HomeMy WebLinkAbout1981-04-01 289 Bozeman, Montana April 1, 1981 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, April 1, 1981, at 1:15 p.m. o'clock. Present were Mayor MacNab, Commissioner Vollmer, I Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Acting City Manager Evans, City Attorney Planalp, and the Clerk. The Commission meeting was opened with the Pledge of Allegaince and a prayer by Commissioner Vollmer, whereupon the minutes were approved as submitted. Continued hearing - Zone Map Change - Walter Nacey - AS to R-MH, North 19th and Durston - to be continued for one week This was the time and place set for the continued hearing to consider the Zone Map Change requested by Walter Nacey. The applicant seeks a change to the City's Official Zoning Map on a 50 acre tract of land located one-half mile north of Durston on Nineteenth and abuting the northwest corner of the Covered Wagon Trailer Court. The public hearing will be continued for a period of one week. Continued Public Hearing - Planning Staff - Zone Code Amendment Chapter 18.21 - Provide flexibility to desi1n future lots around cul-de-sacs, terrain features and property shapes. Minimum 7,500 sq. ft. lot sha 1 be included to insure uniformity of lot sizes based upon the R-2 district. The hearing on the request of the Planning Staff for a Zone Code Amendment was continued for a period of 1 week. Story Hills Annexation Report This was the time and place set for the decision and possible adoption of Story Hills Annexation Report. The decision and possible adoption will be continued for a period of one week. I Public hearing - Commission Resolution No. 2305, SID No. 633 - Watermain and Sewer in West Main Business Plaza - Intent to Create This was the time and place set in Commission Resolution No. 2305 to hear protests to the creation of Special Improvement District No. 633 for the purpose of construction and installation of watermain and sewer in West Main Business Plaza. Affidavit of publication of notice and the Clerk's mailing certificate, stating all property owners had been notified as required by law was presented. There were no written protests on file and no one appeared to protest verbally. The public hearing was continued for a period of one week. Public hearing - Commission Resolution No. 2306, SID No. 634 - Sewer - West Main Business Plaza This was the time and place set in Commission Resolution No. 2306, to hear protests to the creation of Special Improvement District No. 634 for the purpose of construction and installation of sanitary sewer main between Babcock and College Streets on West Main Street. Affidavit of publica- tion of notice and the Clerk's mailing certificate, stating all property owners had been notified as required by law was presented. There were no written protests on file and no one appeared to protest verbally. The public hearing was continued for a period of one week. Public Hearin - Zone Code Amendment h Sabol - Cha ter 18.72.150 -(to allow utilit substations as a con ltlonal use ln B-2 distrlct This was the time and place set for the public hearing to consider the Zone Code Amendment requested by Mr. Joe Sabol. The Applicant seeks an amendment to the City Zoning Code which, if approved, would change I Chapter 18.72.150 to allow utility substations as a conditional use in a ~-2 District. The public hearing was continued for a period of one week. Public Hearing - Zone Map Change - - J. R. Williams and R. L. Hawks (R-4 to R-O) to be continued This was the time and place set for the public hearing to consider the Zone Map Change requested by J. R. Williams and R. L. Hawks. 290 The Applicants wish to change Lots 6-8 Block 6, West Park Addition from an R-4 (Residential- Medium Density Apartments) to R-O (Residential-Office District). This site is located at the southeast corner of West Babcock Street and South 11th Avenue at 1016 West Babcock Street, and is approximately 13,124 square feet. The public hearing was continued for a period of one week. Public Hearing - Zone Map Change - Virgil Jahnke - R-2 to R-2-A I This was the time and place set for the public hearing to consider the Zone Map Change requested by Virgil Jahnke. The Applicant wishes to change the zoning of the NE\ of Section 10, T2S, R5E from R-2 to R-2-A which is located south of and adjacent to West Durstoni The site size is approximately 130 acres. The public hearing was continued for a period of one week. Public Hearing - Zone Map Change - Maurice Klabunde - R-4-T to B-2-T This was the time and place set for the public hearing to consider the Zone Map Change requested by Maurice Klabunde. The Applicant wishes to change the SE~, SE~, Section 11, T2S, R5E, from R-4-T (Medium Density - Residential Apartments - Transitional) to B-2-T (Highway Business Commercial - Transitional) which is located approximately 300 yards south of the University Plaza Shopping Center and east of and adjacent to South 23rd Avenue. The site is approximately 5 acres. The public hearing is to be continued for a period of one week. Public Hearing - Zone Code Amendment - Joseph Sabol - Chapter 18.95.030 - To provide for clarification df approval or denial of a proposed zone code amendment - to be continued This was the time and place set for the public hearing to consider the Zone Code Amendment requested by Joseph Sabol. The Applicant seeks an amendment to the City Zoning Code which, if approved, would require the City Commission, upon request, to prepare written finding of supporting its approval or denial of I a particular rezoning request. The public hearing is to be continued for a periOd of one week. Permission to seal overhead doors at Fire Hall The City Manager requested authorization to proceed on a project to seal the overhead doors at the main Fire Station. The cost for the installation should not exceed $1,000.00. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Commission authorize insulation of the overhead doors. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. Bobcat Boosters - Permission to place banner across Main Street A request from the Bobcat Boosters for permission to hang a banner across Main Street at the corner of Black Avenue and Main Street for the advertising of the Bobcat Booster Fund Drive, was presented. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Bobcat Boosters be granted permission to place the banner across Main Street for a peri.od of one week beginning March 27, 1981, and that the $25,00 permit fee be refunded if the banner is removed at the designated time. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none. Open Bids - Elevator for Municipal Building I This was the time and place set for opening bids for the general contract, including all mechanical, electrical and elevator equipment work for construction of an elevator addition to the Municipal Building for the City of Bozema~. The affidavit of publication for the If Call for Bids" as advertised was presented. 