The Commission of the City of Bozeman met in regular session in the Commission Room, Munic- ipal Building, June 20,1979, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner MacNab, Commissioner Swanson, Commissioner Vandeventer, Assistant City Manager Smith, City Attorney P1ana1p, and the Clerk. I Commissioner Vandeventer opened the meeting with a prayer whereupon the minutes of the reg- ular meeting held on Wednesday, June l3, 1979 were approved as submitted. Absence of Commissioner Vollmer and City Manager Gesko - June 20, 1979 It was moved by Commissioner MacNab, seconded by Commissioner Swanson, that the absence of Commissioner Vollmer and City Manager Gesko be authorized in compliance with Section 11-3245, R.C.M., 1947 and that Assistant City Manager Smith be designated to perform the duties of the City Manager during his absence. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none. Request for Waiver of City Carnival License Fee - Bozeman Jaycees The Bozeman Jaycees requested a waiver of City License fees for a carnival license, which they intend to obtain for an upcoming Jaycees carnival. The carnival will be sponsored by the Jaycees. Ken Shepherd appeared before the Commission on behalf of the Jaycees to explain the Jaycees reason for requesting the reduction in the license fee. He said the off-duty policeman have been patro1ing the carnival. In response to Commission questions, the Director of Finance said it has never been a policy of the City to waive license fees. The Commission denied the request to waive the license fees but assured Mr. Shepherd that the Jaycees would not have to pay an additional fee for police protection at the carnival. The license fee should cover police expenses. I Open Bids - One 1980 Hydrostatic Driven Rotary Lawn Mower - Sewage Treatment Plant This was the time and place set for opening bids for one 1980 hydrostatic driven rotary lawn mower to be used by the Sewage Treatment Plant. The Affidavit of publication of "Notice to Bidders" was presented. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the bids be opened and read. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy, those voting No, none. The following bids were then opened and read: Midland Implement Company, Inc. - Billings - $5,497.05 Turf-Aid Distributing Company - Billings -(1) 5,500.00 -(2) 7,195.00 It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the bids be referred to the Waste Water Treatment Plant Superintendent for evaluation and a recommendation to be made to the Commission on Wednesday, June 27, 1979. The motion was carried byfue following Aye and No vote, those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Swanson and Mayor Sedivy, those voting No, none. Commission Resolution No. 2075 - Creating SID 614 - Paving and Storm Drains, East Garfield Street between South Tracy and Chicago, Milw. Ry. I Commission Resolution No. 2075 creating Special Improvement District No. 614, paving and storm drain construction on East Garfield Street between South Tracy Avenue and the Chicago, Milwaukee Railway, as prepared by the City Attorney, was presented, entitled: COMMISSION RESOLUTION NO. 2075 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 614 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF ASPHALTIC CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND GUTTERS, AND NECESSARY APPURTENANCES THERE- TO: ALSO APPURTENANCES NECESSARY TO STORM DRAINAGE OF EAST GARFIELD BETWEEN TRACY AVENUE AND THE CHICAGO, MILWAUKEE, ST. PAUL AND PACIFIC RAILROAD TRACKS IN THE CITY OF BOZEMAN, MONTANA. 2!'lO It was moved by Commissioner MacNab, seconded by Commissioner Swanson, that Commission Resolution No. 2075, creating SID No. 614, be passed and adopted. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Swanson, Commissioner Vandeventer and those voting Nb being Mayor Sedivy. Sale of Bonds - SID No. 607 - Paving & Storm Drain - Nik1es & Gilkerson Drive - McChesney Industrial Park I The Assistant City Manager advised the Commission that according tome Affidavit of Public- ation, this was the time and place set for the bond sale of Special Improvement District No. 607. The Mayor and Assistant City Manager outlined the procedure for conducting the Bond sale and stated the amount of bonds to be sold would be the same as the advertised amount. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the City proceed withthe bidding. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy, those voting No, none. The Clerk of the Commission advised the Commission that there were no sealed bids. Grande & Company presented their good faith check as prescribed by the Notice of the Bond Sale. Grande & Company of Seattle, being the only bidder, bid 8.45%. The Acting City Manager recommended that the City of Bozeman accept the bid of Grande & Company of Seattle, in the amount of 8.45%. It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the sale of the bonds for SID No. 607 in the amount of $170,000.00 be awarded to Grande & Company of Seattle in the amount of 8.45%, it being the only and best bid submitted. The motion was carried by the following Aye and No vote, those voting Aye being Com- missioner Vandeventer, Commissioner MacNab, Commissioner Swanson and Mayor Sedivy, those voting No, none. Consideration of construction bids - SID No. 607 - Paving Nikles Drive & Gilkerson Drive in McChesney Industrial Park - Long Construction - $l30,714.00 I The City Engineer reviewed the bids of Long Construction Company and Big Sky Paving and advised the Commission that the bid of Long Construction Company was within the project lim- itations available. The Commission concurred in the recommendation of the City Engineer, also concurred in by the City Manager, and it was moved by Commissioner MacNab, seconded by Commissioner Swanson, that Long Construction of Billings, be awarded the bid on the basis of their low bid in the amount of $130,714.00. