December 13. 1978. at 1:15 o'clock p.m. Present were Mayor Sedivy. Com- missioner MacNab, Commissioner Vollmer. Commissioner Swanson, Commissioner Vandeventer, City Manager Gesko, Ass't. City Manager Smith. City Attorney Berg and the Clerk. Commissioner MacNab opened the meeting with a prayer whereupon the minutes of the reg- I ular meeting held on December 6, 1978 were approved as submitted. Open Bids - Sale of 1958 Chevrolet Pickup - Park Dept Vehicle This was the time and place set for opening bids for the sale and removal of the 1958 Chevrolet - ~ ton Pickup No. T020 belonging to the Park Department of the City of Bozeman. The affidavit of publication of the "Call for Bids" was presented. It was moved by Commissioner MacNab. seconded by Commissioner Vollmer, that the bids be opened and read. The motion was carried by the following Aye and No vote. those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, and Mayor Sedivy. those voting No, none. Commissioner Vandeventer abstained. The bid of Milt Vandeventer being the only bid submitted was then opened and read: Milt Vandeventer, Bozeman - $100.00 It was moved by Commissioner Vollmer. seconded by Commissioner Swanson, that the Commis- sion accept the bid of Milt Vandeventer in the amount of $100.00, it being the only bid sub- mitted. The motion was carried by the following Aye and No vote. those voting Aye being Com- missioner Vollmer, Commissioner Swanson, Commissioner MacNab and Mayor Sedivy. those voting No, none. Commissioner Vandeventer abstained. Open Bids - Two Door Garage - Waste Water Treatment Plant residence This was the time and place set for opening bids for the construction of a two-door garage to be utilized by the Waste Water Treatment Plant Superintendent. I There were no bids received, therefore was no action to be taken. Open Bids - Metal, clear-span vehicle storage/garage bldg. shop complex This was the time and place set for opening bids for the construction of a city shop (cold storage) 100' x l60' (lOO' clear span) steel building. It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer that the bid be opened and read. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Swanson, Commissioner Vandeventer. Commissioner MacNab. Commissioner Vollmer, and Mayor Sedivy. those voting No, none. The bid of All Steel Builders of Great Falls being the only bid submitted was then opened and read. All Steel Builders - Great Falls, Montana $l29.500.00 It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the bids be referred to the Staff for review and a recommendation. The motion was carried by the follow- ing Aye and No vote, those voting Aye being Commissioner Vandeventer, Commissioner MacNab, Com- missioner Vollmer. Commissioner Swanson and Mayor Sedivy, those voting No, none. Public Hearing - Conditional Use Permits - to be continued a) Michael McMullen - construction of warehouse & plumbing shop - North Rouse This was the time and place set for a public hearing to consider the Conditional Use Permit for Michael McMullen. The applicant seeks a conditional use permit to allow the construction I of a warehouse and plumbing shop on North Rouse Avenue. The Planning Director advised the Commission that the Zoning Commission tabled action on the request for a conditional use permit. The hearing on the conditional use permit for Michael McMullen will be continued until a recommendation is received from the Zoning Commission. b) Kenneth Spain - construction of medical offices at Mendenhall & North 11th This was the time and place set for a public hearing to consider the Conditional Use Permit for Kenneth Spain. The applicant seeks a conditional use permit to allow the construction of medical offices at the corner of West Mendenhall and North lIth Avenue. The site is presently "08 J_ U' zoned R-4 which requires a conditional use permit for medical offices. The Planning Director advised the Commission that the Zoning Commission tabled action on the request for a conditional use permit. The hearing on the Conditional Use Permit for Kenneth Spain will be continued until a rec- ommendation is received from the Zoning Commission. Public Hearing - Planning staff zone code amendment (Chapter 18.76) I Townhouse Development Standards (to be continued) This was the time and place set for a public hearing to consider the Bozeman City-County Planning Staff Zone Code Amendment. The Planning Director advised the Commission that the Zoning Commission continued the hearing on the Townhouse Zone Code Amendment until the December Zoning Commission meeting. The hearing on the Bozeman City-County Planning Staff Zone Code Amendment will be con- tinued until a recommendation is received from the Zoning Commission. Authorize Consulting Architect to spell out duties of Architect for design and construction of New Library The Attorney General recently ruled that fee schedules previously used by architects are no longer valid. In order to discuss fees intelligently, there must be some directions with regard to the exact duties of any given architect for the New Library project. The Library Board suggested that the City utilize an architect in town who did not bid or was not interviewed for the library construction. They further suggested that Wm. Grabow be retained as Consulting Architect for the purpose of drafting the terms and conditions of the new Library. His services would be paid for from Library bond proceeds. Following discussion, it was moved by Commissioner MacNab, seconded by Commissioner Swanson, that the Commission delay action