The Commission of the City of Bozeman met in regular session in the Commission Room,
Municipal Building, October 29, 1980 at 1:15 o'clock p.m. Present were Mayor MacNab,
Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, City
Manager Gesko, City Attorney Planalp, and the Clerk. I
Commissioner Mathre opened the meeting with a prayer whereupon the minutes of the
regular meeting held on Wednesday, October 22, 1980 were approved as submitted.
Open bids - Landscaping and sprinkling equipment -Parking Lots
This was the place set for opening of bids for the landscaping and sprinkling equipment
for the parking lots on the corner of Tracy Avenue and Mendenhall Street and Black Avenue
and Mendenhall Street.
The affidavit of publication of the "Call for Bids" as advertised was presented.
It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the bids
be opened and read. The motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner
Mathre, and Mayor MacNab; those voting No, none.
The following bids were then opened and read:

Accept bid on bonds for SID 621, 622, 623, 624, 625 - Valley Unit Subdivision I
Because of lower than expected construction bids, Attorney Sabol, representing Virgil
and Phyllis Jahnke of the Valley Unit Subdivision, recommended that the total bonds sold
be reduced from $4,525,000.00 to $3,765,000.00.
Following discussion, it was moved by Commissioner Swanson, seconded by Commissioner
Mathre, that the sale of the bonds for Special Improvement District No. 621 in the amount
of $525,000.00 be awarded to D. A. Davidson & Company of Great Falls at 10.25% contingent
upon:
- receiving a resolution changing the amount of bonds sold from $540,000.00
to $525,000.00
- signing of Improvement Agreement by developer, so that Final Plat may be signed
The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer~ommissioner Stiff, and

It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the sale
of the bonds for Special Improvement District No. 622 in the amount of $315,000.00 be
awarded to D. A. Davidson & Company of Great Falls at 10.25% contingent upon:
- signing of Improvement Agreement by developer, so that Final Plat may be signed.
The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and
Mayor MacNab; those voting No, none.
It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the sale
of the bonds for Special Improvement District No. 623 in the amount of $525,000.00 be 1
awarded to D. A. Davidson & Company of Great Falls at 10.25% contingent upon:
- receiving a resolution changing the amount of bonds sold from $600,000.00
to $525,000.00
- signing of Improvement Agreement by developer, so that Final Plat may be signed.

It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the sale
of the bonds for Special Improvement District No. 624 in the amount of $550,000.00 be
awarded to D. A. Davidson & Company of Great Falls at 10.25% contingent upon:
- receiving a resolution changing the amount of bonds sold from $610,000.00
to $550,000.00

It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the sale
of the bonds for Special Improvement District No. 625 in the amount of $1,850,000.00 be
awarded to D. A. Davidson & Company of Great Falls at 10.25% contingent upon:
- receiving a resolution changing the amount of bonds sold from $2,460,000.00
to $1,850,000.00
- signing of Improvement Agreement by developer, so that Final Plat may be signed.
The motion was carried by the following Aye and No vote: those voting Aye being

Award construction bids - SID Nos. 621, 622, 623, 624, and 625 -
The Consulting Engineer of Thomas, Dean, & Hoskins, Inc., reviewed the bids submitted
on Special Improvement District Nos. 621, 622, 623, 624, and 625 and found them generally
correct in extension and addition.
The low bid in SID No. 622 had a minor discrepancy which amounted to a reduction of
$3.50. Special Improvement District No. 622, based on the low bid submitted, exceeds the
funds allowable within the district.
Attorney Sabol advised the Commission that his clients, Virgil and Phyllis Jahnke of
1 Valley Unit Subdivision authorized him to commit to the City of Bozeman and to D. A.
Davidson & Co., that they will tender to the City of Bozeman on January 2, 1981 a Certificate
of Deposit purchased from a recognized lending institution in the City of Bozeman in the
amount of $21,024.00 which Certificate of Deposit will be purchased in the name of the City
of Bozeman and/or Virgil and Phyllis Jahnke. The Certificate of Deposit will be held by
the City of Bozeman and, used by the City of Bozeman, in the event the funds evident by the
Certificate are needed and required to pay the cost of construction and administration of
Special Improvement District No. 622.
Based on the above, the consulting engineer recommended that the awards be made to the
following contractors.
S.I.D. 621 - $441,867.00, Jim Gilman Excavating of Butte, Montana
S.I.D. 622 - $287,327.20, Hoven-Clause of Laurel, Montana
S.I.D. 623 - $433,628.33, based on deduct as per bid proposal by Johnston
Excavating of Bozeman, Montana
S.I.D. 624 - $459,020.92, based on deduct as per bid proposal by Johnston
Excavating of Bozeman, Montana
S.I.D. 625 - $412,566.20, Schedule I, Long Construction of Billings, Montana
$1,099,944.00, Schedule II, Long Construction of Billings, Montana
It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that Jim Gilman
of Butte, Montana be awarded the bid for the construction of SID 621 Sanitary Sewer Trunk
in the amount of $441,867.00 with the same provisions as stated in the sale of the bonds.
The motion was carried by the following Aye and No vote: those voting Aye being Commissioner

