HomeMy WebLinkAbout1980-10-15 '144 Bozeman, Montana October 15, 1980 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, October 15, 1980 at 1:15 o'clock p.m. Present were Mayor MacNab, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, I City Manager Gesko, City Attorney Planalp, and the Clerk. Commissioner Vollmer opened the meeting with a prayer whereupon the minutes of the regular meeting held on Wednesday, October 1, 1980, and Wednesday, October 8, 1980 were approved as submitted. Montana Associate Planners Meeting - Great Falls, 15-16 October, 1980 - P. Bolton The Montana Associate Planners have scheduled a meeting to be held in Great Falls the 15-16 October, and the Planning Director requested permisSion to attend the meeting. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Planning Director be authorized to attend the meeting and, it being in the public interest his ex- penses be paid out of the appropriate fund. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. Proposed resolution - establishing pOlicy for acquisition of water rights upon conversion of land use The letter addressed to the City Commission from the Agricultural Preservation Associ- ation in regard to the proposed resolution of the City Commission for the purpose of estab- lishing a pOlicy for acquisition of water rights for owners of real property who desire to divide their real property was discussed. It was suggested that the proposed resolution be deferred for a period of one week for additional study. 1 Expansion of Housing Rehabilitation program to allow tenant occupied structures The matter of expanding the Housing Rehabilitation Loan/Grant Program to include tenant-occupied structures was deferred for a week for further research by the Planning staff. Commissioner Swanson suggested that the guidelines be revised without limitation of proportionment to different sectors of the City. Following considerable discussion, the Commission suggested that the Planning Director secure approval from the federal government to expand the income guidelines for the housing rehabilitation program. City/County Planning Board budget The City/County Planning Board Budget for the fiscal year ending June 30, 1981 and the proposed budget to accomplish the revision of the Master Plan was presented. The Commission recognized the $20,300.00 as a separate item for the Master Plan effort. The total fiscal year 1981 City/County Planning Board budget would be $91,962.00. The Commission further recognized a possible or likely budget figure for the master plan effort for the year 1981-1982 in the amount of $31,700.00. Following discussion, it was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the Commission approve the $91,962.00 budget for the City/County Planning Board, including the $20,300.00 for the revision of the Bozeman Area Master Plan. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner 1 Mathre, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab; those voting No, none. Change Order No. 1 - SID No. 619 - Lea Avenue Water Main Improvement Change Order No.1, as prepared by Thomas, Dean & Hoskins, Inc., to become a part of SID No. 619 - Lea Avenue Water Main construction, was presented as follows: Description: Extend 7 water services @ $59.16 = $ 414.12 1 water service @ 76.90 = 76.90 274 S.Y. gravel street @ 3.00 = 822.00 Total increase $1,312.02 145 It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Commission approve the Change Order as presented. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. 1 Contract documents for signature - Potts Drilling - monitoring wells at landfill The Contract documents for drilling two monitoring wells, 200 foot and 50-foot deep and for installation of prescribed casing and appurtenances at the prices bid on the proposal form all to the satisfaction and under the general supervision of the Engineer, was presented. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission approve the Contract documents, and the Mayor and Clerk of the Commission be authorized and directed to sign the contract for the City of Bozeman, and that Potts Drilling be authorized and directed to proceed with the drilling. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none. Petition - Marwyn Addition residents requesting City refuse collection service The City Manager presented a petition signed by fortY-Six property owners, petitioning the City of Bozeman to provide refuse collection service in the Marwyn Addition. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Commission acknowledge receipt of the petition and refer it to the staff for review and a recommendation. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. Application for Kennel License - Charles Pinkava, 1212~ South Willson Avenue The City Manager presented an application for a kennel license, along with the appropriate 1 fee for Charles Pinkava, 1212~ South Willson Avenue. The Animal Control Wardens recommended denial on the basis of a complaint from the next door neighbor, lack of cooperation from the Pinkava's and apparent unwillingness to show health information on the dogs and to arrange a time to inspect the premises provided for the three dogs. The Commission concurred in the recommendation of the Animal Control offices, also concurred in by the City Manager, and it was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the kennel license be denied and that the extra dog be removed or destroyed within two weeKs. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none. Claims The claims for the month of September were presented. The City Manager had checked the claims and found them to be true and correct and recommended that the Director of Finance be instructed to issue warrants in payment thereof. It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the claims be approved. The motion was carried by the fOllowing Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, and Mayor MacNab; those voting No, none. File report of Building Inspector for September 1 The City Manager commented on the report of the Building Inspector and recommended it be accepted and ordered filed. It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the report of the Building Inspector be accepted and ordered filed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab; those voting No, none. 146 Discussion - priority list - personnel for City A short discussion was held on the priority list of personnel for the City. Following discussion, the Commission directed the City Manager to submit a list of priorities for adding or calling back City personnel. Commissioner Mathre - Report on Energy Workshop Commissioner Mathre gave a short report on the Energy Workshop which she and the 1 Building Jnspector attended on Friday and Saturday, October 10 and 11th. She said she found the workshop very beneficial. Report by Commissioner Stiff - Audit Committee meeting Commissioner Stiff gave a short report of the meeting of the Audit Committee and the Auditors for Cooper & Lybrand. Report - Quarterly report of Fire Department The quarterly report of the Fire Department was presented for comment on Wednesday, October 22, 1980. Adjournment With no further business to come before the Commission at this time, it was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the meeting be adjourned.
