The Commission of the City of Bozeman met in regular session in the Commission Room, Munic-
ipal Building, September 20, 1978, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner
MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer, City Manager Gesko,
City Attorney Berg and the Clerk.
I Commissioner Vollmer opened the meeting with a prayer whereupon the minutes of the regular
meeting held on Wednesday, September 13, 1978, were approved as submitted.
Acknowledgement of appraisal report and consideration of a resolution - re - vacation of Fridley
and McAdow Streets requested by Western General Enterprises
Western General Enterprises recently requested the City Commission to vacate certain portions
of Fridley and McAdow Streets. Mr. Simkins of Western General was told that the City aimed at a
policy of selling vacated lands, rather than giving such lands to abutting property owners.
The City Manager stated an independent appraisal had been made and that he would research
the code, to determine whether or not the City could sell anything below its appraised value.
It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commission
acknowledge the appraisal report on the vacation of portions of Fridley and McAdow Streets. The
motion was carried by the following Aye and No vote, those voting Aye being Commissioner MacNab,
Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor Sedivy, those vot-
ing No, none.
Approve plans and specifications and "Call for Bids" - Construction of Watermains SID 595, Sani-
tary Sewer SID 596, and Sanitary Sewer SID 597 all in McChesney/Wheat Subdv. Open construct-
ion bids October 11. Authorize sale of bonds October 18, 1978
The City Manager recommended that the plans and specifications for the construction and in-
stallation of a watermain on Northwood Drive in Wheat Subdivision SID NO. 595, sanitary sewer
mains on Meadow Lane, South to Griffin Drive and on Griffin Drive SID No. 596, and sanitary sewer
mains in Wheat Commercial Subdivision SID No. 597, as prepared by Morrison Maierle, Inc., be approved.
I Upon recommendation of the City Manager, it was moved by Commissioner Vollmer, seconded by
Commissioner Swanson, that the plans and specifications be approved as presented. Also, that the
Clerk of the Commission be authorized and directed to publish a "Call for Bids" for the construction
of watermains and sanitary sewer mains with an opening date of October ll, 1978. The Clerk of the
Commission was also authorized and directed to advertise for bids for the sale of bonds for SID
No. 595 in the amount of $40,000.00, SID No. 596 in the amount of $l05,000.00, and SID No. 597 in
the amount of $66,000.00, to be received on October 19, 1978. The motion was carried by the follow-
ing Aye and No vote, those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner
Vandeventer, Commissioner MacNab and Mayor Sedivy, those voting No, none.
Decision - Conditional Use Permit - add recreational facility to Phase 1 Woodbrook P.U.D.
The hearing on the request of the Woodbrook Planned Unit Development for a Conditional Use
Permit to add recreational facilities to Phase 1 was closed on Wednesday, September l3, 1978. The
subject has been continued until today for a final decision.
The Mayor asked how many such requests in Planned Unit Devolopments would be similar to the
request at hand. He also asked if this would tend to establish a precedent if the request was
approved.
The Planning Director indicated that there have been no Planned Unit Developments approved
which included a proposal similar to what is being requested. He further stated that as far as
future requests of this kind, a decision to approve this request could establish some sort of a
precedent.
I The concerned citizens forum and the University Thompson Fourth Homeowners Association pro-
tested the desirability and suitability of the proposed use in the Woodbrook Planned Unit Develop-
ment.
The City Manager asked if the matter of conflict of interest was settled. The applicant said
it was.
The Zoning Commission recommended denial of the Conditional Use Permit as requested by Willow-
brook, Ltd.
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Commis-
sion deny the request from Willowbrook. Ltd. to build a commercial racketball facility. The motion
was carried by the following Aye and No vote, those voting Aye being Commissioner Swanson, Commis-

