed- itorial stated. Some very serious problems which began long ago have been stopped tracks and some even turned around. The City went from red to black. people had a hand in the turnaround but all under the direction of Sam in their Several Gesko. I It was not an easy job, and we feel it took a man of courage, wisdom and honesty to accomplish it. We as a Commission feel those qualities in a City Manager are far more valuable to the citizens of Bozeman than good rapport with the press. We respect Sam Gesko for NOT being a YES man. He was hired to manage the City for the benefit of its present citizens as well as citizens of the future. We feel he is doing this. We, the City Commissioners, support Sam Gesko in his continuing efforts to guide our City, not only for all of us but for his own family as well. It is now time that we, the City Commission, the press, the City employees and all citizens re-unite for the purpose of making Bozeman a great city in which to live. Signed: Edmund P. Open Construction Bids - SID 608 - Paving Figgins 4th SID 614 - Paving Garfield Between Tracy & C.M. Railroad This was the time and place set for the opening of bids for SID No. 608 paving construction Figgins Fourth, and SID 614 Paving Garfield Street between Tracy Avenue and the Chicago, Milwaukee Railway. The affidavit of publication for the "Call for Bids" as advertised was presented. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the bids be opened and read. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none. The bid of Long Construction Company being the only bid submitted was opened and read. Long Construction, Billings - SID 608 - SID 614 - $312,915.00 32,268.50 $345,183.50 I It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the bid of Long Construction Company be referred to the Consulting engineers and City engineers for eval- uation and a recommendation to be made to the Commission on Wednesday, September 5, 1979. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy, those voting No, none. Public Hearing - proposed Industrial Development Revenue Bond Issue for the Montana Bank of Bozeman I This was the date set for the public hearing on a proposed project under Section 90-5-104. The proposed project will consist of acquisition of land and construction of a new Montana Bank Bui1ding(s) and facilities at a cost presently estimated not to exceed Four Million and No/100th ($4,000,000) dollars. Funds for this purpose will be provided by the issuance of Industrial Development Revenue Bonds. The bonds and interest coupons shall not constitute nor give rise to a pecuniary liability of the City or a charge against its general credit or taxing power. The Mayor declared the hearing open. The City Attorney advised the Mayor that before proceeding with the hearing, the records sho1d reflect that a protest and motion for continuance from the First Security Bank of Bozeman has been received. The protest of First Security Bank to the issuance of said bonds is based upon the fact that such issuance is not in the public interest, but is for a private banking corporation. The request is for a one week continuation. The City Attorney asked if the petitioner had a position on this request. Joe Sabol, representative for the petitioner, said he would resist such a motion. He stated Commission Resolution No. 2083 calling for a public hearing on a proposed project under Section 90-5-104 Montana Code Annotated was passed July 25, 1979. The hearing was advertised for August 29, 1979. The notice of public hearing was advertised on August 8, 15, and 22, 1979. There have also been several newsy type articles. The First Security Bank stated they would not object to the petitioners holding the public hearing if they would give them an additional week to prepare their opposition. Mr. Sabol said that if the Commissioners gave the protestors an additional week to continue the matter it would put the Montana Bank of Bozeman at a disadvantage. The City Attorney recommended that the Commission act upon one of three possibilities: 1. That the hearing be opened and the petitioner be allowed to proceed if he wishes and continue the hearing for a period of one week. 2. Allow the petitioner to proceed and close the hearing. , j l "'. .'" vuI 302 3. The hearing may be opened, and if the petitioner wishes not to proceed, the hearing may be continued until next week and allow all parties to present their testimony. The City Attorney also asked if there were any other individuals planning to participate in todays hearing. The City Attorney felt the continuation of the hearing should be considerate of Mr. Robert E11erd. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the extension be denied to delay the hearing for a period of one week. The City Attorney advised the Commission it was up to them as to which way they would want to vote. Commissioner Vollmer, said he felt the City had made the guide lines by advertising the hearing and com- munications by this Commission. He doesn't feel the Commission has anything to be ashamed of. Those voting Aye being Commissioner Vollmer, Commissioner MacNab and Commissioner Vandeventer. Commissioner Swanson Abstained and Mayor Sedivy Voted No. The City Attorney stated all the Commission had done at this point is deny the continuance of the hearing, and retained the right, depending on any testimony to continue. Attorney Sabol stated the testimony for the petitioner was all prepared but they would pre- fer to have everyone heard at the same time. Mr. E11erd said he would do everything possible to be here on September 5, and if not, he will prepare a statement to be presented. Following discussion, it was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the hearing be continued in order to give everyone an equal opportunity to speak. