The Commission of the City of Bozeman met in regular session in the Commission Room,
Municipal Building. November l, 1978, at l:l5 o'clock p.m. Present were Mayor Sedivy, Commis-
sioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer. City Man-
ager Gesko, Ass't City Manager Smith. City Attorney Berg and the Clerk.
Commissioner MacNab opened the meeting with a prayer whereupon the minutes of the regular
I meeting held on Wednesday, October 25. 1978 were approved as submitted.
Open Construction Bids - SID 587 - Sanitary Sewer & Watermain Bomont Subdv.
SID 589 - Watermain Bomont Subdv.
SID 59l - Watermains Northeast Annexation
This was the time and place set for the opening of bids for construction of SID 587 sanitary
sewer & watermains in Bomont Subdivision, SID 589 watermains in Bomont Subdivision and SID No.
59l watermains Northeast Annexation. The affidavit of publication for the "Call for Bids" was
presented.
It was moved by Commissioner MacNab. seconded by Commissioner Vollmer, that the bids be
opened and read. The motion was carried by the following Aye and No vote, those voting Aye being
Commissioner MacNab. Commissioner Vollmer. Commissioner Swanson. Commissioner Vandeventer and
Mayor Sedivy, those voting No, none.
The following bids were then opened and read.

Upon the City Managers recommendation, it was moved by Commissioner Vollmer, seconded by
Commissioner Swanson, that the bids be referred to the consulting engineers, Thomas, Dean &
Hoskins. Inc. , and the City Engineer for tabulation and recommendation to be made on Wednesday,
November 8, 1978. The motion was carried by the following Aye and No vote. those voting Aye
I being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer. Commissioner MacNab
and Mayor Sedivy, those voting No. none.
Public Hearing - Conditional Use Permits
(a) D. Osterman - construct 3 warehouse bldgs - No. Rouse
This was the time and place set for a public hearing to consider the conditional use permit
requested by David Osterman. The applicant seeks approval to construct a complex of three (3)
warehouse buildings containing approximately 16,000 square feet of rent-type storage units. The
new complex will be similar to the applicant's existing two storage complexes.
The Planning Director presented the staff report which recommended approval of the condit-
ional use permit subject to six conditions.
The Mayor declared the hearing closed, and the City Manager recommended that action be
deferred for a period of one week.
(b) Everett Egbert - expansion of existing 4.000 sq. ft. rental shop located on Lot 7
of the Bozeman Industrial Park Subdivision
This was the time and place set for a public hearing to consider the conditional use permit
requested by Everett Egbert. The applicant seeks approval to expand the existing 4,000 square
foot rental shop. The building is located on Lot 7 of the Bozeman Industrial Park Subdivision.
or more commonly at the intersection of Industrial Drive and Griffin Drive.
The Planning Director presented the staff report which recommended approval of the condit-
ional use permit subject to four conditions.

The Mayor declared the hearing closed and a decision will be made on Wednesday, November 8,
1978.
(c) Vann's Inc.. - construction l4,000 sq. ft. bldg to be used as a music. television,
appliance and bedding retail warehouse display store at 2504 West Main Street
This was the time and place set for a public hearing to consider the conditional use permit
requested by Vann's Inc. The applicant seeks approval to construct a building containing approx-
imately 14,000 square feet to be used as a music, television. appliance. and bedding retail and
warehouse display store. The site is located at 2504 West Main Street, adjacent to and west of
the new Bob Ward & Son's store. The present zoning is B-2-T requiring a conditional use permit.

