The Commission of the City of Bozeman met in regular session in the Commission Room,
Municipal Building. November 22, 1978. at 1:l5 o'clock p.m. Present were Mayor Sedivy, Com-
missioner MacNab, Commissioner Vandeventer, City Manager Gesko, Ass't City Manager Smith, City
Attorney Berg and the Clerk.
Commissioner MacNab opened the meeting with a prayer whereupon the minutes of the regular
I meeting held on Wednesday. November l5, 1978 were approved as submitted.
Public Hearing - Commission Resolution No. 1999 - Assess solid waste collection and disposal
final passage - $209.lll.84
This was the time and place set for public hearing on levying the final assessment for
levying the Solid Waste Collection and Disposal Assessment in the amount of $209,111.84. Af-
fidavit of publication of Notice was presented. No one appeared to protest verbally. and
there being no protests on file, it was moved by CommissionerMacNab. seconded by Commissioner
Vandeventer, that Commission Resolution No. 1999 provisionally passed and adopted on Wednes-
day. November 15, be finally passed. The motion was carried by the following Aye and No vote
those voting Aye being Commissioner MacNab, Commissioner Vandeventer and Mayor Sedivy, those
voting No. none.
Ordinance No. 1016 - Zone Code Amendment - City/County Planning Staff - (public notice require

Ordinance No. 1016 amending Section 18.96.030 entitled:

AN ORDINANCE AMENDING SECTION 18.96.030 OF TITLE 18 ENTITLED THE CITY OF BOZEMAN
ZONE CODE.

The ordinance involves an amendment to the public notice requirements where zoning bound-
I aries are extended which require initial zoning classification. Public notice shall consist
of three separate notifications in a local newspaper. provided at least one of the notifications
is published not more than thirty days nor less than fifteen days prior to fue public hearing,
and no less than a total of eight radio announcements (a minimum of two broadcasts per station)
shall be broadcast within the same period of time by distribution to each local commercial AM
radio station serving the City of Bozeman to run simultaneously on each station.
In addition to such publication, the building inspector shall post same notice of public
hearing not more than thirty days nor less than fifteen days prior to the public hearings. on
the site in question as well as on one or more additional locations, visible to the general
public, within the affected area as deemed appropriate by he building inspector. However.
where City zoning boundaries are extended which require initial zoning classification, sign
posting requirements shall not apply.
Such notice shall be sent by mail. not more than thirty days nor less than fifteen days,
to the applicant and owners of record (or their legal representative) of the subject property
as well as to the owners of record of all parcels within one hundred fifty feet of the perimeter
of the subject property. The number of feet occupied by all public roads, streets. alleys. and
other public ways shall be excluded in determining the one-hundred-fifty-foot requirements.
However, where City zoning boundaries are extended which require initial zoning classification
mailing of notice of public hearing to such applicants. owners of public record (or their legal
representative) of the subject property (ies). or owners of record of all parcels within one
hundred fifty feet of the perimeter of the subject properties shall not apply.

Authority to call for bids - sale of Park department vehicle - open bids - December 13, 1978
The City Manager requested permission to call for bids for the sale of one 1958 Chevrolet I
one-half ton. six cylinder engine, 4 speed transmission, with a flat bed and hoist stored at
the Waste Water Treatment Plant.
It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the Com-
mission grant permission to call for bids for the sale of the vehicle, and the Clerk of the
Commission be directed to issue a "Call forBids" for the sale, to be opened on December l3.

Authority to Call for Bids - 2 door garage to be constructed at Waste Water Treatment Plant
Open Bids December 13, 1978
The residence utilized by the Waste. Water Treatment Plant Superintendent is badly in need
of a garage and the City Manager requested permission to call for bids for the construction of
a two-door garage.
I It was moved by Commissioner MacNab, seconded by Commissioner Vandeventer, that the Commis-
sion approve the construction of the two-door garage and the Clerk of the Commission be authorized
and directed to publish a "Call for Bids" with an opening date of December 13, 1978. The motion
was carried by the following Aye and No vote. those voting Aye being Commissioner MacNab, Commis-
sioner Vandeventer and Mayor Sedivy, those voting No, none.
Authorize specifications for bid: metal, clear-span vehicle storage/garage building for shop
complex. Open bids December 13, 1978
The City Manager recommended that plans and specifications for the construction of a
metal clear-span vehicle storage/garage building for the shop complex as prepared by the Build-
ing Inspector be authorized. and ~he Clerk of the Commission be authorized and directed to pub-
lish a "Call for Bids" for the construction thereof.
It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab. that the plans
and specifications be approved and the Clerk of the Commission be authorized and directed to
publish a "Call for Bids" for the construction of the shop complex with an opening date of
December 13, 1978. The motion was carried by the following Aye and No vote, those voting Aye
being Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy. those voting No, none.
Authorize signature on contract documents for sanitary sewer and water main on SID No's. 587,
589, and 59l
The Contract Documents for the constuction of Special Improvement District No. 587, 589,
and 591, sanitary sewer and watermain improvements in the Bomont Subdivision and Northeast
I Annexation prepared by Thomas. Dean and Hoskins. Inc., were presented. The City Manager rec-
ommended that the Contract Documents in the amount of $42,596.00 as submitted by Clause Ex-
cavating, Worden, Montana, be approved.
It was moved by Commissioner MacNab, seconded by Commissioner Vandeventer, that the
Contract Documents be approved and the Mayor and Clerk of the Commission be authorized and
directed to sign ~he contracts for the City of Bozeman, and that Clause Excavating be auth-
orized and directed to proceed with the construction of SID's 587, 589, and 59!. The motion
was carried by the following Ayeand No vote, those voting Aye being Commissioner MacNab, Com-
missioner Vandeventer and Mayor Sedivy, those voting No, none.
Submission of Certificate of Substantial Completition from Doug Rand, Architect. re: Senior
Center Building .....
A certificate of substantial completion of the Senior Citizens Social Center as prepared
by Doug Rand ARchitect of Bozeman was presented.
The certificate of completion does not relieve Edsall Construction of the responsibility
for negligence in faulty materials or workmanship within the extent or period provided by law.
$15.000.00 has been withheld from final payment to cover all of the items to be corrected or
completed.
Following discussion, it was moved by Commissioner Vandeventer. seconded by Commissioner
MacNab. that he certificate of substantial completion be acknowledged and the utility accounts
be placed in the name of the City of Bozeman. The motion was carried by the following Aye and

Salvation Army - permission to place bell stands at three locations November 24 thru December
23 -1st National. Bank~ Buttreys & Albertsons/Skaggs
A letter received from the Salvation Army requesting permission to place bell-stands at
the corner of the First National Bank, in front of Buttreys store, and Albertsons/Skaggs, was
presented.
It was moved by Commissioner MacNab. seconded by Commissioner Vandeventer, that the Commis-
sion approve the placing of the bell stands at the above locations from November 24 to December
23. 1978. The motion was carried by the following Aye and No vote, those voting Aye being

The City Manager presented an application from the Gallatin Shooting Sports Center Group.

A Parking Commission Resolution as prepared by Attorney Berg was presented. The Parking
Commission Resolution authorizes action to be taken on condemnation of the Stimson property.
