The Commission of the City of Bozeman met in regular session in the Commission Room.
Municipal Building, December 20, 1978, at 1:15 o'clock p.m. Present were Mayor Sedivy, Com-
missioner MacNab, Commissioner Vollmer. Commissioner Swanson, Commissioner Vandeventer, City
Manager Gesko, Ass't. City Manager Smith, Acting City Attorney Coil and the Clerk.
Commissioner Vollmer opened the meeting with a prayer whereupon the minutes of the reg-
ular meeting held an December 13, 1978 were approved as submitted. I
Decision - Re bid received - metal, clear-span vehicle storage/garage building - Shop Complex
Upon concurrence of the City Manager, it was moved by Commissioner MacNab, seconded by
Commissioner Vollmer. that the Commission reject the bid of All Steel Builders of Great Falls,
it being the only bid submitted, and the Clerk of the Commission be directed to return the bid
deposit . The motion was carried by the following Aye and No vote, those voting Aye being Com-
missioner MacNab, Commissioner Vollmer, Commissioner Swanson. Commissioner Vandeventer and
Mayor Sedivy, those voting No. none.
Commission Resolution No. 2040 - re operation. management of Senior Center
Commission Resolution No. 2040 setting forth the operational procedures for the Bozeman
Senior Citizens Center Building was presented.

A RESOLUTION SETTING FORTH THE OPERATIONAL PROCEDURES FOR THE BOZEMAN SENIOR
CITIZENS CENTER BUILDING
Commissioner Swanson had met with Mr. Dusenberry and Mr. Moos, together with the City
Manager to discuss Commission Resolution No. 2040 which governs the operation and management
of the new Senior Center.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that Commission
Resolution No. 2040 setting forth the operational procedures for the Bozeman Senior Citizens
Center Building be approved as presented. The motion was carried by the following Aye and I
No vote, those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner
Vandeventer, Commissioner MacNab and Mayor Sedivy, those voting No, none.
Gregg Heath - request for Building code variance at 610 No. Grand Avenue
A letter received from Gregg Heath requesting permission to construct an apartment with
a seven foot and one-half inch ceiling was presented.
The Building Inspector advised the Commissioner that since the ceiling height would be
uniform at seven feet one and one-half inches and all other requirements were being met he
recommended approval of the variance request.
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the
Commission approve the building code variance as requested by Gregg Heath of 610 North Grand
Avenue. The motion was carried by the following Aye vote, those voting Aye being Comm. Swanson,
Comm. Vandeventer, Comm. MacNab. Camm. Vollmer and Mayor Sedivy,those voting No. none.
Continued hearing from June 7, 1978, - re Woodridge Annexation Study (Daines) Zone Change RS-l to R-l
Having delayed action on the request of Woodridge Annexation for a zone change from RS-l
to R-l contingent upon a favorable annexation report, it was again presented.
The property abuts Graf's Fourth Addition --undeveloped--on its east side, and is located
approximately 200 yards south of the present city limits on South Third Avenue.
Hearing no objection on the report, the Mayor declared the hearing closed.
It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the hearing
be reopened and the motion was carried by the following Aye and No vote, those voting Aye being
Commissioner Vandeventer. Commissioner MacNab. Commissioner- Vollmer, Commissioner Swanson and I
Mayor Sedivy, those voting No, none.
The Planning Director gave the staff report. The Planning Staff supported the annexation.
The Planning Director advised the Commission the annexation study was ready for City Commission
review and a decision.
The City Engineer said his only objection to the annexation was that he did not like to
jump across property which is not in the City.
Commissioner Swanson asked that if the City ran the utilities across the unannexed prop-
erty would it not enhance those property owners to annex into the City. The answer was no.
The City Manager advised the Commission that the park requirements had been met.

Following discussion. the hearing was continued for a period of one week.
Decision - re hiring Consulting Architect to spell out duties of Architect for design & con-
struction of New Library
The decision on retaining a Consulting Architect for the purpose of drafting the terms
and conditions of the new Library was deferred for a period of one week for further study.

