The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, February 11, 1981 at 1:15 p.m. Present were Mayor MacNab, Commissioner Vollmer, Commis-
sioner Stiff, Commissioner Swanson, Commissioner Mathre, City Manager Gesko, City Attorney Planalp
and the Clerk. I
The Commission meeting was opened with the Pledge of Allegiance and a prayer by Commissioner
Vollmer whereupon the minutes of the regular meeting held on Wednesday, February 4, 1981 were
approved as submitted.
Open bids - One used motor grader for the Street Department
This was the time and place set for opening bids for the purchase of one used motor grader
for the Street Department.
The affidavit of publication for the "Call for Bids" as advertised was presented.
It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the bids be opened
and read. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor
MacNab; those voting No, none.
The following bids were then opened and read:
Jim Gilman, Bozeman, Montana - $35,000.00
Tractor and Equipment, Billings, MT - 20,700.00
The Street Superintendent tabulated the bids and recommended that the bid be awarded to Tractor
and Equipment of Billings on the basis of their bid being the lowest bid and meeting or exceeding
the specifications in the "Call for Bids".
The Commission concurred in the recommendation of the Street Superintendent, also concurred
in by the City Manager, and it was moved by Commissioner Vollmer, seconded by Commissioner Stiff
that the bid be awarded to Tractor and Equipment Company of Billings in the amount of $20,700.00, I
it being the lowest bid and meeting or exceeding the specifications in the "Call for Bids". The
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer,
Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No,
none.
Consideration of Bids - Furnishings for New Municipal Library
The Commission was referred to the opening of bids for the furnishings for the new Municipal
Library.
The Architects completed the tabulation and thoroughly analyzed all bids submitted and the
recommendations were reviewed by the Library Building Committee on Tuesday morning.
The Library Building Committee concurred in the recommendation of the architects as follows:

The Architect advised the Commission that in one case the lowest bid did not meet the plans
and specifications in the Call for Bids, therefore, it was not recommended. He further advised
the Commission that the bids were considerably lower than they had anticipated.
It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission
accept the above bids for the furnishing for the New Municipal Library. The motion was carried
I by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson,
Commissioner Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none.
Mutual Release - City of Bozeman and Concrete Specialities - for signature
It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission
approve the Mutual Release between the City of Bozeman and Concrete Specialties which is intended
to effect the extinguishment of obligations as designated in the release. The motion was carried
by the fOllowing Aye and No vote: Those voting Aye being Commissioner Swanson, Commissioner Mathre,
Commissioner Vollmer, Commissioner Stiff, and Mayor MacNab; those voting No, none.
Continued public hearing - Planning staff - Zone Code Amendment Chapter 18.21 provide flexibility
to desi n future lots around cul-de-sacs, terrain features and ro ert sha e. Minimum 7,500 s .ft.
lot s all be included to insure unlformlty of lot sizes based upon the R-2 district.
This was the time and place set for the continued pu~ic hearing of the City/County Planning
Staff for a Zone Code Amendment Chapter 18.2I.
The Planning Director advised the Commission, that if adopted the proposed amendment would
provide for future city-sized lots in subdivisions featuring initial lots of less than three acres
in size.
The Planning Director advised the Commission that the City Zoning Commission has recommended
approval of this Code Amendment and a public notice has been advertised for the City Commission's
review. He further advised the Commission that the City Attorney has advised that this procedure
be followed since considerable time has lapsed between the Zoning Commission's action and the review
by the City Commission this month.
I Following an extensive discussion, it was suggested that the hearing be continued for another
week to allow the Commission to again review the proposed amendment.
Public hearing - Commission Resolution No. 2299 - SID No. 615 - Burrup Annexation
This was the time and place set in Commission Resolution No. 2299 to hear protests to the
creation of Special Improvement District No. 615, Sanitary Sewer Construction in the Burrup Annexa-
tion. Affidavit of publication of Notice and the Clerk's mailing certificate, stating all property
owners had been notified as required by law, was presented. No one appeared to protest and there
were no written protests on file.
Several property owners in that area were present in support of the Special Improvement District.
The public hearing was closed and it was moved by Commissioner Mathre, seconded by Commissioner
Vollmer, that the Commission waive the one week waiting period. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Mathre. Commissioner Vollmer, Com-
missliloner Stiff, Commissioner Swanson, and Mayor MacNab; those voting No, none.
It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the City Attorney
be instructed to draw up a resolution creating the district. The motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner
Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none.
Decision - Zone Code Amendment - Southwest Montana Homebuilders Association modifications in Town-
house Development Standards and Curb Cuts
The request for a Zone Code Amendment by Southwest Montana Homebuilders Association having
I been delayed for a period of one week was presented for a decision.
The applicant seeks several changes to Chapter 18.76 - Townhouse Development Standards and
Overlay District. In addition, a code amendment is requested for Chapter 18.69 - Supplementary
Regulations, specifically Section 18.69.180 Curb Cuts.
It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission
approve the Zone Code Amendments. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer,
and Mayor MacNab; those voting No, none.