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy, Commissioner Swanson abstained. I Public Hearing - Commission Resolution No. 2089 - SID 615 - Sewer installation Burrup Annexation This was the time and place set in Commission Resolution No. 2089, to hear the protests to the creation of Special Improvement District No. 6l5, sewer installation in Burrup's Annex- ation. Affidavit of publication of Notice and the Clerk's mailing certificate stating all property owners had been notified as required by law were presented. There were no protests on file and no one appeared to protest verbally. The Mayor declared the hearing closed and upon recommendation by the City Manager, it was moved by Commissioner Swanson, seconded by Commissioner Vandeventer that the City Attorney be directed to draw up a resolution creating the district. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer and Mayor Sedivy, those voting No, none. I Status Report - System 34 IBM Computer System Two weeks ago, the City requested authorization to purchase a System 34 IBM computer. A special meeting was held at which time this subject was discussed exclusively. Immediately thereafter, the staff formulated criteria for selection of a data processing vendor, and dis- seminated this material to those interested. After evaluation of proposals for computer services which includes service capabilities and back-up equipment, capacities of proposed equipment, conversion time and costs, lease arrangements and costs including hardware, service/maintenance, conversion, and lease cost per month, the staff recommended that the City of Bozeman select the IBM System/34 as an upgrade to the present computor system. The decision was based primarily upon the reduced conversion costs and ease of program transition of the IBM System/34 as well as the lower per month lease cost and proven reliability of the vendor. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Com- mission approve the proposal to lease the IBM System/34 computor to program city finances on. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner MacNab and Mayor Sedivy, those voting No, being Commissioner Vandeventer. I Public Hearing - Establishing use of Federal Revenue Sharing Funds This was the time and place set for a public hearing on the reallocation of Federal Revenue Sharing Funds. The Mayor declared the public hearing open. The funds, totaling $257,000.00 are to be used mainly to support the police and fire departments. The establishment of the federal money in the City's general fund must now be '.:" ':;, '-.lU\,.' approved by the federal government. The Mayor declared the hearing closed and the City Manager advised the Commission that receipt and use of Federal Revenue Sharing Funds requires that a public hearing be conducted to indicate how such funds will be spent. I Commission Resolution No. 2094 - Conflict of Interest prOV1Slons applicable to Grantees under the HUD Community Development Block Grant Program Commission Resolution No. 2094 recognizing the City of Bozeman responsible for enacting conflict of interest guidelines to be used in the housing and urban development, community development block grant program was presented. All officers and employees shall conform to the policy to avoid conflicts of interest which may arise in the enactment of the Housing and Urban Development Block Grant Program. The program has granted $375,000 to Bozeman to allow low income families to rehabilitate their homes. Seventy-five percent of the money will go to families living in the northeast section of town. The other twenty-five percent goes to families living anywhere in the City. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commis- sion approve Commission Resolution No. 2094. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none. Library matters - (a) (b) (c) (d) Designate Commission member on building committee Designate Chairman for building committee Consider program for library Review proposed site plan I The City Manager advised the Commission that a member of the City Commission should be appointed as a member of the building committee for the new library. Mayor Sedivy designated Commissioner MacNab as the Commission's representative on the building committee. He will appoint an alternate member at a later date. Mayor Sedivy appointed Commissioner MacNab chairman of the building committee and John Parker alternate. The Committee will meet at 10:00 a.m. on Friday, September 7, 1979 at the City Hall. The City Commission then reviewed the proposed program for the library, which consists of space allocations for the various functions carried out by the library. The program was dis- cussed only briefly, with mention made of three-hundred square feet having been added to the community room. It was clarified that the total area provided in the proposed building was 20,560 square feet. The architect then displayed a