Vollmer, that the City not retain a Consulting Architect for the purpose of drafting the
terms and conditons of the new library. The motion was carried by the following Aye and No
vote. those voting Aye being Commissioner MacNab. Commissioner Vollmer. Commissioner Swanson.
Commissioner Vandeventer and Mayor Sedivy, those voting No. none.
EPA Grant amendment for sewage treatment project - additional engineering
Amendment No. 5 to the Engineering Contract Agreement between the City of Bozeman and
Thomas. Dean and Hoskins. Inc., was presented.
The scope of service is for preparation of a revised supplement of the Bozeman Facility
Plan which was dated July 1978 to provide the information requested in EPA's letter dated
August 27. 1978, and Department of Health and Environmental Science letter dated September 6,
1978.
Following discussion, it was moved by Commissioner Vollmer, seconded by Commissioner
Swanson, that the Commission concur with the recommendation of the City Manager and approve
Amendment No. S to the Engineering Contract Agreement between the City of Bozeman and Thomas,
Dean & Hoskins, Inc. The motion was carried by the following Aye and No vote, those voting
Aye being, Commissioner Vollmer, Commissioner Swanson, Commissioner V?ndeventer, Commissioner
MacNab and Mayor Sedivy, those voting No, none. ^'

Evaluation of Thomas. Dean & Hoskins, Inc. . engineering contract on Nineteenth Avenue from
Babcock Street to Durston Road and Kagy Blvd. from Third Avenue to Highland Blvd.
I When originally drafted, the agreement from engineering services in conjunction with ~he
design of North Nineteenth Avenue and Kagy Boulevard was stated at the current market rate.
Inflation has affected the economy during this interval. and Thomas. Dean and Hoskins are
asking that the contract amount be up-dated, in order to accomodate the inflation factor.
The increase is due to the delay in scheduling the completion of the project.
The Commission concurred in the recommendation of the City Manager, and it was moved by
Commissioner Swanson, seconded by Commissioner Vandeventer. that the City staff be directed
to negotiate with Thomas. Dean and Hoskins, Inc. The motion was carried by the following Aye
and No vote, those voting Aye being Commissioner Swanson, Commisioner Vandeventer, Commis-
sioner MacNab. Commissioner Vollmer and Mayor Sedivy, those voting No, none.
Raffle License Application - Bridger Bowl Jr. Ski Patrol - January l3, 1979
The City Manager presented an application from Bridger Bowl Jr. Ski Patrol along with the
appropriate fee for the purpose of holding a raffle on January l3, 1979.
It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab. that the Com-
mission approve the application for the raffle license for Bridger Bowl Jr. Ski Patrol. The
motion was carried by the following Aye and No vote, those voting Aye being Commissioner
Vandeventer, Commissioner MacNab, Commissioner Vollmer. Commissioner Swanson and Mayor Sedivy.

Report - Police Court for November
I The City Manager commented on the report of the Police Court and recommended it be accept-
ed and ordered filed.
It was moved by Commissioner MacNab. seconded by Commissioner Vollmer, that the report
of Police Court be approved and ordered filed. The motion was carried by the following Aye and
No vote, those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson,
Commissioner Vandeventer and Mayor Sedivy. those voting No, none.
Amend minute entry regarding Wessel - Water and Sewer
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson. that the minute
entry of October 18. 1978, in regard to the David Wessel water and sewer services, be amended
to read as follows:

The water main does have a stub-in already installed for his property. The sewer is very
close at hand, but does not have a stub already installed.
The motion was carried by the following Aye and No vote, those voting Aye being Commis-
sioner Vollmer. Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor
Sedivy, those voting No, none.
City Manager- Executive session to discuss applicants for City Attorney I
The City Manager requested an executive session for the purpose of discussing the appli-
cants for City Attorney.

There being no further business to come before the Commission, it was moved by Commissioner
Vollmer. seconded by Commissioner Swanson. that the meeting be adjourned. The motion was car-
ried by the following Aye and No vote. those voting Aye being Commissioner Vollmer. Commissioner
Swanson, Commissioner Vandeventer. Commissioner MacNab and Mayor Sedivy, those voting No, none.
