HomeMy WebLinkAbout1980-11-26 200 Bozeman, Montana November 26, 1980 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, November 26, 1980, at 1:15 olclock p.m. Present were Mayor MacNab, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, City Manager Gesko, Acting I City Attorney Johnston, and the Clerk. Commissioner Stiff opened the meeting with a prayer whereupon the minutes of the regular meeting held on Wednesday, November 19, 1980 were approved as submitted. Consideration of bids - Drilling domestic water well - Bogert Park The City staff reviewed the two bids for the drilling, casing, and screening of a 100 foot well at Bogert Park located on South Church Avenue, to be used for ice control in Bozeman Creek. The bid submitted by Van Dyken Drilling Company in the amount of $5,001.00 was the low bid and met or exceeded the specifications in the "Call for Bids". The Commission concurred in the recommendation of the City staff, and it was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the City accept the bid of Van Dyken Drilling Company in the amount of $5,001.00 as submitted. The motion was carried by the following Aye and No votes: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. Decision - Resolution 2262 - SID 626 - Sanitary Sewer - Stratford, W. Main Annexation The decision on Commission Resolution No. 2262, SID No. 626, Sanitary Sewer Lateral construction on the north boundary of Stratford, West Main and Town Pump annexation having been delayed for a week was brought before the Commission for a decision. The Commission concurred with the recommendation of the City Manager, and it was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission approve the I creation of Special Improvement District No. 626, and instruct the City Attorney to draft a resolution creating the district, to be brought in for action on December 10, 1980. The motion was carried by the following Aye and No votes: those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Stiff, and Mayor MacNab; those voting No, none. Decision - Resolution 2263 - SID 627 - Sanitary Sewer - Triangle Area Annexation The decision on Commission Resolution No. 2263, SID No. 627, Sanitary Sewer Lateral Construction in Lot 1, Triangle Area Annexation having been delayed for a week was brought before the Commission for a decision. The Commission concurred with the recommendation of the City Manager, and it was moved by Commissioner Mathre, seconded by Commissioner Stiff, that the Commission approve the creation of Special Improvement District No. 627, and instruct the City Attorney to draft a resolution creating the district, to be brought in for action on December 10, 1980. Decision - Resolution 2264 - SID 628 - Water Main, Sanitary Sewer, Storm Drain, and Pavinq - Block 9, Figgins Addition - First Phase The decision on Commission Resolution No. 2264, SID No. 628, Water Main, Sanitary Sewer, , Storm Drain, and Paving construction on Fryslie Street in the Figgins Addition First Phase, having been delayed for a week was brought before the Commission for a decision. The Commission concurred with the recommendation of the City Manager, and it was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission approve the I creation of Special Improvement District No. 628, and instruct the City Attorney to draft a resolution creating the district, to be brought in for action on December 10, 1980. The Commission concurred with the recommendation of the City Manager, and it was moved by Commissioner Mathre, seconded by Commissioner Stiff, that the Commission approve the creation of Special Improvement District No. 630, and instruct the City Attorney to draft a resolution creating the district, to be brought in for action on December 10, 1980. Affidavit of publication of Notice was presented. No one appeared to protest verbally, and there were no written protests on file. 203~ The Mayor declared the hearing closed, and it was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission waive the one week waiting period, and that Commission Resolution No. 2259, provisionally passed and adopted on Wednesday, November 19, 1980 be finally passed and adopted, levied and assessed. Public hearing - Commission Resolution 2260 - levy and assess Street Sweeping for final passage This was the time and place set for public hearing on levying the final assessment for street sweeping for the year 1980 in the total amount of $30,114.12. Affidavit of publication of Notice was presented. No one appeared to protest verbally, and there were no written pro- tests on file. The Mayor declared the hearing closed, and it was moved by Commissioner Mathre, seconded by Commissioner Stiff, that the Commission waive the one week waiting period, and that Commission Resolution No. 2260, provisionally passed and adopted on Wednesday, November 19, 1980 be finally passed and adopted, levied and assessed. Public hearing - Commission Resolution 2261 - levy and assess Solid Waste Collection and Landfill This was the time and place set for public hearing on levying the final assessment on the Solid Waste Collection and Landfill in the total amount of $282,822.82. Affidavit of publication of Notice was presented. No one appeared to protest verbally, and there were no written pro- tests on file. The Mayor declared the hearing closed, and it was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission waive the