voting No, none.

the amount of $287,327.20 with the same provisions as stated in the sale of the bonds. The

It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that Johnston
Excavating of Bozeman, Montana be awarded the bid for the construction of SID No. 623 -
Sanitary Sewer in the amount of $433,628.33 with the same provisions as stated in the sale
of the bonds. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer,
and Mayor MacNab; those voting No, none. 1

Excavating of Bozeman, Montana be awarded the bid for the construction of SID No. 624 -
Water Mains in the amount of $459,020.92 with the same provisions as stated in the sale of
the bonds. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff,
and Mayor MacNab; those voting No, none.

Proposed resolution - establishing policy for acquisition of water rights
The proposed resolution establishing policy for acquisition of water rights upon
conversion of land use was again presented for discussion.
Bill Asher, representing the Agricultural Preservation Association was present in
regard to the proposed resolution. Several other area ranchers were present. State
Senator Paul Boylan advised the Commission that he felt the resolution establishing
policy for acquisition of water rights needs a lot of study. He told the City to do it
cautiously and legally.
Vernon Westlake, water rights chairman, also expressed concern that the City had not
fully studied the proposal. Mr. Westlake said the State would have the final say on the
water rights purchase. He added that most water rights are owned by incorporated ditch
companies.
The City Manager said he was aware of the process of converting water use. The City
Manager said that if the City was denied purchase by water users associations or the State, I
the City could decide not to annex property associated with the water rights.
The proposed resolution will be delayed for a periOd of one week for review by the
legal department. A copy of the resolution will be mailed to several members of the
Agricultural Preservation Association and area ranches.
United Parcel Service - request for sewer service on North 19th
The request from United Parcel Service for sewer service on North 19th Avenue was
again brought before the Commission.
A letter dated October 23, 1980 from the Water Quality Bureau of the Montana Depart-
ment of Health and Environmental Sciences, addressed to Thomas, Dean and Hoskins, Inc.,
regarding the UPS proposal adjacent to the Simmental Building was discussed. The Water
Quality Bureau said there are two choices for disposal of the waste generated by the UPS:
1) discharge to the city wastewater system or
2) discharge to an on-site wastewater treatment system
The Water Quality Bureau said that since the City of Bozeman has indicated they are
against the connection of the truck washing facility to their system, the only option is
an on-site facility. Such a facility would be acceptable as long as adequate pretreat-
ment were provided and all State design criteria are met.
The City Engineer also proposed that the truck waShing facility be allowed to discharge
directly, the same as a storm water system. The Water Quality Bureau indicated that this
would not be allowed unless UPS applied for and received a discharge permit. Such permit I
would have to meet the State's non-degradation pOlicy.
Mr. Job, the representative from UPS presented new material showing the exact oil
interceptor to be installed in their new facility. The plan submitted was drawn by
Donald E. Fry & Associates, Inc., of Omaha, Nebraska, and was dated October 27, 1980. This
showed a much more refined and sophisticated manhole/oil interceptor than was depicted last
week. The City Engineer was much more impressed with the potential efficiency of this unit
than the unit displayed one week earlier.

After initial discussion, Mr. Job and the City Engineer left the Commission chamber to
pursue the matter in greater detail in the engineer's office. They returned approximately
one hour later and the engineer reported substantial success after reviewing the proposal
with Mr. Job.
Following discussion, it was moved by Commissioner Swanson, seconded by Commissioner
1 Mathre, that the proposed installation submitted by Donald E. Fry & Associates, dated
October 27, 1980, be approved with the understanding that the City could inspect the instal-
lation at virtually anytime. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, Commissioner
Stiff, and Mayor MacNab; those voting No, none.
Discussion - revised procedure for notification of abutting property owners for public
hearing
Following the discussion several weeks regarding obtaining the list of property owners
or other parties of interest required to receive notice of Public Hearing for Zoning Changes,
Conditional Use Permits, and Board of Adjustment - Gallatin Title offered to provide the
City with a list of names and addresses of all parties of interest relating to any public
hearing as required by the Zone Codes. The offer is made free of charge to the City of
Bozeman as a public service.
It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commis-
sion accept with gratitude the offer of Gallatin Title Company and put it in to force with
the Building Inspector's supervision to include equitable ownership all the way through.

