The Commission of the City of Bozeman met in regular session in the Commission Room,
Municipal Building, October 25. 1978. at l:l5 o'clock p.m. Present were Mayor Sedivy, Com-
missioner MacNab, Commissioner Vollmer, Commissioner Swanson. Commissioner Vandeventer, City
Manager Gesko, Ass't. City Manager Smith. City Attorney Berg and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer whereupon the minutes of the I
regular meeting held on Wednesday. October 18. 1978. were approved as submitted.
Consideration of waiver - Transient merchant fee for Bozeman Winter Fair
The request from the Bozeman Winter Fair Board. requesting that the endorcement of Sec-
tion 3.12.030 - license fee, and 3.12.050 - bond requirements of the Bozeman Municipal Code
be waived for the Bozeman Winter Fair. was presented for further discussion and a decision.
The Chamber of Commerce Board of Directors drafted a resolution recommending that no
special license fee nor surety bond be required of transient merchants. They further recom-
mended that the Winter Fair personnel continue to make every effort to screen out any person
or persons not considered desirable as exhibitors at the Winter Fair.
The Commission concurred in the recommendation of the City Manager, and it was moved by
Commissioner MacNab, seconded by Commissioner Vollmer, that the license fee and surety bond
be waived for the transient retail merchants. The motion was carried by the following Aye
and No vote. those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner
Swanson, Commissioner Vandeventer and Mayor Sedivy. those voting No. none.
Residency - requirements for City employees
The residency requirements for City employees was brought before the Commission for dis-
cussion and a decision.
Several persons were present to discuss the requirements for City employees.
Attorney Jim Kommers was present on behalf of the Police Protective Association.
Following discussion. it was moved by Commissioner MacNab, seconded by Commissioner I
Vollmer, that the City Commission establish a historical center of the city (presumably the
intersection of Tracy and Main). and allow employees to reside within a straight line. 5~-
mile radius of that point with the following provisions:
1. Approval in writing of both the Department Head and the City Manager.
2. That they live on an all weather road.
3. That they have a private telephone line.
4. They must sign a waiver of protest for annexation.
Commissioner MacNab said this line will not increase as the City grows and eventually
everyone will be living within the City. Commissioner Vandeventer agreed with him.
Thosevoting Aye on the motion being Commissioner MacNab and Commissioner Swanson; those
voting No, being Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy. The motion
died for lack of a majority.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the City
employees be required to live within the City limits, and those living outside the City limits
at this time return to the City within a two-year period.
Before the voting took place the City Manager stated he felt that this would create an
extreme hardship on those people moving out of the city within the last year. He felt they
moved out of the City in good faith.
Those voting Aye on the motion were Commissioner Vollmer, those voting No, being Commis- I
sioner Swanson, Commissioner Vandeventer. Commissioner MacNab and Mayor Sedivy. The motion
died for lack of a majority.
It was then moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that
the City retain the 3~ mile radius within which City employees might live and that anyone
now living in the 3~ mile area be allowed to remain there under the grandfather clause. Any
City employee that wants to move outside the City limits must have the approval of the De-
partment Head as well as that of the City Manager. They must live on an all-weather road,
have a private telephone and sign a waiver of protest for annexation.
It was moved by Commissioner MacNab. seconded by Commissioner Vollmer. that the Commission

amend the motion to read that the 3~ mile residency boundary not expand as the city grows. Those
voting Aye to the amended motion being Commissioner MacNab; those voting No being Commissioner
Vollmer. Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy. The motion died for
lack of a majority.
Subsequent to the aforementioned proceedings, Commissioner Vandeventer modified his orig-
I inal motion to incorporate the conditions as follows:
l. That all employees may live within three (3) miles of the City limit boundaries if
their move is approved by their immediate supervisor and subject to final approval
, by the City Manager. Further. all employees, if they intend to move within the
three (3) mile limit live on all-weather roads, and be able to obtain a private
telephone line, and be willing to sign a waiver of protest to annexation.
This motion also included the stipulation that all those who received approval
from their supervisor and the City Manager to move within the 3~ mile limit as
set forth in the previous policy in force during the past 14 months should be
permitted to stay at their present location.
Those voting Aye on the original motion being Commissioner Vandeventer. Commissioner MacNab.
and Commissioner Swanson; those voting No being Commissioner Vollmer and Mayor Sedivy. The motion
was carried by a three to two vote.
Public Hearing - Commission Resolution No. 2003 - Vacating Alley - First Security Bank - Ordin-
ance No. 1014 - Vacating Alley - First Security Bank
This was the time and place set for a public hearing to consider the request of the First
Security Bank for vacation of a portion of the Alley between Lots 29 and 30 in Block C of the
Original Townsite of the City of Bozeman. Affidavit of publication of Notice and the Sheriff's
certificate stating all property owners had been notified as required by law was presented.
There were no written protests on file, and no one appeared to protest verbally.
The hearing was closed. and it was moved by Commissioner Swanson, seconded by Commissioner
Vandeventer, that Ordinance No. 1014, entitled set forth in full:

