The Commission of the City of Bozeman met in regular session in the Commission Room, Mun-
icipal Building, September 27, 1978, at l:15 o'clock p.m. Present were Mayor Sedivy, Commis-
sioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City Hana-
ger Gesko, Ass't City Manager Smith, City Attorney Berg and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer whereupon the minutes of the
regular meeting held on Wednesday, September 20, 1978, were approved as read. I
Confirmation - Police Officer Bickle- effective September 21, 1978
A letter received from the Acting Police Chief stating Officer Kerry Bickle had successfully
completed his probationary status as a member of the Police Department effective September 2l,
was presented.
The Acting Chief of Police recommended that Officer Bickle be confirmed as a regular mem-
ber of the Police Department effective September 2l, 1978.
The City Manager concurred in the recommendation of the Acting Police Chief, and it was
moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the confirmation of Kerry
Bickle as a police officer be approved. The motion was carried by the following Aye and No
vote, those voting Aye being Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson,
Commissioner Vandeventer and Mayor Sedivy, those voting No, none.
Open Construction Bids - SID No's 592, 593 & 594 - S. Sewer, Storm Drain & Paving:, ,Imp ~,Figg:in~..4 -'.
This was the time and place set for the opening of bids for SID No. 592 for the construct-
ion of a watermain, SID No. 593 for the construction of a sanitary sewer, and SID No. 594, for
the construct:loh or"paving of Figgins Phase 4:' ~Theliffid~vit of publi~ation for the"Call"fcit
Bids" was presented.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the bids be
opened and read. The motion was carried by the following Aye and No vote, those voting Aye being
Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab and
Mayor Sedivy, those voting No, none. I
The following bids were then opened and read:
Clause Excavating & Construction - Worden, Montana $49,916.00
Intermountain Construction - Bozeman, Montana 50,206.00
Lockie Excavating - Bozeman, Montana 60,136.75
Tom Roe & Son - Big Timber, Montana 41,603.27
Upon the City Manager's recommendation, it was moved by Commissioner Swanson, seconded
by Commissioner Vandeventer, that the bids be referred to the consulting engineers, Thomas,
Dean & Hoskins, Inc. , and the City Engineer for tabulation and recommendation to be made on
Wednesday, October 4, 1978, and that the bid security check be returned to Lockie Excavating
as highest bidder. The motion was carried by the following Aye and No vote, those voting Aye
being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer,
and Mayor Sedivy, those voting No, none.
Discussion - Downtown Development Association - Parking
Attorney Sabol appeared before the Commission on behalf of the Downtown Development Assoc-
iation. He advised the Commission that the Downtown Development Association has become more
active and that he would like to comment on Commission Resolution No. 1839 which was adopted
November 24, 1976.
Section 4 of Commission Resolution No. 1676 limited its authorities of the Parking Commis-
sion in the three specific areas.
1. The Parking Commission shall not have the authority to make capital improvements in I
excess of $5,000 without the approval of the City Commission of the City of Bozeman.
2. The Parking Commission shall have no power to regulate on-street parking.
3. The Parking Commission shall have no power to issue revenue bonds or special improve-
ment bonds in its name or in the name of the City of Bozeman without prior written
consent of the City Commission of the City of Bozeman.
Attorney Sabol said the Downtown Development Association felt that they must have unlimited
control of downtown parking, such as off-street and on-street parking.

A petition signed by 310 interested persons was presented. The petitioners contend that
the Parking Commission must regulate and coordinate both the $750,000.00 downtown off-street
parking district and on-street parking, if needs of the public are to be served.
Wayne Gibson, President of the Downtown Development Association said his group have dis-
cussed several possibilities.
I The Commission thanked Attorney Sabol for his presentation. The Downtown Development
Association was advised that it would be the decision of the City Attorney and the City Commis-
sion whether official action must be taken to clarify the authority of the Parking Commission.
Discussion regarding Wessel, Hall & Cowdrey utility requests
The City Manager advised the Commission that he was not in a position to make a recommend-
ation at this meeting but hoped to have the desired information by the following week.
Petition - Request to create SID for development of Langohr Park
A petition signed by approximately 100 property owners requesting the City of Bozeman to
create a Special Improvement District for the development of Langohr Park was presented. The
development shall not exceed $200,000 and such assessments shall not exceed five (5C) cents
per square foot of real property.
It was moved by Commissioner Vandeventer, seconded by Commissioner MacNab, that the Commis-
sion acknowledge receipt of the petition and refer it back to the park recreation committee to
consider the plans. The motion was carried by the following Aye and No vote, those voting Aye
being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson,&
Mayor Sedivy, those voting No, none.
Authorization to execute Contract - Ambulance service for Gallatin County, City of Bozeman,
and Good Samaritan Ambulance Service
An Agreement by and between the County of Gallatin, the City of Bozeman, and Clifford C.
I Halls, doing business as Good Samaritan Ambulance Service was presented.
In view of a new owner all throught it preferable to execute a new agreement with the new
owner. The City Manager stated there were very few revisions made to the Agreement
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission
enter into the Agreement, and instruct the City Manager and the Clerk of the Commission to execute
the Ambulance Contract Agreement. The motion was carried by the following Aye and No vote, those
voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commis-
sioner MacNab, and Mayor Sedivy, those voting No, none.
Commission Resolution No. 2003 - Vacate First Security Bank Alley - Hearing October 25