The acknowledgement of the City Commission clears up the question of whether the City
should notify only owners of record or whether or not the City should include other parties
1 of interest owning a given piece of land.
Discussion - Repurchase Agreement
Commissioner Stiff gave a status report on the Repurchase Agreement.
The Commission acknowledged presentation of the report. The specifications should be
ready by November 5, 1980.
Plans & specifications - drill well at Bogart Park - open bids November 19, 1980
Plans and specifications for the drilling, casing, and screening of a 100 foot well to
be located at Bogart Park, was presented.
It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission
approve the plans and specifications as presented, and the Clerk of the Commission be authorized
and directed to issue a "Call for Bids" for the drilling, casing, and screening of a 100 foot
well to be located at Bogart Park, with an opening date of November 19, 1980. The motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Swanson,
Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, and Mayor MacNab; those voting

Novak-Po iel - re uest for S ecial Exce tion - ermission to our slab for 50' x 175' utilit
uilding at Herltage Homes
Novak-Popiel requested a Special Exception for permission to pour a slab for a 50' x 175'
utility building at Heritage Homes thus taking advantage of the good weather. Novak-Popiel
will file their application for a Conditional Use Permit immediately.

approve the request for permission to pour a 50' x 175' slab for a utility building and Novak-
Popiel be requested to begin the procedure to apply for a Conditional Use Permit. The motion

Maurice Klabunde requested a Special Exception for permission to pour a slab for the con-
struction of a Recreation Building south of University Square Subdivision. The Commission
requested Maurice Klabunde to file his application for a Conditional Use Permit immediately. 1
It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the
Commission concur in the recommendation of the City Manager and approve the Special Excep-
tion for permission to pour a slab for the construction of a Recreation Building south of
University Square Subdivision and that Maurice Klabunde proceed to file his application
for a Conditional Use Permit. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson,
Commissioner Mathre, and Mayor MacNab; those voting No, none.
If the Conditional Use Permit is denied, Mr. Klabunde will not be able to build any-
thing on the slab.
Request for transfer of Sani ta ry Sewer toCi ty, together with easements for same
The City Attorney informed the Commission that according to the City Engineer, the
City was ready to receive four of the Daum Easements for the Sewer System to service the
Main Mall and adjacent properties. The fifth easement from Gene Cook, et al will not be
received by the City until further covenants are received from Mr. Daum and Cook, et al.
It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the four
easements be accepted by the Commission and the fifth easement from Cook, et al be deferred
until further action is taken by the property owners. The motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner
Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none.
Certificate of Completion - SID 616 - Koch Street, 20th to 23rd, SID 619 - Lea Avenue, and I
SID 620 - Blackmore Place cul-de-sac
The certificate of the engineers of Thomas, Dean & Hoskins, Inc., notifying the City
that construction of SID 616, street paving and Storm Drainage on Koch Street - 20th to
23rd Avenue by Long Construction, Inc., has been completed in accordance with plans and
specifications, was presented.
This final acceptance does not relieve the contractor of responsibility of negligence
or faulty materials or workmanship within the standard period provided for by law. The
contractor has furnished a performance bond equal to contract bid to guarantee materials
and workmanship for a one year period to commence upon final acceptance.
It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that as recom-
mended the project be accepted as completed, and the motion was carried by the following

sewer, water, paving and storm drainage in the University Square Subdivision, was presented.
It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Com-
mission acknowledge receipt of the petition and instruct the staff to prepare the proper
resolutions to create the districts. The motion was carried by the following Aye and No

The City Manager presented an application for a raffle license along with the appropriate
fee from Bozeman Weavers Guild, for a raffle to be held on November 15, 1980.

The claims for the month of October were presented. The City Manager had checked the
claims and found them to be true and correct and recommended that the Director of Finance be

The City Manager commented on the report of the Broad Valleys Federation of Libraries