Decision - Zone Map Change - Maurice Klabunde - R-4-T to B-2
Maurice Klabunde's request for a Zone Map Change having been delayed for a period of one
week for a decision, was presented.
The applicant wished to change a portion of the SE~, SE~, Section 11, T2S, R5E, M.P.M.,
Gallatin County, Montana from R-4-T to B-2. The property in question is located approximately
300 yards south of University Plaza Shopping Center and east of and adjacent to South 23rd I
Avenue.
The Building Inspector checked the property owners and found that out of the twenty possible
signatures, twelve property owners had signed the petition protesting the Zone Map Change.
The City Manager said that those protesting constitute more than twenty percent of abutting
land, and consequently it will take a four to one vote to approve the Zone Map Change.
The City Manager advised the Commission that the Planning Board and the Zoning Commission both
recommended denial of the Master Plan Amendment and the Zone ~1ap Change and he concurred in their
recommendation.
It was moved by Commissioner Mathre, seconded by Commissioner Stiff, that the Commission
deny the Zone flap Change from R-4-T to B-2. Those voting Aye being Commissioner Mathre, Commissioner
Stiff, and Mayor MacNab; those voting No being Commissioner Vollmer and Commissioner Swanson. The
Zone Map Change was denied.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission
approve the Zone Map Change from R-4-T to B-2-T. The motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Vollmer, Commissioner Swanson, and Mayor MacNab;
those voting No being Commissioner Mathre, and Commissioner Stiff. The motion failed.
Maurice Klabunde - amendment to Bozeman Area Master Plan
The Commission delayed action on the request of Maurice Klabunde - amendment to the Bozeman
Area Master Plan for a period of one week.
The amendment would change the land use classification from "~1edium Density-Residential" to I
"Highway Commercial" on property described as the SE~, SE~ of Section 11, T2S, R5E, M.P.M., Gallatin
County, Montana.
The City Manager advised the Commission that the City/County Planning Board recommended
denial of the request, and he concurred in their recommendation.
It was moved by Commissioner Swanson, seconded by Commissioner Vollmer, that the Commission
approve the amendment to the Bozeman Area Master Plan requested by t1aurice Klabunde. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson,
Commissioner Vollmer, and Mayor MacNab; those voting No being Commissioner Mathre and Commissioner
Stiff.
Decision - Zone Map Change - D. V. Norris - 1013 West Babcock - B-2-T to B-2.
The request of D. V. Norris for a Zone ~1ap Change from B-2-T to B-2 having been delayed for
a week for a decision, was brought before the Commission.
It was moved by Commissioner Mathre, seconded by Commissioner Stiff, that the Commission deny
the Zone Map Change from B-2-T to B-2 requested by Mr. Norris. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner nathre, Commissioner Stiff, and
Mayor MacNab; those voting No being Commissioner Vollmer, and Commissioner Swanson.
Decision - Zone Code Amendment - Planning staff - modifications of Townhouse Development Standards
Chapter 18
The request from the Planning Staff for a Zone Code Amendment having been delayed for a period
of one week was presented for a decision. I
Following a short discussion, it was moved by Commissioner Vollmer, seconded by Commissioner
Stiff, that the Commission approve the Zone Code Amendment - Chapter 18.69.180, 18.76.010, 18.76.070,
18.76.100, 18.76.150, 18.76.160, 18.84.040, and 18.84.050 pertaining to Curb cuts, Open Space,
Landscaping, Plat filing and Parking. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner
Mathre, and Mayor MacNab; those voting No, none.

