HomeMy WebLinkAbout1979-05-16 May 16, 1979 Bozeman, Montana I The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, May 16, 1979, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commis- sioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City Manager Gesko, Ass't. City Manager Smith, City Attorney Planalp and the Clerk. Commissioner Vandeventer opened the meeting with a prayer whereupon the minutes of the regular meeting held on Wednesday, May 9, 1979, were approved as submitted. Open Bids - Bituminous Plant Mix - Street Department This was the time and place set for opening bids for 4,500 tons of bituminous plant mix material to be used for street maintenance and reconstruction and to be paid out of Gas Tax HB-254 Funds. Affidavit of publication of "Notice to Bidders" was presented. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the bids be opened and read. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none. The following bid was then opened and read: Pioneer Ready Mix - Bozeman $62,850.00 It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission concur with the recommendation of the City Manager, that the bid of Pioneer Ready Mix, it being the only bid submitted, be referred to the Street Superintendent for evaluation and a recommend- ation to be made to the Commission on Wednesday, May 23, 1979. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy, those voting No, none. Open Bids - Wheel Loader Backhoe - Water Department I This was the time and place set for opening bids for a new wheel loader backhoe to be used by the Water Department. Affidavit of publication of "Notice to Bidders" was presented: It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the bids be opened and read. I Decision - Gary Barker - Zone Map Change - A-S to R-l - West side of South Nineteenth, approximately 2~ miles south of city limits The decision on the request of Gary Barker for a Zone Map Change from A-S to R-l, having been delayed for a period of one week, was brought before the Commission for a decision. The applicant seeks the Zone Map Change to reclassify the zoning on approximately 320 acres of land from A-S to R-l. Members of the staff and legal council met with the County Commissioners to discuss cer- tain subdivision development criteria which could be required of the potential development of 320 acres located two miles south of Bozeman west of and adjacent to South 19th Avenue (N~, Sec. 35, T2S, R5E.) The County Commission assured the City Commission that they would require and utilize City t .","' " "-if 212 of Bozeman subdivision development and design standards of any developers of the property commonly referred to as and included in the "Barker Rezoning", including but not limited to the following: All central/community water distribution and/or sanitary sewer collection systems will be developed to meet City construction standards/criteria. Dedication either to the public or a Home/Property Owner's Association of all required park land associated with subdivision of this property will be required. I Paved street systems, including standard curb and gutter sections will be required to be developed to City street design standards/ criteria. The County Commission advised the staff that they were aware of the present developer's intent to develop R-l lots of approximately 15,000 square feet, and would approve only those plats reflecting this lot size and density, from the present as well as future owners. The City Manager felt that with the above assurance, it would be advisable to rezone the property as requested by the applicant. The City Manager recommended approval of the request for a zone map change from AS to R-l with the above conditions. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Commission approve Gary Barker's request for a zone map change from AS to R-l with the con- ditions as set forth by the County Commissioners. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer and Mayor Sedivy, those voting No, none. Decision - Earl Best - Zone Map Change - reclassify land bounded on North by present B-3, on West by the alley between Tracy and Willson and Tracy and Black, on the East by Wallace, and on the South and East by Chicago, Milwaukee Railroad from R-4 to R-3 The decision on the request of Earl Best for a Zone Map Change from R-4 to R-3, having been delayed for a period of one week, was brought before the Commission for a decision. The City Manager felt that the more restrictive the zoning adjacent to the business district, the more difficult it would be for the commercial district to expand. He fur- ther stated he could not agree with those who objected to a parking lot which would have replaced the eyesore presently situated on the lot. If the east-west line which turns northward at Bozeman Avenue were extended straight eastward to the east border of the pro- posed district, even that would be an improvement. That would allow the more natural de- velopment of commercial and high-density residential which would be common to downtown districts. Following discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the Commission approve the request for the Zone Map Change from R-4 to R-3, all of that land bounded on the north by the present B-3, on the west by the alley between Tracy and Willson and Tracy and Black Avenue, on the east by Wallace Avenue, and on the south and east by the Chicago, Milwaukee, St. Paul and Pacific Railroad with the exception of a parcel of land owned by McCloy-Crouse as it is in Certificate of Survey #381 for a tract of land located in the SE~, Section 7, T2S, R6E and containing approximately 1,261 acres. The motion was carried, by the following Aye and No vote, those voting Aye being Commissioner Vandeventer, Commissioner MacNab, CommissionerVollmer, Commissioner Swanson, and Mayor Sedivy, those voting I No, none. Decision - Clair Daines - Conditional Use Permit - allow addition to existing 5,000 square foot building located at 121 West Kagy Blvd. Action was delayed on the request of Clair Daines who seeks a Conditional Use Permit for an addition to the existing building located at 121 West Kagy Boulevard. The new add- ition would contain 10,120 square feet. The Zoning Commission recommended approval of the Conditional Use Permit subject to conditions as recommended by the Planning Staff. The City Commission concurred with the recommendation of the Zoning Commission, also concurred in by the City Manager, and it was moved by Commissioner MacNab, seconded by Com- missioner Vollmer, that the Commission approve the request for the Conditional Use Permit subject to the following conditions: I 1. A drainage and erosion plan for the new addition be submitted and approved by the City Engineer prior to issuance of a building permit. 