one week waiting period, and that Commission Resolution 2261, provisionally passed and adopted on Wednesday, November 19, 1980 I be finally passed and adopted, levied and assessed. Commission Resolution No. 2273 - Energy Conservation Policy for City The proposed resolution adopting an energy conservation policy for the City of Bozeman was discussed. The City Manager advised the Commission that he had discussed the resolution dealing with the energy policy with the staff. It was suggested that the proposed resolution be taken to the National Convention to see what information was presented regarding energy. Following an extensive discussion, it was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission adopt Commission Resolution No. 2273 down to and including Section I, and that Section 2 through Section 8 be provisionally passed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Stiff, and Mayor MacNab; those voting No, none. Waddell Construction - permission to move siqn from roof of first buildinq to present location at 1623 North Rouse Avenue A letter received from Waddell Construction Company, requesting permission to move their sign from the roof of the first building to its present location which is on their property located at 1623 North Rouse Avenue was presented. I It was moved by Commissioner Mathre, seconded by Commissioner Stiff, that permiSSion be granted to move the sign. Bozeman Public Library - Martel Construction - Change Order No.1 Change Order No.1 for the Bozeman Public Library, to become a part of the original con- tract for construction was presented as follows: The Original contract sum $ 990,900.00 The Increase 31,948.00 New Contract Sum including Change Order $1,022.848.00 -2U4 The City Manager concurred in the recommendation of Architects/Planner Mattson, Prugh & Lenon and recommended that Change Order No. 1 be accepted as presented. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that Change Order No. 1 be accepted, and the Mayor and Clerk of the Commission be authorized and directed to sign for the City. Application for Beer & Wine License - Me & Janis II, 621 West Main Street The City Manager presented an application for a beer and wine license along with the appropriate fee from Me & JanIs II, 621 West Main Street. The Police Department said they could see no problem with the issuance of a license to Me &_Jan1s II. It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission approve the beer and wine license application. Claims The claims and payroll claims were presented. The City Manager had checked the claims and found them to be true and correct claims and recommended that the Director of Finance be instructed to issue warrants in payment thereof. It was moved by Commissioner Mathre, seconded by Commissioner Stiff, that the claims be approved as presented. Report - Broad Valleys Federation of Libraries The report of the Broad Valleys Federation of Libraries was presented for comment on I Wednesday, December 10, 1980. Report - Dental Insurance policy proposal - coverage for City John Evans met with the Dental Insurance Committee comprised of members of the Local Life Underwriters Association and Dr. Wayne Thompson and recommended that the City of Bozeman accept the M.P.S. Plan as set forth in full: Monthly Max. Ben. Pros- Perio Company Premium Deductable per year Basic thetics% dontics% M.P.S. $17.04 $25.00 per yr. Sign Code Variance - Rising Sun Leather Co. - 307 East Main Street A letter received from Rising Sun Leather Company requesting a variance to the sign code to erect a 201 in width by 22" in height sign at 307 East Main Street. The sign will be oak and cedar and will be attached to a steel beam on the exterior of the store located at 307 East Main Street. It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission I approve the sign code variance as presented. Change Order No. 1 - SID 599 - paving and storm drain - Bomont Center Change Order No.1 on SID No. 599 as prepared by Thomas, Dean, and Hoskins, Inc., to become a part of the original contract for construction of improvements in the project 2'05 described were presented as follows: Description: Soil sterilization of the area which underlies all the asphalt streets in SID 599. Purpose: To kill existing plant roots which might grow through the new aspha 1 t street. I Cost: Total cost for labor, equipment rentals & chemicals = $1, 727.40 It was moved by Commissioner Mathre, seconded by Commissioner Stiff, that Change Order 1 on SID No. 599 be accepted and the Mayor and Clerk of the Commission be authorized and directed to sign for the City. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Mathre, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab; those voting No, none. Repurchase Agreement: A short discussion was held on the repurchase agreement. Commissioner Stiff said he had discussed it with the County Auditor. Mr. Mosby said the County would be ready to go with the repurchase agreement by December 1, 1980 and they would keep the City posted as to what is going on. Retreat - to be continued by Commission It was moved by Commissioner Stiff, seconded by Commissioner Mathre, that this yearls retreat be scheduled around the technicals sessions held in Atlanta, and that the retreat be tentatively scheduled for Tuesday, December 16, 1980. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab: those voting No, none.