on hiring a consutling architect for a period of one week. The motion was carried by the following Aye and No vote. those voting Aye being Commis- sioner MacNab. Commissioner Swanson. Commissioner Vandeventer. and Mayor Sedivy. those voting I No being Commissioner Vollmer. . Approve plan and specifications and "Call for Bids" - construction of Water Mains Figgins 4th SID 600; Sanitary Sewer Figgins 4th - SID 601; Storm Drain & Paving Figgins 4th Addn. SID 602 - Open bids January 10, 1979 - Authorize Sale of Bonds January 17, 1979. The City Manager recommended that the plans and specifications for the construction and installation of water mains, Figgins 4th SID No. 600, sanitary sewer, Figgins 4th SID No. 601; and Storm Drain & Paving Figgins 4th SID No. 602 as prepared by Thomas, Dean & Hoskins, Inc. . be approved. Upon recommendation of the City Manager, it was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the plans and specifications be approved as presented. Also that the Clerk of the Commission be authorized and directed to publish a "Call for Bids" for the construction of SID no. 600, 601 and 602 with an opening date of January lO, 1979. The Clerk of the Commission was also authorized and directed to advertise for bids for the sale of bonds for SID No. 600 in the amount of $105.000.00, SID No. 601 in the amount of $88,000.00 and SID No. 602 in the amount of $50.000.00 to be received on January l7. 1979. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Vollmer, Commissioner Swanson. Commissioner Vandeventer. Commissioner MacNab and Mayor Sedivy, those voting No, none. Set date for public hearing for possible reallocation of Revenue Sharing Funds - December 27, 1978 It was moved by Commissioner Swanson. seconded by Commissioner Vandeventer. that Wed- I nesday, December 27. 1978, at l:l5 o'clock p.m. be the date set for a public hearing for the purpose of establishing the use of Federal Revenue Sharing Funds in accordance with a pro- posed budget revision as submitted by the City Manager to the City Commission. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner Swanson. Commissioner Vandeventer. Commissioner MacNab. U "': Opposition expressed in regard to giving land to private developers Section 8 project Some opposition was expressed by members of the audience on giving land to private developers in connection with the Section 8 housing program. The Commission thanked the members present for their presentation in regard to the Section 8 housing project. I Claims for November The payroll claims and the general claims for the month of November were presented. The City Manager had checked the claims and found them to be true and lawful claims against the City of Bozeman and recommended they be approved and the Director of Finance be instructed to issue warrants in payment. Since the City of Bozeman is pledged to cut expenses, particularly with the recently dis- covered fund shortage, Commissioner Vandeventer recommended the following: 1) A one-year hiatus of joining any local, state, or national association. As an example, included in today's list of claims is the American Water Works membership costing $200.00. I believe that for one year we can withhold our membership in associations such as this to give us a chance to determine if we are getting value received for value spent. I would certainly urge any member of the Water Department and any other departments whose "membership fees" will be questioned to stipulate why membership on a continued basis is mandatory. 2) While we gain a great deal of knowledge and insight from traveling to state and national meetings, I believe at least for one year, travel expense is another source we can reduce. 3) Our greatest source of help in this situation is our city employees. They are the ones who know their own situations best. This is the time they need to especially feel encourged to speak out their ideas to their immediate su- pervisors. This is also a time to put those ideas in writing to the City manager so we can all benefit from the creative ways to save on our opera- tional expenses. I I see the recently discovered fund shortage as not a total disaster. I see it as an oppor- tunity to re-evaluate the current costs of operating Bozeman's government. Following discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the City of Bozeman not join, or renew any membership in any association until it has been determined by the City Manager and various department heads involved that it is a good investment for the City of Bozman. The motion was carried by the follwing Aye and No vote. those voting Aye being Commissioner Vandeventer. Commissioner MacNab, Commissioner Vollmer, Commis- sioner Swanson and Mayor Sedivy, those voting No. none. Report The City Manager commented on the report of the Director of Public Service and recommended it be accepted and ordered filed. It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the report of the Director of Public Service be accepted and ordered filed. The motion was carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none. City Attorney excused from the meeting of December 20, 1978 The City Attorney asked to be excused from the meeting of December 20,1978. City Attorney asked for executive session to discuss litigations I The City Attorney requested an executive session for the purpose of discussing litigations. Adjournment There being no further business to come before the Commission, it was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the meeting be adjourned.
