HomeMy WebLinkAboutResolution 3539 Smoking ordinance on ballot, amended for bars & casinos MOTION TO ADOPT FAILED August 21, 2002 COMMISSION RESOLUTION NO. 3539 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, SUBMITTING TO THE QUALIFIED ELECTORS OF THE CITY OF BOZEMAN, MONTANA, THE QUESTION OF ENACTING ORDINANCE NO. 1575, AMENDING SECTION 8.48.040 OF THE BOZEMAN MUNICIPAL CODE, TO PROHIBIT SMOKING IN BARS AND CASINOS. BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 The City Commission had determined it is in the best interests of the citizens of Bozeman to submit the issue to the registered electors of the City. Section 2 The ballot question to enact Ordinance No. 1575, amending Chapter 8.48 to the Bozeman Municipal Code, prohibiting smoking in bars and casinos, shall be submitted to the registered electors of the City of Bozeman at the general election to be held on Tuesday, November 5, 2002, and the wording of the ballot measure shall be substantially as follows: Bozeman Municipal Code Section 8.48.040 prohibits smoking in all enclosed public places and places of employment. This Section does not apply to bars or casinos. Ordinance No. 1575 will amend Bozeman Municipal Code Section 8.48.040, to prohibit smoking in bars and casinos by removing this exemption. [] FOR smoking in bars and casinos (rejecting Ordinance No. 1575). [] AGAINST smoking in bars and casinos (approving Ordinance No. 1575). Section 3 That, upon a favorable vote of the public, the ordinance shall become effective thirty (30) days after approval by a majority of qualified electors.