fidavit of publication of Notice was presented. No one appeared to protest verbally, and there
being no protests on file, it was moved by Commissioner Vandeventer. seconded by Commissioner
MacNab, that Commission Resolution No. 2008 provisionally passed and adopted on October 18, 1978
be finally passed. The motion was carried by the following Aye and No vote. those voting Aye
being Commissioner Vandeventer. Commissioner MacNab. Commissioner Vollmer, Commissioner Swanson

Recreation Board - Acknowledge endorsement - Re - Langohr Park SID
An endorsement from the Recreation Board, suggesting that the City proceed with creation
of an SID and the development of Langohr Park. was presented.
The submission of an application for federal funds to assist in this project at an estimated
cost of $200,000 was approved on Wednesday, October l8. 1978.
Following discussion, it was moved by Commissioner Vandeventer. seconded by Commissioner
Vollmer, that the City Attorney be directed to draw up a resolution of intention for the creation
of a Special Improvement District. The motion was carried by the following Aye and No vote.

Petition - Story Hills request to create sanitary sewer system
A letter received from Thomas H. Langel, Story Hills Development, petitioning the City of
Bozeman to create a special improvement district to install a sanitary sewer to serve the west
portion of Story Hills, was presented.
Following discussion, it was moved by Commissioner MacNab, seconded by Commissioner Vollmer,
that the City acknowledge receipt of the petition and it be referred to the City staff for a
I recommendation. The motion was carried by the following Aye and No vote, those voting Aye being

City Manager to attend 54th Annual Conference - St. Louis, November 26-30
The Annual Conference of the National League of Cities is scheduled to be held in St. Louis.
November. 26-30. 1978. and the City Manager requested permission to attend the conference.
It was moved by Commissioner Vandeventer. seconded by Commissioner MacNab that City Manager

a) The City Manager presented an application from the Gallatin Chapter Montana Mountain
Mushers. along with the required fee, for a raffle to be held on December 20, 1978.

Proclamation - Life Insurance Week - October 29 through November 4, 1978
In accordance with a request from the Mid-Montana Association of Life Underwriters,
Mayor Sedivy proclaimed the week of October 29 through November 4. 1978 as "Life Insurance
Week" in the City of Bozeman and recommended that all citizens observe this week with appro-
priate programs.
It was moved by Commissioner Swanson. seconded by Commissioner Vandeventer. that the
Mayor's proclamation be endorsed and the motion was carried by the following Aye and No vote,
those voting Aye being Commissioner Swanson. Commissioner Vandeventer. Commissioner MacNab,
Commissioner Vollmer and Mayor Sedivy, those voting No. none.
Discussion of truck traffic problems
The City Manager advised the Commission that in researching what other Montana cities were
doing in regard to the truck traffic problem, they found other cities were not satisfied with
the results. The truck problem still persists.
Several persons were present in regard to the problem.
The simplest expedient would be to post "No Truck Traffic" signs in problem areas. A
more formal approach would be to designate specific truck routes as such. to be deviated only
on an occasion of pickup or delivery within a residential area. More likely than not, most of
the city's arterials would be designated truck routes.
In researching what other Montana cities were doing. the survey was rather basic and
elementary, and its results certainly rather easily digested. I
The Pedestrian/Traffic Safety Committee met Tuesday evening but Mr. Zimmer was unable
to attend the Qommission meeting to relate any observations they might have. The City Manager
advised the Commission that any surveys or studies made by the Pedestrian/Traffic Safety
Committee would benefit the city.
Stephanie Becker of 902 South Willson was present and said the City should consider
secondary highways as truck routes.
Commissioner Swanson favored setting load limits on City streets.
The truck traffic problem will be delayed for a period of one week for further study and
staff recommendation.
U.S. Department of Housing & Urban Development - Option to purchase University Village dba
Greentree Apartments - Project #093-35037
A letter received from the U.S. Department of Housing and Urban Development allowing
the City of Bozeman first option on the purchase of the Greentree Apartments. was presented.
The Commissioners stated that they did not feel that the City should be involved in the
housing business.
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the
City Manager address a letter to the Department of Housing Urban and Development advising
them there is no interest on the part of the City to negotiate for the acquisition of the
Greentree Apartments. The motion was carried by the following Aye and No vote. those voting
Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner I
Vollmer and Mayor Sedivy. those voting No, none.