Discussion - Commission priorities
Commissioner Mathre asked the Commission if they had listed some of their priorities to
assist the City inthefuture.
Commissioner Vollmer felt the priorities should be set by the Departments.
Commissioner Stiff, Commissioner Swanson, Commissioner Mathre and Mayor MacNab made a number
I of suggestions, such as authority, responsibility, and accountability, audit followup, update
master plan, housing for the disabled, energy conservation, establish reserves for hiring, water
rates adequate planning and establishment of roads and streets, public telephone survey, etc.
Following discussion, the Mayor felt the Commission had made some headway and suggested
that the Commission discuss the priorities again in two weeks - February 25, 1981.
Proposals related to alternative activities for HUD funds - Small Cities Grant
Options for unused housing rehabilitation grant funds in the approximate amount of $275,000.00
was presented.
The Planning Director spoke briefly on the five options as set forth in full:
1- Offer grants to all applicants
2. Construction of a new or rehabilitation of an existing structure near
the proposed Section 8 (Greenwood Plaza) complex to be used as a day care center.
3. The acquisition and rehabilitation of structures later sold to low and moderate
income persons. The transfer to such individuals could be at or below market
value.
4. Acquisition of a large home to be used for a shelter for the developmentally
disabled, battered spouses or the handicapped.
5. Acquisition of a large home or apartment house to rehabilitate and resell
to low and moderate income persons on a condominium basis.
The Planning Director advised the Commission that time is of great importance.
I Mayor MacNab suggested that maybe it would be advisable to return the unused portion of the
grant received in 1979.
It was suggested that the proposals be brought back for some ideas on Wednesday, February 18, 1981.
Authorization to purchase 5,000 ft. 3/4" Type K Copper Tubing
The Water Department has need for 5,000 feet of 3/4" Type K Copper Tubing, and the City Manager
requested authorization to purchase the tubing.
It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the City ~1anager
be granted authorization to purchase the copper tubing. The motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner
Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none.
Application for Raffle License - Bozeman Tackwondo Association - April 15, 1981
Future Secretaries of America - March 13, 1981
The City Manager presented an application from Bozeman Tackwondo Association along with the
required fee for the purpose of holding a raffle on April 15, 1981.
It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission
approve the application for the raffle license for Bozeman Tackwondo Association. The motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner
Mathre, Commissioner Vollmer, Commissioner Stiff, and Mayor MacNab; those voting No, none.
The City Manager presented an application from the Future Secretaries of America along with
the required fee for the purpose of holding a raffle on March 13, 1981.
It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the Commission
I approve the application for the raffle license for the Future Secretaries of America. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Mathre,
Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab; those voting No, none.
Claims
The claims were presented. The City Manager had checked the claims and found them to be true
and correct and recommended that the Director of Finance be instructed to issue warrants in payment
thereof.

It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the Commission
approve all of the claims with the exception of the claim to Medical Pharmacy for Rolaids. The
City Manager will check on this claim. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, Commijssioner
Swanson, and Mayor MacNab; those voting No, none.

The report of the Broad Valleys Federation, Building Inspector, and the Police Department were
presented for acknowledgement and filing on Wednesday, February 18, 1981.
Absence of Commissioner Vollmer on February 25, 1981
It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the absence of
Commissioner Vollmer from the meeting of February 25, 1981 be authorized. The motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson,
Commissioner Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none.
Adjournment
With no further business to come before the Commission at this time, it was moved by
Commissioner Swanson, seconded by Commissioner Mathre, that the meeting be adjourned. The motion