DECLARING TO BE THE INTENTION OF SAID COMMISSION TO VACATE THE ALLEY
BETWEEN LOTS 29 AND 30 IN BLOCK C OF THE ORIGINAL TOWNSITE OF THE CITY
OF BOZEMAN, MONTANA.
as prepared by the City Attorney was directed by the City Commission to vacate the alley between
Lots 29 and 30 in Block C of the Original Townsite for use as a North South Alley, being 20 feet
in width and 141.5 feet in length.
It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that Commission Reso-
lution No. 2003 be passed and adopted and October 25, 1978, be the date set for public hearing.

Kagy Boulevard & North 19th Avenue - Authorization to proceed with working design drawing
The State Highway Commission considered Kagy Boulevard and North Nineteenth Avenue recently,
and approved the concept submitted to them by the City.
The City Manager stated authorization should be given Thomas, Dean and Hoskins to proceed
with the working design drawings for these two projects.
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that authorization
be given Thomas, Dean & Hoskins to proceed with the working design drawings. The motion was carried
by the following Aye and No vote, those voting Aye being Commissioner Swanson, Commissioner Vande-
venter, Commissioner MacNab, Commissioner Vollmer and Mayor Sedivy, those voting No, none.

Commission Resolution 2004 - Intent to Create SID 607 - Paving Gilkerson & Nik1es Drive
Commission Resolution No. 2004, declaring the intention to create Special Improvement Dis-
trict No. 607, for the construction and installation of an asphaltic concrete pavement on Nikles
and Gilkerson Drive in McChesney Industrial Park was presented, entitled:

Authority to purchase 5,000' copper tubing for Water Department
The Water Department has need for copper tubing and the City Manager requested authority
to purchase the copper tubing at an approximate cost of $4,000.00.
It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the City Manager
be granted authorization to purchase 5,000 feet 3/4 inch copper tubing. The motion was carried
by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner Vollmer,
Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none.
Set date for Public Hearing - proposed Facility Plan
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that Tuesday, I
October 31, 1978, at 7:30 p.m. be the date set for a public hearing to receive public comment
on the proposed Facility Plan, and Engineering Report on the Sanitary Sewer System for the City
of Bozeman. The motion was carried by the following Aye and No vote, those voting Aye being
Commissioner Vollmer, Commissioner Swanson, Commissioner MacNab, and Mayor Sedivy, those voting
No being Commissioner Vandeventer.
Discussion & Proclamation - Nuclear Awareness Week - October 1-7, 1978
A short discussion was held in regard to Nuclear Awareness Week to be held October l-7,
1978. A variety of activities are being scheduled during this week to provide a public forum
for debate of the issues and to provide the citizens with the information they need to make an
informed decision.
Mayor Sedivy proclaimed the week of October 1-7 as "Nuclear Awareness Week" and urged the
citizens of Bozeman to use this opportunity to become informed on both sides of the issue.
Application for Gambling License - Eagles Lodge
The City Manager presented an application from the Eagles Lodge, along with the required
fee, for a gambling license.
Upon recommendation of the City Manager, it was moved by Commissioner Swanson, seconded
by Commissioner Vandeventer, that the Commission approve the application for the gambling license
for Eagles Lodge in the amount of $250.00. The motion was carried by the following Aye and No
vote, those voting Aye being Commissioner Swanson, Commissioner Vandeventer, Commissioner MacNab, I
Commissioner Vollmer and Mayor Sedivy, those voting No, none.
Raffle License application - Lucky Five - December 3l, 1978
Gallatin Empire Lions Club - November 2, 1978
The City Manager presented an application from the Lucky Five,a10ng with the required fee,
for a raffle to be held on December 31, 1978.
Upon recommendation of the City Manager, it was moved by Commissioner Vandeventer, seconded
by Commissioner MacNab, that the Commission approve the application for the raffle to be held on
December 31, 1978. The motion was carried by the following Aye and No vote, those voting Aye
being Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson,

The City Manager presented an application from the Gallatin Empire Lions Club, along with
the required fee, for a raffle to be held on November 2.
It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commission
approve the application for the raffle to be held on November 2, 1978. The motion was carried

Authorize absence of Commissioner MacNab - October 4, 1978
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the absence of
Commissioner MacNab from the meeting of October 4, 1978, be authorized in compliance with Section
11-3245, R.C.M. , 1947. The motion was carried by the following Aye and No vote, those voting
Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, Commissioner
MacNab and Mayor Sedivy, those voting No, none.
Adjournment
There being no further business to come before the Commission, it was moved by Commissioner
MacNab, seconded by Commissioner Vandeventer, that the meeting be adjourned. The motion was
carried by the following Aye and No vote, those voting Aye being Commissioner MacNab, Commissioner
Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those voting No, none.
