HomeMy WebLinkAbout1979-01-24 January 24, 1979 Bozeman, Montana I The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, January 24, 1979, at 1:l5 o'clock p.m. Present were Mayor Sedivy, Commis- sioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City Manager Gesko, Ass't City Manager Smith, City Attorney Planalp and the Clerk. Commissioner Vollmer opened the meeting with a prayer whereupon the minutes of the regular meeting held on Wednesday, January l7, 1979 were approved as corrected. Continued Hearing - Zone Code Amendments (a) Conditional Use Section - Chapter 18 The request of the Planning Staff for a Zone Code Amendment (Chapter 18.72 - Conditional Uses) having been continued for a period of one week, was again presented. There was no one present in regard to the request for a Zone Code Amendment, either for or against. The Mayor declared the hearing closed and the City Manager recommended that the decision be delayed for a period of one week. (b) Off-Street Parking and Loading - Chapter 18 I The request of the Planning Staff for a Zone Code Amendment for Off-Street Parking and Load- ing (Chapter 18.81 - Off-Street Parking and Loading)having been continued for a period of one week, was again presented. The Planning Director gave a status report of the revisions by the Bozeman City Zoning Commission. He stated that if the lot area used for parking is placed between the required land- scaped yard abutting a public or private street and the structure(s), then a view-obscuring screen- ing of the parking area shall be established in the rear portion of the landscaped yard area. The required screen shall contain at least one or more of the following design elements: low- profile vegetative ground cover not to exceed two (2) feet in height at maturity and/or earth berms. No single design element shall comprise more than fifty percent of the required screen- ing. The required screening shall be at least two (2) feet but not more than three (3) feet in height. The screening design shall include at least one (1) tree per fifteen (15) lineal feet of public or private street frontage, planted on fifteen-foot corners. So as to minimize potential vandalism, the required view-obscuring screen shall not have a continuous frontage, but shall contain intermittent breaks of at least six (6) feet, but not more than ten (lO) feet in length. The individual segments of the screening shall not be less than fifty (50) feet nor more than eighty (80) feet in length. However, where a specific lot frontage does not permit full compliance with this requirement, these dimensions may be reduced or modified so that the intent of this requirement can be satisfied. Following an extensive discussion, the request of the Planning Staff for a Zone Code Amend- ments was continued for a period of one week. Rose's Cantina - Sign Code variance - wood sign at 13 North Rouse I A request received from Rose's Cantina for a sign code variance located at 13 North Rouse Avenue was presented. The sign will be 36" x 36" x 5" thick and will be hung from a metal pole. The pole will be buried minimum of 4' in the ground and will also be fastened to the building. The Building Department recommended approval of the sign. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission approve the sign code variance located at 13 North Rouse Avenue. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none. John Davis - Kletterwerks - Sign Code variance Store front sign 315 East Main Street A request from John Davis - Kletterwerks, 315 East Main Street for a variance to the Sign Code to approve a hand carved redwood with brass band sign, was presented. The sign will be 6' x 3' and will be attached to the store front with lag bolts. The Building Department recommended approval of the sign. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Commis- sion approve the sign code variance located at 315 East Main Street. Certificate of Completion & Final Acceptance - EPA Project C300208-3 Schedule I, Sewer Rehabilitation The certificate of completion of the EPA Project C300208-3, Schedule I, Sewer Reha- bilitation by the firm of Ge1co Grouting Service as prepared by Thomas, Dean & Hoskins, Inc., was presented. The contractor, as a part of his contract, is required to come back next year and re- TV inspect some of the areas of sewer rehabilitation. The contractor has provided a performance and materials bond to guarantee work for a one (1) year period. The City Manager concurred in therecoITlITlendation of the Project Engineer and recommended that the project be accepted and approved by the City Commission and that final payment be made within 30 days of the final acceptance. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that as recom- mended, the project be accepted as completed. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Swanson and Mayor Sedivy, those voting No, none. I Certificate of Completion & Final Acceptance - EPA Project C300208-3, Schedule II, Sewer Rehabilitation The certificate of completion of the EPA Project C300208-3, Schedule II, Sewer Rehab- ilitation by the firm of White & McNeil Excavating, as prepared by Thomas, Dean & Hoskins, Inc., was presented. The project has not had final inspection by the State Department of Health, EPA, and the Corps of Engineers. A request for final inspection was forwarded to the state on August 16, 1978. I The City Manager concurred in the recommendation of the Project Engineer and recommended that the project be accepted and approved by the City Commission. This final acceptance does not relieve the contractor of responsibility for negligence or faulty materials or workmanship to the extent and period provided by law. The contractor has provided a performance and mat- erials bond to guarantee work for a one (1) year period. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that as recom- mended, the project be accepted as completed and final payment be made within 30 days of the final acceptance. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none. Proclamation & fund drive - Pi Kappa Alpha Fraternity in conjunction with women's living groups - "Pie Week" January 29 to February 3, 1979 In accordance with a request from the Montana State University Chapter of the Pi Kappa Alpha Fraternity in conjunction with the women's living groups, Mayor Sedivy proclaimed the week of January 29 to February 3, 1979 as "Pie Week" in the City of Bozeman, and urged all citizens to take an active part in supporting the March of Dimes in an attempt to fight birth defects through research and rehabilitation. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Com- mission endorse the Mayor's proclamation. The motion was carried by the following aye and No vote, those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner Vollmer and Mayor Sedivy, those voting No, none. Report - Director of Public Service for the month of December, 1978 I The City Manager commented on the report of the Director of Public Service for the month of December and recommended acceptance thereof. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the Com- mission accept the report of the Director of Public Service, andthe motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Swanson and Mayor Sedivy, those voting No, none.