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none. Ordinance No. 1031 - Amending Section 18.76.150, Chapter 18.76 (Landscaping for Townhouse Development) Bozeman Zoning Code Ordinance No. 1031 amending Section 18.76.150, Chapter 18.76 (Landscaping for Townhouse Development) of the Bozeman Zone Code as follows: "Exception: Additional landscaping adj acent to the required front yard, in front of the building only, may be included as part of the front yard landscaping to satisfy the seventy-five percent requirement, subject to Planning Department reveiw and approval." was presented. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Commission pass and adopt Ordinance No. 1031 modifying the Zone Code by inserting the above- stated language. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy, those voting No, none. I Consideration of a Permit to Construct a 22-foot wide access road - Dahl's Funeral Home A request from Dahl's Funeral Home for a permit to construct a 22-foot wide access road to the new funeral home from the end of Curtiss Street was presented. Curtiss Street is undeveloped from the east property line of Lot 6, Block B, Marwyn Addition. Switz1er Avenue is only a dedicated right of way. When Switzler is built as part of the arterial system tying into Highland Boulevard, it will be designed as a divided street and the intersection , ~ ,. ,., .c...Lt.J. I of Curtiss and Switzler will be designed accordingly. Mr. Dahl wishes to put in the 22-foot-wide access road at no cost to the City. The access road will be signed as "not a thru street" and "road narrows". The construction of this road would not relieve the funeral home from inclusion in a future S.I.D. if one is attempted. The Commission concurred in the recommendation of the Acting City Manager, and it was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the Commission approve the con- struction of the access road as requested. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Commissioner Swanson and Mayor Sedivy, those voting No, none. Consideration of the appointment of a Member at Large to the Bozeman Senior Citizens Advisory Council - Requested by the County Commissioners Members of the County Commission appeared before the City Commission in regard to the appoint- ment of a rural resident to the Senior Center Advisory Council. The Bozeman Senior Center has over seven hundred members and the center has been budgeted to receive $9,100 of county taxes from a mill levy sought by Gallatin Council on Aging. The County Commissioners definitely want a rural resident on the council and they selected Bob Howe as an Advisory Member at Large. Following discussion, the Mayor recommended that the decision to select the Advisory Member at Large be delayed until July 11, 1979, when all five members of the Commission are present. Approval of Change Order No. 1 - SID 587 - Sanitary Sewer Improvements Change Order No.1, SID No. 587, as prepared by Thomas, Dean and Hoskins, Inc., Consulting Engineers, to become a part of the original contract for construction of improvements in the pro- ject described was presented as follows: Description: An additional MH over the existing 20" sewer line, change alignment of sewer adding 35 1. f. of 8" PVC sanitary sewer main, addi t iona1 man-hours and equipment and 14 calendar days to contract I Cost: $6,064.93 The Acting City Manager concurred in the recommendation of the engineers and recommended that the Change Order be accepted and approved as presented. It was moved by Commissioner MacNab, seconded by Commissioner Swanson, that Change Order No. 1 on SID No. 587 be approved, and the Mayor and Clerk of the Commission be authorized and directed to sign for the City of Bozeman. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none. Authorization to call for bids for five Police patrol vehicles - Police Department The Police Department has need for five Police patrol vehicles, and the Acting City Manager requested authorization to prepare specifications for replacement of the vehicles. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Com- mission authorize the preparation of bid specifications to replace the present Police patrol vehicles. The motion was carried by the following Aye and No vote, those voting Aye being Commis- sioner Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy, those voting No, none. Approval of Gambling License Application - John Ralph Walker (Crystal Bar) I The Acting City Manager presented an application from John Ralph Walker of the Crystal Bar along with the appropriate fee of $500.00 for a gambling license for the purpose of operating two card tables. The Commission concurred in the recommendation of the Chief of Police, also concurred in by the City Manager, and it was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the application for the Gambling License be approved. The motion was carried by the follow- ing Aye and No vote, those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Com- missioner Swanson and Mayor Sedivy, those voting No, none. Application for Beer License for Friday,June 22,1979 - Bozeman Soft Ball The Acting City Manager presented an application from the Bozeman Soft Ball Association for permission to obtain a beer license for June 22, 1979 along with the required fee. ,242 It was moved by Commissioner MacNab, seconded by Commissioner Swanson, that the Bozeman Soft Ball Association, having met all requirements, be granted a license to sell beer at the Recreational Softball Complex on June 22, 1979. The motion was carried by the following Aye and No, those voting Aye being Commissioner MacNab, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none. Adjournment I There being no further business to come before the City Commission, it was moved by Com- missioner Swanson, seconded by Commissioner Vandeventer, that the meeting be adjourned.