The Planning Director gave the staff presentation. and recommended approval of the appli-
cant subject to five conditions.
The public hearing was closed and the decision was deferred for a period of one week.
Public Hearing - Zone Change
(a) Continued Hearing - Michael M. Nash on behalf of Lonnie Beck, Stanley Erlenbush,
David Osterman, Kenneth LeClair, and James Placek. I
The request of Michael Nash was brought before the commission on August 31 for a public
hearing. The hearing was continued until a recommendation could be received from the Planning
Board and Zoning Commission.
A letter received from Michael requesting that the zone map change from R-3 and R-O to B-3
be withdrawn was presented.
The public hearing was closed and the request for a zone change from R-3 and R-O, which is
in conflict with the Bozeman Area Master Plan designation of Medium Density Residential, was
withdrawn.
(b) City County Planning Staff - amendment (public notice requirements)
This was the time and place set for a public hearing to consider the request of the City-
County Planning staff. The applicant seeks approval to minimize costs, yet provide adequate
public notice.
The Planning Director said that under the current public notice requirements outlined:, in
the Bozeman Zoning Code, whenever changes to the City's official zoning map are considered. all
property owners within the area considered for a zone map change as well as those property
owners living within one-hundred and fifty feet of the area under consideration must receive
written notification specifying the number, date. time and place of all scheduled public hear-
ings on the proposed zone map change.
Under the current public notice requirements , considerable, and more likely. prohibitive
costs would be incurred whenever large areas would be initially included into the City's extra- I
territorial zoning authority. In an effort to minimize costs, yet provide adequate public
notice, it was proposed that three public notices be advertised in a local paper with the
first public notice published not more than thirty days nor less than fifteen days prior to
the public hearing. Along with each such public notice will be a map describing the area for
which extraterritorial zoning is being sought.
Commissioner Vandeventer suggested that the notices be advertised through radio channels
as well as newspaper.
Several persons were present and stated that they were in favor of advertising by radio as
well as in the newspaper.

I Report from staff - re truck traffic
The City Manager advised the Commission that the staff had contacted other Montana cities,
including Ottawa, Ontario. Canada and Houston, Texas. Neither of the above have anything unique
in the method of dealing with truck traffic.
The City Manager said he intended meeting with the truckers. He felt the City should re-
ceive some input from the truckers. He further advised the Commission he was not in a position
to give a recommendation at this time.
Mr. Zimmer of the Pedestrian/Traffic Safety Committee appeared before the Commission. He
was not in a position to share any wisdom with the City at this point. He felt they needed to
see more data in regard to the desirablity of the truck route.

Sign Code Variance - Wooden sign in fire zone for Arcade Restaurant
A letter received from the Arcade Restaurant, lO North Willson Avenue. requesting a variance
to the Sign Code to place a wooden sign in Fire Zone l, was presented.
The sign will be two inch wood bound with iron. It will be thirty inches round and ten feet
from bottom edge to sidewalk. The sign is non-illuminated.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission I

Sign Code Variance - Laminated wood construction - "Buns Abundant" 240 E. Main
A letter received from Renee Erlandsen - Buns Abundant - 240 East Main requesting a vari-
ance to the Sign Code to install lamented wood construction sign at 240 East Main Street, was
presented.
The sign will be twenty inches by twenty-four inches.
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer. that the Commis-

mittee, requesting permission for a group of cars and open trucks. probably not to exceed ten
in number, to proceed from the SUB on the MSU campus to Buttreys Shopping Center, via 11th
Avenue and west to Main Street. then to Safeway Shopping Center and then driving the length of
Main Street to the Bozeman Hotel was presented.
Following discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner
MacNab. that the Commission grant the Democratic Central Committe.e:, permission to hold the

Call for bids - Sale of one 1947 Austin-Western Badger Shovel - Open November 15
I The City Manager requested permission to call for bids for the sale of one 1947 Austin-
Western Badger Shovel stored at the shop complex off North Rouse.
It was moved by Commissioner Vollmer. seconded by Commissioner Swanson, that the Commission
grant permission to call for bids for the sale of the shovel and the Clerk of the Commission be
directed to issue a "Call for Bids: for the sale. to be opened on November 15, 1978, and the

Amendment to contract - Kagy Blvd. design and engineering services - Thomas Dean & Hoskins
A letter received from Thomas, Dean & Hoskins. Inc. advising the Commission that the