sioner Vandeventer, Commissioner MacNab, Commissioner Vollmer and Mayor Sedivy, those voting No,
none.
It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commission
approve the request of the Woodbrook Planned Unit Development for a Conditional Use Permit to
include the small clubhouse, the tennis court, and the swimming pool as a part of the over all con-
ceptional development plan that might be used with Phase 1 as originally approved on August 31, I
1977 . The motion was carried by the following Aye and No vote, those voting Aye being Commis-
sioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor
Sedivy, those voting No, none.
Consideration of Ordinance relating to City employees residency
A proposed draft ordinance relating to city employees residency was submitted by the City
Attorney for consideration by the Commission.
It was moved by Commissioner Swanson, seconded by Commissioner Vandeventer, that the Commis-
sion delay action on the ordinance relating to City Employees residency.
Those voting Aye on the above motion were Commissioner Swanson, Commissioner Vandeventer,
and Commmissioner MacNab. Those voting No, were Commissioner Vollmer and Mayor Sedivy. The
motion was carried.
Commission Resolution NO. 2002 - Authorizing question of Municipal bonds for New Municipal Lib-
rary to be submitted at the next election

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, SUB-
MITTING TO THE QUALIFIED ELECTORS OF THE CITY OF BOZEMAN AT A GENERAL ELEC-
TION ON NOVEMBER 7TH, 1978, THE QUESTION OF ISSUING GENERAL OBLIGATION BONDS
IN AN AMOUNT OF NOT TO EXCEED $l,460,OOO.00 FOR THE PURPOSE OF ACQUIRING A
SITE FOR, AND TO CONSTRUCT, BUILD AND FURNISH A NEW MUNICIPAL LIBRARY IN
BOZEMAN, AND PROVIDING THE NUMBER OF YEARS THROUGH WHICH THE BONDS ARE TO
BE PAID SHALL BE 20 YEARS.

The resolution officially authorizes placement of the question of a municipal bond sale for
a new municipal library to the electorate on Tuesday, November 7, 1978, as follows:
PROPOSITION
THAT THE CITY OF BOZEMAN, MONTANA, ISSUE ITS GENERAL OBLIGATION BONDS IN
AN AMOUNT NOT TO EXCEED $1,460,000.00 TO BE PAYABLE DURING A PERIOD OF 1Q
YEARS FROM THE DATE OF ISSUANCE, THE PROCEEDS OF SUCH BONDS TO BE USED TO
ACQUIRE A SITE FOR AND TO CONSTRUCT, EQUIP AND FURNISH A NEW MUNICIPAL
LIBRARY IN BOZEMAN, MONTANA.
It was moved by Commissioner Vandeventer, seconded by Commission MacNab, that the Commission
authorize the placement of an Official Ballot on the General Election to be held on Tuesday, Nov-
ember 7, 1978. The motion was carried by the following Aye and No vote, those voting Aye being
Commissioner Vandeventer, Commissioner MacNab, Commissioner Vollmer, Commissioner Swanson, and
Mayor Sedivy, those voting No, none.
Montana State University - Permission to hold annual MSU Homecoming Parade, Saturday, October 14,
1978, 10:00 A.M.
A letter received from the Montana State University Alumni Association requesting permission
to hold the annual MSU Homecoming Parade on Main Street on October l4, 1978, was presented.
It was moved by Commissioner MacNab, seconded by Commissioner Vollmer, that the Commission
grant the Montana State University Alumni Association permission to hold the annual MSU Homecoming
Parade. The motion was carried by the following Aye and No vote, those voting Aye being Commis-
sioner MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Vandeventer and Mayor I
Sedivy, those voting No, none.
Proposed sign ordinance presentation - Planning Staff
Suzanne Jurgens of the Planning Department prepared a draft sign ordinance which was present-
ed to the Commission. Members of th- Planning Department were present to explain the ordinance.
They stated there is a limit to the information level that can be observed by motorists and sug-
gested fewer signs would probably aid business. The Planning Director said the intent of the
ordinance is to take advantage of the natural beauty of Bozeman. He suggested the height and
size limitations could be changed if the Commission thought it was necessary.

The Commission thanked Suzanne Jurgens and Paul Bolton of the Planning Department for their
extensive presentation of the draft sign ordinance.
Report
The City Manager commented on the Library report and recommended it be accepted and ordered
filed. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Library

There being no further business to come before the Commission, it was moved by Commissioner
Vandeventer, seconded by Commissioner Swanson, that the meeting be adjourned. The motion was

missioner MacNab, Commissioner Vollmer, Commissioner Swanson and Mayor Sedivy, those voting No,
none.