2. The Planning Staff review and approve the final landscaping plan for the new addition prior to issuance of a building permit. All landscaped areas shall be enclosed by a permanent protection curbing at least six inches in height to prevent vehicular traffic from crossing the land- scaped areas. I 3. Signing for this addition shall be limited to and in compliance with signing conditions placed on the conditional use permit for the first building. No external lighting apparatus shall be attached to or made part of any sign. 4. All site improvements (I.e. paving, landscaping) shall be completed within twelve months after occupancy of the building. 5. The curb cut opening shall be expanded not to exceed 40' and subject to the approval of the City Engineer. 6. A 5" high minimum curbing shall be plac:ed along the northern boundary line of the interior parking area. 7. Three copies of the final site plan delineating the above corrections shall be submitted to the Planning Department. Ordinance No. 1028 - Zone Code Amendment - Off-Street Parking and Loading Ordinance No. l028 amending Chapter 18.84 of Title 18 and repealing Chapter 18.87 of the Bozeman Zone Code, as prepared by the City Attorney was presented; entitled: ORDINANCE NO. 1028 I AN ORDINANCE AMENDING CHAPTER 18.84 OF TITLE 18 ENTITLED THE CITY OF BOZEMAN ZONE CODE, AND REPEALING CHAPTER 18.87 OF THE CITY OF BOZEMAN ZONE CODE. The City Manager advised the Commission that the ordinance includes the two subjects covering compact car spaces on off-street lots, as well as a cash-in-lieu provision to pro- vide for additional parking needed under certain circumstances (Ordinance No. l026 and 1027). Upon the recommendation of the City Manager, it was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that Ordinance No. 1028 be passed and adopted. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy, those voting No, none. Commission Resolution No. 2064 - Create SID No. 612 - Westridge Meadows - Water Installation Don Weaver Commission Resolution No. 2064 creating Special Improvement District No. 612, installation of a water main in the Westridge Meadows (Don Weaver) as prepared by the City Attorney, was presented, entitled: COMMISSION RESOLUTION NO. 2064 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA CREATING A SPECIAL IMPROVEMENT DISTRICT NO. 612 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF A WATER MAIN AND APPURTENANCES TO SERVE THE ADJOINING PROPERTIES AND MORE SPECIFICALLY DESCRIBED AS FOLLOWS: A SIX (6) INCH WATER MAIN AND APPURTENANCES IN WESTRIDGE MEADOWS IN THE CITY OF BOZEMAN, MONTANA. I THE CONSTRUCTION AND INSTALLATION OF THE WATER MAIN TO INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIAL, DUCTILE WATER MAIN VALVES, FITTINGS, HYDRANTS, SERVICE LINE STUBS, AND OTHER NECESSARY APPURTENANCES. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that Commis- sion Resolution No. 2064 creating Special Improvement District No. 612, be passed and adopted. Ordinance No. l029 - Telephone Solicitation Ordinance No. 1029 adding Section No. 3.70 proposed Boilerroom Operations to the Licensing \..-:' i""i ..:.:. ..L (', 214 Chapter of the City Code of the City of Bozeman was presented, entitled: ORDINANCE NO. 1029 AN ORDINANCE OF THE CITY OF BOZEMAN ADDING SECTION 3.70 PROPOSED BOILERROOM OPERATIONS, TO THE LICENSING CHAPTER OF THE CITY CODE OF THE CITY OF BOZEMAN. The ordinance regulates boiler rooms (massive telephone solicitation headquarters) in the City. No person shall conduct any boilerroom operation within the city, without first obtaining a business license therefor and paying in application for such license shall be made to the City Treasurer on forms to be provided by and retained by the City Treasurer. The background investigation fee shall be $100.00 per operation plus $25.00 per person in- vestigated. The police department shall be allowed up to ten days to conduct background investigations of the applicants. It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that Ordinance No. 1029 be passed and adopted. I Commission Resolution No. 2065 - Sewage Treatment Facility Plan Commission Resolution No. 2065 relating to the construction of and improvements at the sewage treatment plant including a holding pond and infiltration-percolation beds as required by the Water Quality Bureau, Department of Health and Environmental Sciences, State of Montana, and the Environmental Protection Agency, as prepared by the City Attorney, was presented, entitled: COMMISSION RESOLUTION NO. 2065 RESOLUTION BY THE CITY OF BOZEMAN, MONTANA, RELATING TO THE CONSTRUCTION OF IMPROVEMENTS AT THE SEWAGE TREATMENT PLANT INCLUDING A HOLDING POND AND INFILTRATION-PERCOLATION BEDS. The Commission concurred with the recommendation of the City Manager, and it was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that Commission Resolution No. 2065 be passed and adopted. I 12 Easements - Graf's First Addition Twelve Easements and Right of Way Agreements for the purpose of construction and install- ation of sewer and water lines and necessary appurtenances to serve various properties located within the Southeast portion of the City of Bozeman and containing a strip of land thirty feet in width was presented as follows: Lot 17, Graf's Second Subdivision - Eugene Graf, Jr. & City of Bozeman Lot 1, Block 4, Graf's First Subdivision - Eugene Graf, Jr. & City of Bozeman Lot 2, Block 4, Graf's First Subdivision - A.W. I Commission Resolution No. 2066 - Awarding sale of $32,000 - SID 589 - prescribing form and terms and covenants - D.A. I Adjournment Approve Plans and specifications - SID's 598 and 607 - Paving & Storm Drain - Northwood Drive Paving - McChesney Annexation - Open construction bids - June 13, 1979-Bond Sale 6-20-79 The City Manager recommended that the plans and specifications for the construction and installation of paving and storm drains - Northwood Drive, paving - McChesney Annexation - SID 597 and SID 607, as prepared by Morrison & Maierle, be approved. Upon recommendation of the City Manager, it was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the plans and specifications be approved as presented. Also that the Clerk of the Commission be authorized and directed to publish a "Call for Bids" for the construction of SID 598 and SID 607 with an opening date of June 6, 1979. The Clerk of Commis- sion was also authorized and directed to advertise for bids for the sale of bonds for SID No. 598 in the amount of $90,000.00 and SID No. 607 in the amount of $170,000.00 to be received on June 20, 1979.
