The Commission of the City of Bozeman met in regular session in the Commission Room,
Municipal Building, August 22, 1979, at 1:15 o'clock p.m. Present were Mayor Sedivy, Com-
missioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City
Manager Gesko, City Attorney P1analp and the Clerk.
Commissioner Vollmer opened the meeting with a prayer whereupon the minutes of the
regular meeting held on Wednesday, August 15, 1979, and the minutes of the special meeting
held on Tuesday, August l4, 1979, were approved as submitted.
Sign Variance - Cactus Records - 101 West Main Street

The Cactus Records requested a sign code variance to move a sign to a new location.
The applicant requested permission to change the sign from 12' to 10' 3" from the Sidewalks.
The location of the sign is to be the corner of Main & Willson on the Willson Street side.
It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commis-
sion approve the sign code variance for one year,and that it be reviewed at the end of the
year. The motion was carried by the following Aye and No vote, those voting Aye being Com-
missioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and
Mayor Sedivy, those voting No, none.
Farmers' Market Board - re permission to place sandwich-board type of sign downtown on days
of 1979 market season
A letter received from Joanne Jennings, Board Member of the Farmers' Market, requesting
permission to place a sandwich-board type sign downtown on the days of the 1979 market season,
was presented.
The sign would be placed on the sidewalk in front of Owenhouse Hardware. The sign would
be to remind downtown shoppers that the Farmers' Market is open that day.
Mayor Sedivy stated the intent of the farmers market was to assist local gardeners or
craftsmen
but that the original intent had been lost.

Following discussion, it was moved by Commissioner Vollmer, seconded by Commissioner
Swanson, that the Commission deny placing the sandwich-board type sign on Main Street for the
1979 market season and that the request be brought back for discussion in 1980. The motion
was carried by the following Aye and No vote, those voting Aye being Commissioner Vollmer,
Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, those voting No, none.
Mayor Sedivy abstained.
Bond Sale - SID No. 610 - Water & Sewer - Woodridge Annexation - $142,300.00
SID No. 612 - Watermains - Westridge Meadows - $26,000.00
The City Manager advised the Commission that according to the Affidavit of Publication,
this was the time and place set for the bond sale of Special Improvement District No. 6l0.
The Mayor and City Manager outlined the procedure for conducting the bond sale and
stated the amount of bonds to be sold would be the same as the advertised amount.
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the City
proceed with the bidding. The motion was carried by the following Aye and No vote, those
voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commis-
sioner Vollmer and Mayor Sedivy, those voting No, none.
Joe Hanser of Montana Bank of Bozeman, bidding for Grande & Company, Inc., presented their
good faith check as prescribed by the Notice of the Bond Sale in the amount of $7,l15.00.
Grande & Company, Inc., being the only bidder bid 8.45%
The Commission concurred in the recommendation of the Director of Finance, also concurred
in by the City Manager, and it was moved by Commissioner Vandeventer, seconded by Commissioner
MacNab, that the sale of the bonds for SID No. 610 in the amount of $142,300.00 be awarded to
Grande & Company, Inc., of Seattle in the amount of 8.45% it being the only bid submitted.
The motion was carried by the following Aye and No vote, those voting Aye being Commissioner
Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson and Mayor Sedivy,
those voting No, none.

Don Weaver being the only bidder presented his good faith check as prescribed by the
Notice of the Bond Sale in the amount of $1,300.00.
Don Weaver being the only bidder bid 9%.
The Commission concurred in the recommendation of the Director of Finance, also concurred
in by the City Manager, and it was moved by Commissioner Vollmer, seconded by Commissioner
Swanson, that the sale of the bonds for SID No. 612 in the amount of $26,000.00 be awarded to
Don Weaver in the amount of 9%, it being the only bid submitted. The motion was carried by
the following Aye and No vote, those voting Aye being Commissioner Vollmer, Commissioner
Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sediyv, those voting No,
none.
Consideration of Construction Bids - SID 610 - Water & Sewer Woodridge Annex.
SID 612 - Watermains - Westridge Meadows
Thomas, Dean & Hoskins, Inc., consulting engineers having reviewed the bids for SID
No. 610 and 6l2, Sanitary Sewer, Water Main and Storm Drain Improvements found them to be
correct. Therefore, they recommended Underground Construction of Bozeman be awarded the
bid subject to their low bid in the amount of $l09,077.50, it meeting or exceeding the Notice
in the Call for Bids.