Bozeman Urban System Kagy Blvd has been programed for a bridge to be constructed over Bozeman
Creek at an estimated cost of $2,000.00. was presented.
Following discussion, the City Manager recommended that the Commission approve an amend-
ment to the engineering contract to cover services for Kagy Boulevard improvements, to include
$2.000.00 maximum fee for core borings.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commis- I
sion approve the amendment to the contract in the amount of approximately $2,000.00. The motion
was carried by the following Aye and No vote. those voting Aye being Commissioner Vollmer, Com-
missioner Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy, those voting
No. none.

No. 1015 be passed and adopted. The motion was carried by the following Aye and No vote, those

voting No being Commissioner Vollmer and Mayor Sedivy.
Meeting - Continued until Friday at 2:00 p.m. for the purpose of negotiating the bond sale
of SID No's. 595, 596 and 597.
Meeting reconvened - Friday, November 3. 1978 - 2:00 p.m.
Negotiate sale of SID No's 595, 596 and 597
Mr. Albert Cook of Boettcher and Company. Denver. Colorado, appeared before the Commission
regarding the bond sale.
Mr. Cook explained that the best interest rate could be obtained over a fifteen year per- I
iod. He further explained that the bonds could be called at any time. Boettcher and Company
plan to close the issue on January 2, 1979. He advised the Commission that his company needed
to know whether the City would approve the sale of the bonds.
Having negotiated with the City Manager. Mr. Cook of Boettcher and Company presented the
Boettcher and Company good faith checks as prescribed by the Notice of Sale for SID No. 595.
596 and 597 and bid the following:
SID No. 595 - $ 40,000.00 @ 8.56%
SID No. 596 - l05,000.00 @ 8.57%
SID No. 597 - 66,000.00 @ 8.56%
The meeting was reconvened at 2.35 p.m.
Upon recommendation of the City Manager, it was moved by Commissioner MacNab. seconded
by Commissioner Swanson. that the sale of the bonds for SID No. 595 in the amount of $40.000.00
at 8.56% be awarded to Boettcher and Company of Denver, Colorado. The motion was carried by
the following Aye and No votes. those voting Aye being Commissioner MacNab, Commissioner Vollmer,
Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none.
Upon recommendation of the City Manager. it was moved by Commissioner Swanson, seconded
by Commissioner Vandeventer, that the sale of the bonds for SID No. 596 in the amount of
$105.000.00 at 8.57%beawarded to Boettcher and Company of Denver. Colorado. The motion was
carried by the following Aye and No vote, those voting Aye being Commissioner Swanson. Commis-
sioner Vandeventer. Commissioner MacNab, Commissioner Vollmer and Mayor Sedivy, those voting

Upon recommendation of the City Manager, it was moved by Commissioner Vandeventer, sec-
onded by Commissioner MacNab, that the sale of the bonds for SID No. 597 in the amount of
$66.000.00 at 8.56% be awarded to Boettcher and Company of Denver, Coloardo. The motion was
carried by the following Aye and No vote. those voting Aye being Commissioner Vandeventer.

recommended the low bid of Clause Excavating & Construction, Worden, Mt. in the amount of
$176,225.00 it being the lowest and best bid submitted.
It was moved by Commissioner Vandeventer. seconded by Commissioner Swanson. that the
award be made to Clause Excavating & Construction from Worden, Montana on the basis of their
I low bid in the amount of $l76.225.00. The motion was carried by the following Aye and No
vote, those voting Aye being Commissioner Vandeventer. Commissioner MacNab, Commissioner
Vollmer, Commissioner Swanson and Mayor Sedivy, those voting No, none.

There being no further business to come before the Commission, it was moved by Commis-
sioner Vollmer, seconded by Commissioner Swanson. that the meeting be adjourned. The motion
was carried by the following Aye and No vote, those voting Aye being Commissioner Vollmer,
Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab and Mayor Sedivy. those