site/schematic design for the new library. This showed a largely triangle-shaped building parallel to the west bank of Sourdough Creek. The main struct- ure was two stories, with an attached community room of one story only on the south side. The site/schematic design was generally acceptable by the Commission. Interpretation - Marquee - Hoffart Building, corner of Willson & Babcock I A letter received from Mattson, Prugh & Lenon, Architects for the Hoffart Office Building located at 27 South Willson Avenue, requesting a variance to the building code as it applies to roof structure over public property was presented. The Building Inspector advised the Commission that Chapter 45 of the Uniform Building Code deals with appendages to buildings that will permanently occupy public property. One of such appendages is a marquee. The roof structure in question is a continuation of the roof over the buid1ing and in essence is nothing more than an extension of the eaves of the roof. The Building Inspector stated that while the proposal does not meet the requirements of a marquee as spelled out in the Uniform Building Code, the Building Department would not oppose the granting of a variance. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commission grant the variance to place the permanent roofed structure attached to and supported by the building and projecting over public property. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none. Discussion of rehabilitation loan proposal to local banks - HUD project The City Manager advised the Commission that an item dealing with rehabilitation loan proposal to be made to local banks was to be presented by Grant Administrator Barbara Agocs. 30ii' Mrs. Agocs stated that this rehabilitation loan proposal to be made to local banks is in conjunction with the rehabilitation project for which CBDG funds have been granted. The banks and other lending institutions in the City of Bozeman were contacted in the past and asked to participate in a loan program for persons of low and moderate income. The only lending in- stitution interested in doing so was the Federal Credit Union. The final application was written on the basis of their interest as a participating party. I Mrs. Agocs said that at this time the Federal Credit Union feels it may not be able to assist since they are in the process of personnel reorganization and were under a mis- conception regarding the overall arrangements, thinking the lump sum of the grant would be a part of the agreement and deposited with this agency. She further stated that it appears necessary to approach the banks with a specific pro- posal, which was not done the first time. Dean Drink,Associate Professor, Montana State University was also present and explained various phases of the rehabilitation loan proposal. Following discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that Barbara Agocs, Director of the HUD Community Development Block Grant Program pro- ceed to approach the banks to develop a loan program to distribute the money. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson and Mayor Sedivy, those voting I No, none. Petition - Intent to create SID - 2 and 3 hundred blocks of Alley between East Babcock and East Main Street A letter received from eight property owners located in the two and three hundred blocks of East Main Street, and the two and three hundred blocks of East Babcock Street, petitioning the City of Bozeman to create a Special Improvement District to pave the alley located between the above described properties was presented. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the petition be acknowledged and referred to the staff for research and a decision. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, I none. Verification of Depository Securities - June 30, 1979 In compliance with the provisions of Section 7-6-201 - 7-6-212 Montana Code Annotated 1978, Mayor Sedivy and Commissioner Vollmer proceeded to examine the receipts and depository bonds and securities held by the Director of Finance as security for City funds deposited in Bozeman Banks. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the securities be approved and a list of these set forth in full in the minutes of the meeting. Report - Building Inspector The report of the Building Inspector will be placed on the agenda next week for acknow- ledgement and filing. Louis Burton - Cancel Kennel License effective September 12, 1979 I A letter received from Joy A. Petersen and Connie Lien, Animal Control Officers for the City of Bozeman, was presented. The Animal Control Officers feel the Burtons have violated every condition of the require- ments set for them in order to maintain a kennel. They also feel that the kennel has become a definite nuisance to the area. They request that the kennel license be revoked immediately, and that Mr. Burton be given a stated period of time to move the remainder of the dogs out of the city and dispose of the wild dogs. Following discussion it was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission concur in the recommendation of the Animal Control Officers, also concurred in by the City Manager, and revoke Louis Burton's kennel license in fifteen days, effective September 12, 1979. Also that Mr. Burton be given fifteen days in which to get rid or or dispose of the remainder of the dogs.
