In addition, the statement by the staff as to what municipal services could or would be
provided within a five-year period must be submitted and adopted by the Commission, prior to
action on annexation by the Commission.
The hearing was closed, and according to statute action, the annexation cannot occur until
at least twenty days after conclusion of the hearing.
Discussion of Peach Street Paving Proposal I
The City Manager advised the Commission that he had been unable to obtain additional infor-
mation from the owner of Karst Stage. Discussion on the proposal is to be delayed for another
week for the purpose of contacting the owner of the property located on Peach Street.
Cooperative Agreement - Gallatin County Mutual Fire Protective Assistance Contract
The City Attorney investigated the Gallatin County Mutual Fire Protective Agreement thoroughly
and advised the Commission that the Gallatin County Mutual Fire Protective Assistance Contract is
in order. The City Attorney said City firemen could be covered by insurance during any out-of-town
calls, and that damage to equipment would be paid for by the rural districts.
The City Manager said the agreement, signed by 21 fire departments and districts in the County,
would cost nothing to the City for labor during the first year.
The City Attorney explained that the City would only respond to a call from a district chief.
County Civil Defense Director Hank Wruck told the Commission the City would benefit in case
of any large fire in downtown Bozeman.
The City Fire Department will assist in fighting any major fire in the County and will not
withdraw from the scene if the victim failed to pay his dues to the volunteer fire department. The
City will rarely respond to single-building fires, but would be called out to assist in major fires.
Following discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Stiff,
that the City enter into a cooperative agreement with Gallatin County Mutual Fire Protective
Assistance for a period ending August 15, 1982. The motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, I
Commissioner Mathre, and Mayor MacNab; those voting No, none.
Commission Resolution No. 2304 - Affirming the implementation of equal Action Commitment
Commission Resolution No. 2304 affirming the implementation of equal employment opportunity
and affirmative action within the personnel policies of the City was presented, entitled:

AFFIRMING THE IMPLEMENTATION OF EQUAL EMPLOY~1ENT OPPORTUNITY AND AFFIRMA-
TIVE ACTION WITHIN THE PERSONNEL POLICIES OF THE CITY OF BOZEMAN
The commitment provides equal employment opportunity to all persons on the basis of individual
qualifications and merit without regard to race, creed, religion, color, sex, age, national origin,
marital status, family relationships - unless considered to fall within the definition of nepotism,
political affiliation or other non-merit factors, except for bona fide occupational reasons.
It was moved by Commissioner Mathre, seconded by Commissioner Stiff, that the Commission adopt
the resolution. Those voting Aye being Commissioner Mathre, Commissioner Stiff, Commissioner Swanson,
and Mayor MacNab. Commissioner Vollmer moved no.
Request for Waiver of Conditional Use Process - Steve Quayle
The owners of AMC Sullivan Photo requested a waiver of the Conditional Use Permit so that
residence/artist's studio proposed for the front part of the second story can be occupied as proposed.
There are apartments being occupied on the second floor of many business establishments along
Main Street.
After discussion, it was moved by Commissioner Stiff, seconded by Commissioner Swanson, that a I
waiver of the Conditional Use process be approved, and that the fee be waived. The motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner
Swanson, Commissioner Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none.
The Commission directed the staff to begin a review of the Conditional Use process which is
non-controversial, thereby saving the petitioners time and money.

Contract Documents for signature - Northern School Supply - $75,190.50
The Contract Documents for the furnishings for the new Library as prepared by Mattson, Prugh,
and Lenon, were presented. The City Manager recommended that the Contract Documents in the amount
of $75,190.50 as submitted by Northern School Supply of Worden, Montana be approved.
It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Contract Docu-
I ments be approved and the Mayor and Clerk of the Commission be authorized and directed to sign the
contracts for the City of Bozeman, and the Northern School Supply be authorized and directed to
proceed with the furnishing of the new Library. The motion was carried by the following AYe and No
vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson,
Commissioner Mathre, and Mayor MacNab; those voting No, none.
Application for Kennel License - Christine Duntsch
The City Manager presented an application for a kennel license, along with the appropriate fee
for Christine Duntsch, 2530 Maple Drive.
The Animal Control Warden recommended that the application filed by Christine Duntsch be
approved. They have inspected the premises and found the fencing adequate for the dogs enclosed.
It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission
approve the Kennel License application. The motion was carried by the following Aye and No vote:
those voting AYe being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner
Vollmer, and Mayor MacNab; those voting No, none.
Appointment to Zoning Commission - Ron Newville to December 31, 1981
Mayor MacNab announced his appointment of Ron Newville to the Zoning Commission ending Oecember
31, 198!. He replaces Mary Merrick who resigned.
It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission
concur in the Mayor's appointment. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, Commissioner
Stiff, and Mayor MacNab. those voting No, none.
I Call for Bids - Elevator Addition to the Municipal Building
The plans and specifications for the mechanical, electrical, and elevator equipment work for
construction of an elevator addition to the Municipal Building for the City of Bozeman, as prepared
by BGS Architects, 1119 North Seventh Avenue, Bozeman, Montana, were presented.
The City Manager recommended that the plans be approved and the Clerk of the Commission be
authorized and directed to publish a "Call for Bids" for the elevator addition.
It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the plans and
specifications for the elevator addition be approved and the Clerk of the Commission be authorized
and directed to publish a "Call for Bids" for the elevator addition to be opened on Wednesday,
April 1, 1981, at 1:15 o'clock p.m. The motion was carried by the following Aye ,and No vote: those
voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff,
and Mayor MacNab; those voting No, none.
Attend Meetings - Montana Fire Prevention Assoc.-Kalispell, MT. March 11-12, 1981 - L. Lewis
Pump Mechanical Seal & Packing - Billings, March 25-26, 1981 - D. Kirk
The Montana Fire Prevention Association has scheduled a meeting to be held in Kalispell, on
March 11-12, and Lee Lewis requested permission to attend the meeting.
It was moved by Commissioner Mathre, seconded by Commissioner Vollmer that Lee Lewis be granted
permission to attend the meeting, and, it being in the public interest his expenses be paid out of
the appropriate fund. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and
I Mayor MacNab; those voting No, none.
A Pump Mechanical Seal & Packing Seminar has been scheduled to be held in Billings, on March
25-26, 1981. The cost of the Seminar is $65.00 plus $41.00 for hotel room. The Water Superintendent
requested permission for Doug Kirk to attend the Seminar.
It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that Doug Kirk be granted
permission to attend the seminar and, it being in the public interest his expenses be paid out of
the appropriate fund. The motion was carried by the following Aye \and No vote: those voting Aye
being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and tlayor
MacNab; those voting No, none.

Further Discussion Commission Priorities
Commissioner Swanson recommended that the Commission have another retreat to discuss Com-
mission priorities. Mayor MacNab will arrange such a retreat.
Status report - Greenwood Plaza
The City Attorney advised the City Commission that Greenwood Plaza will no doubt be closed
by next week. I