The Commission concurred in the recommendation of the engineers, also concurred in by
the City Manager, and it was moved by Commissioner Swanson, seconded by Commissioner Vande-
venter, that Underground Construction be awarded the bid on the basis of their low bid, and
that the security check be returned to the unsuccessful bidder. The motion was carried by
the following Aye and No vote, those voting Aye being Commissioner Swanson, Commissioner
Vandeventer, Commissioner MacNab, Commissioner Vollmer and Mayor Sedivy, those voting No,
none.
Restvedt's - request to have annual outdoor barbeque August 25 - 229 East Main
A letter received from Steve Ki1lorn of Restvedt's Market requesting permission to
hold an outdoor barbeque in front of his store at 229 East Main Street on Saturday, August
25, 1979, was presented.
It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that Mr.
Ki110rn be granted permission to hold the outdoor barbeque with the stipulation that there
is nothing on the sidewalk to restrict pedestrian traffic. The motion was carried by the
following Aye and No vote, those voting Aye being Commissioner Vandeventer, Commissioner
MacNab, Commissioner Vollmer, Commissioner Swanson, and Mayor Sedivy, those voting No,
none.
Discussion - Proposed dog ordinance

Having distributed copies of the proposed dog ordinance on August 8, 1979, the subject
was brought back for discussion. Several members of the City staff were present to explain
portions of the ordinance and answer any questions that might arise.
Following discussion, the City Manager recommended that the City Judge and the City
Attorney discuss proposed amendments to the dog ordinance and that the ordinance be brought
back for a final decision not later than September 5, 1979.
Public Hearing - preliminary budget/administration allocations 1979-1980
The preliminary budget was prepared on the basis that the mill levy would be the same
as the fiscal year 1978-1979.
The Mayor declared the public hearing opened. There was no one present to discuss the
preliminary budget.
The Mayor declared the hearing closed and further action will be deferred until after
the election on September 11, 1979.
Request for reimbursement of Federal payments - EPA - Sewer Facility Plan

The outlay report and request for reimbursement for construction programs Environmental
Protection Agency Federal Grant No. C300208- Step 1 for the Sewer Facility Plan study was
presented.
As the work is completed, the City requests reimbursement of 75% of the cost from the
Environmental Protection Agency. The total reimbursement requested is $50,807.00.
Following discussion, it was moved by Commissioner MacNab, seconded by Commissioner
Vollmer, that the City enter into the request for reimbursement for construction program
for the Sewer Facility Plan, and the Mayor be authorized and directed to sign for the
City. The motion was carried by the following Aye and No vote, those voting Aye being
Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vollmer and
Mayor Sedivy, those voting No, none.
Authorize signature - Contract Documents SID 598 - Paving Northwood Drive
The Contract Documents for the construction of Special Improvement District No.
598, Paving Northwood Drive, Wheat's Subdivision as prepared by Morrison & Maierle in the
amount of $122,443.00 as submitted by Long Construction, was presented.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Con-
tract Documents be approved and the Mayor and Clerk of the Commission be authorized and
directed to sign the contracts for the City of Bozeman, and that Long Construction Company
be authorized and directed to proceed withfue construction of SID NO. 598. The motion was
carried by the following Aye and No vote, those voting Aye being Commissioner Vollmer, Com-
lllissioner Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy, those
voting No, none.

Application for Raffle License - Montana Chapter of Wildlife - February 15, 1980
The City Manager presented an application from the Montana Chapter of Wildlife, along
with the appropriate fee for the purpose of holding a raffle on February 15, 1980.
It was moved by Commissioner Swanson, seconded by Commiss;ioner Vandeventer, that the
Commission approve the application for the raffle license for the Montana Chapter of Wild-
life. The motion was carried by the following Aye and No vote, those voting Aye being
Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer,
and Mayor Sedivy, those voting No, none.
Application for Gambling License - Little John's Inc., (Hipshots) - $500.00
The City Manager presented an application from John Hooper of Little John's Inc.,
along with the appropriate fee for operating two card games at Hipshots.
It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the
Commission concur in the Recommendation of the Chief of Police, also concurred in by the City
Manager, and approve the application for the issuance of the gambling license. The motion
was carried by the following Aye and No vote, those voting Aye being Commissioner Vandeventer
Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, and Mayor Sedivy, those
voting No, none.

Claims
The general claims for the month of August, 1979, were presented. The City Manager
had checked the claims and found them to be true and lawful claims against the City of
Bozeman and recommended they be approved and the Director of Finance be instructed to issue
warrants in payment.
It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the claims
be approved. The motion was carried by the following Aye and No vote, those voting Aye
being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner
Vandeventer and Mayor Sedivy, those voting No, none.
Report of Police Department for July
The report of the Police Department will be placed on the agenda on Wednesday, August
29, 1979 for consideration and acknowledgement.