291 It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the bids be opened and read. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner t1athre, Commissioner Vollmer, Commissioner Stiff, and Mayor MacNab; those voting No, none. Thomas, Dean & Hoskins, Inc. Outlay report and req. Step 2, Partial Payment No.6 - Waste Water Treatment Facility, and Amendment 11 - Engineering and Construction contract The Federal Assistance application for Step 2 Partial Payment Request No.6, Architectural Engineering Services in the amount of $29,300.00, was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Commission approve the Outlay Report and request for reimbursement for construction as prepared. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. Thomas Dean & Hoskins - Amendment No. 11 I Amendment No. 11, to the Engineering Contract between;the City of Bozeman and Thomas, Dean & Hoskins, Inc., was presented. Amendment No. 11 involves the engineering services for Phase I in an amount not to exceed $28,536.00, and Phase II in an amount not to exceed $15,889.00. The total payment to the Engineer for work contemplated under this agreement shall not exceed $231,212.00 for Phase I and $128,788.00 for Phase II, with exception that final payments may be adjusted with OWner's approval, to reflect the actual work accomplished. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission approve Amendment No. 11 to the engineering contract between the City of Bozeman and Thomas, Dean & Hoskins, Inc., and direct the Mayor and Clerk of the Commission to sign Amendment No. 11 to the Engineering Contract on behalf of the City of Bozeman. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none. Grant Application - EPA No. C300208-03, - Thomas, Dean & Hoskins, Inc. - Engineering Services for Wastewater Treatment Facility Upgrade The Federal Assistance Step 2 grant application for EPA No. C300208-03, Engineering services for Wastewater Treatment Facility Upgrade in the amount of $231,212.00 was presented. It was moved by Commissioner Swanson, seconded by Commissioner Vollmer that the Commission approve the application as prepared by the Environmental Protection Agency Region VIII, Helena, MT. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff; and Mayor MacNab; those I voting No, none. Permission for Art Van't Hul and Clinton Gee to attend Rock Mountain Cha ter of American Public Wor s Meeting - Helena, MT - April - 4 The Rocky Mountain Chapter of American Public Works Meeting is scheduled to be held in Helena, MT. April 22-24, and the City Engineer and the Street and Sanitation Superintendent have requested permission to attend this meeting. The estimated cost for 2 people to attend this meeting is $430.00. Permission for Don Stra.ng,w.at.er Department su.perintendent, to attend t.10ntana Section of American I Water Works M~eting, Butte, MT - March 25-27, 1981 The Montana Section of American Water Works meeting is scheduled to be held in Butte, MT, March 25-27, 1981, and the Superintendent of Water Department, Don Strang, has requested permission to attend this meeting. The total cost is estimated to be $196.42. It was moved by COmmissioner Vollmer, seconded by Commissioner Stiff, that the Water Department Superintendent be granted permission to attend the meeting, and it being in the public interest, his expenses be paid out of the appropriate fOhd. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. Commission's sentiments on payment of dues for next year - Montana League of Cities and Towns It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the City of Bozeman continue its memberShip in the amount of $4,329.00 in the Leag"ue of Cities and Towns. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commis- sioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. Gardner-Simmental Plaza - request Quit Claim Deed to vacate Easement A Quit Claim Deed for the purpose of vacating an Easement by and between ~he City of Bozeman and Lentana Corporation was presented by the Interim City Manager. The Quit Claim Deed Easement covers 10' on each side of the common boundary line between Lots 3 and 4 of Tract 7 of Gardner-Simmental Plaza, located in the E~ of Section 35, Township 1 South, Range 5 East, M.P.M. I It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission approve the Quit Claim Deed, and the Mayor and Clerk of the Commission be authorized and directed to sign the Quit Claim Deed. A discussion was held on how the City is going to handle the approval of the building plans since the Building Advisory Committee had waived two provisions of the restrictive covenants, and since one of the restrictive covenants requires approval of the Bozeman City Commission. The Commission decided no action was required since this was a Waiver of the restrictive covenants and not an amendment. Report - Broad Valleys Federation of Libraries The City Manager commented on the report of the Broad Valleys Federation of Libraries and recommended that the City Commission accept the report and it be filed. It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the report of the Broad Valleys Federations be accepted and ordered filed. The motion was carried by the follow- ing Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, and Mayor MacNab; those voting No, none. Claims The general claims and payroll claims were presented. The City Manager had checked the claims and found them to be true and correct and recommended that the Director of Finance be instructed to issue warrants in payment thereto. It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the claims be I approved as presented. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson; and Mayor MacNab; those voting No, none. 293 Application for Raffle License - Gallatin 4-H Jr. Leaders - May 2, 1981 The City Manager presented an application from Gallatin 4-H Jr. Leaders along with the appropriate fee for the purpose of holding a raffle on May 2, 1981. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Commission approve the application for the raffle license. The motion was carried by the following Aye I and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. John Parker - re Bicycle Moto Cross track - Langohr Park John Parker appeared before the Commission to protest the Bicycle Moto Cross course proposed for Langohr Park located south of Mason Street. Following discussion, the Mayor advised Mr. Parker that a public hearing will be held. The Commission instructed the Clerk of the Commission to submit a Notice in the Bozeman Daily Chronicle for the Public Hearing to be held on April 15, 1981. Adjournment With no further business to come before the Commission at this time, it was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the meeting be adjourned.
