COMMISSION RESOLUTION NO. 3536
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, SUBMITTING TO THE QUALIFIED ELECTORS OF THE CITY OF
BOZEMAN, MONTANA, THE QUESTION OF ENACTING ORDINANCE NO. 1573,
ADDING CHAPTER 8.48 TO THE BOZEMAN MUNICIPAL CODE, PROHIBITING
SMOKING IN ALL ENCLOSED PUBLIC PLACES AND PLACES OF EMPLOYMENT.
BE IT RESOLVED by the City Commission of the City of Bozeman, Montana:
Section 1
The City Commission had determined it is in the best interests of the citizens of Bozeman to
submit the issue to the registered electors of the City.
Section 2
The ballot question to enact Ordinance No. 1573, adding Chapter 8.48 to the Bozeman Municipal
Code, prohibiting smoking in all indoor public places and places of employment, shall be submitted to the
registered electors of the City of Bozeman at the general election to be held on Tuesday, November 5, 2002,
and the wording of the ballot measure shall be substantially as follows:
Ordinance No. 1573 prohibits smoking in all enclosed public places and places of
employment. The Ordinance does not apply to private functions not advertised or
accessible to the general public; hotel or motel guest room, provided the room is
designated as a smoking room; outdoor areas; retail tobacco stores; and any private
residence, unless the residence is used as a child-care, adult day-care, or health-care
facility. "Enclosed public place" and "place of employment" are defined in the
Ordinance.

Section 3
That, upon a favorable vote of the public, the ordinance shall become effective thirty (30) days
after approval by a majority of qualified electors.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a special
session thereof held on the 21st day of August 2002.
