The Commission of the City of Bozeman met in regular session in the Commission Room,
Municipal Building, October 8, 1980 at 1:15 o'clock p.m. Present were Mayor MacNab,
1 Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, City
Manager Gesko, City Attorney Planalp, and the Clerk.
Commissioner Mathre opened the meeting with a prayer.
Consideration of bids - Drilling 200-foot monitoring well
Dri 11 i ng 60-foot monitoring well
In reviewing the well drilling bids, the bids on the 200-foot well were within $30.00
of each other. On the 60-foot test well, the items for developing the well were not bid by
VanDyken Drilling as a result of discussions in the office indicating that the 60-foot
well probably woul d not be developed. Potts Drilling bid $5,695.00 on the 200-foot well, and
$1,835.00 on the drilling of the 60-foot test well, and VanDyken Drilling Co. bid $7,620.20
on the 200-foot well.
The Commission concurred in the recommendation of the City Engineer, also concurred in
by the City Manager, and it was moved by Commissioner Vollmer, seconded by Commissioner Stiff,
that the bid of Potts Drilling in the amount of $7,530.00 be accepted. The motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner
Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none.
Decision- Conditional Use Permit - MPM Co., - sanction office with existing automotive and
transmission repair business - 2203 Lea Avenue
The request of MPM Co., for a Conditional Use Permit, was presented for a decision.
The applicant seeks a conditional use permit which, if granted, would formally sanction
the institution of an existing automotive and standard transmission repair business plus a
1 business office for the sale of steel buildings.
The Commission concurred in the recommendation of the City Manager, and it was moved by
Commissioner Stiff, seconded by Commissioner Swanson, that the Commission approve the
Conditional Use Permit with the following conditions:
1- Signing shall be limited to the existing flush-mounted building signs as
designated on the applicant's site plan submitted for this hearing. Said
signs shall not be externally illuminated nor blinking, flashing, or
animated. No mobile, portable, or temporary signs shall be used on the
site. No external lighting apparatus shall be attached to signs in con-
junction with the proposed use.
2. Three (3) copies of a final site plan containing all conditions, corrections
and modifications recommended and approved by the City Commission shall be
reviewed and approved by the Planning Staff prior to the issuance of a
building permit for this project.
The final site plan shall show, in addition to the data now contained on
the site plan submitted, the following:
A. All landscaped areas shall be enclosed by permanent concrete or
asphaltic curbing at least six (6) inches in height to prevent
vehicular traffic across landscaped areas.
B. All parking spaces and ingress/egress areas thereto as paved.
C. A six (6) foot minimum height for the proposed trash enclosure area.
D. A different symbol change for either the Japanese Barberry or Alpine
Current as used in the landscape schedule.
I 3. All on-site improvements (i.e., paving, landscaping, etc.) shall be com-
pleted within eighteen (18) months of approval of the Conditional Use
Permit.
4. The Conditional Use Permit shall be valid for a periOd of only eighteen (18)
months following approval of the conditional use permit and shall be sub-
mitted to the City Commission for renewal as specified on the Conditional
Use Permit. Failure of the applicant to satisfy all conditions within the
designated time periOd may be grounds for terminating the Conditional Use
Permit. If all required conditions have been satisfied, the permit shall
be permanently renewed.

Decision - Conditional Use Permit - Michael ROdrique - construct 2,816 square foot
carpenter shop - 1403 Gold Avenue
The request of Michael Rodrique, for a Conditional Use Permit, was presented for a
decision.
The applicant seeks a conditional use permit which, if granted, would allow the con-
struction of a 2,816 square foot carpenter's shop at 1403 Gold Avenue, in the Bomont Center I
Subdivision.
Following discussion, it was moved by Commissioner Swanson, seconded by Commissioner
Mathre, that the Commission approve the conditional use permit which would allow the con-
struction of a 2,816 square foot carpenter's shop with the following conditions:
l. The conditional use review and approval is limited to the carpenter's shop.
Due to zoning code limitations, review and approval of an unspecified use
cannot occur as all uses in a 'T' di stri ct must be approved through the
conditional use process.
2. Revision of landscape schedule per Planning Office's standard format.
3. Providing additional tam junipers or similar species to provide effective
low screening of parking spaces.
4. Minor Revisions
a. Provide dimensioned and scaled cross-section of pavement.
b. Show percent building coverage of the site.
c. Label curb location clearly on site plan.
5. Three (3) copies of a final site plan containing all conditions, corrections and
modifications recommended and approved by the City Commission shall be reviewed
and approved by the Planning Director prior to the issuance of a building permit
for the project. One (1) signed copy shall be retained by the Planning Director;
one (1) signed copy retained by the Building Department; and one (1) signed copy
retained by the applicant.

Decision - Zone Map Change - Tom Deibele - AS to RS-1, 10 acres located on Haggerty Lane
The request of Tom Deibele for a Zone Map Change, was presented for a decision.
The applicant seeks a change to the City's Official Zoning r4ap on approximately 10.0
acres located several hundred yards east of Haggerty Lane and south of and adjacent to
Clover Meadows Subdivision.
It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the Commission
approve the Zone Map Change from AS to RS-1 as recommended by the Zoning Commission. The
motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Mathre, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab;
those voting No, none.
Decision - Zone Map Change - Robert Pearson - A-S to R-O, 7.7 acres west of Haggerty Lane
The request of Robert Pearson for a Zone Map Change from A-S to R-O, was presented for 1
a decision.
The applicant seeks a change to the City's Official Zoning Map on approximately 7.7
acres located west of and adjacent to Haggerty Lane. It would change land presently zoned
A-S to R-O. The Staff report recommended approval of this request provided the property is
annexed to the City or other suitable measures are implemented to insure annexation prior to
issuance of a City Building Permit and that the City and County Commissions formally approve
the pending Master Plan Amendment.

It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Commission
approve the request for the Zone Map Change with the conditions as stated above. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer,
Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting
No, none.

Continued hearing - Zone Map Change - Gary Schaefer & Vaughn Johnson A-S to R-MH
This was the time and place set for the continued hearing on the request of Gary Schaefer
and Vaughn for a Zone Map Change from A-S to R-MG.
Applicant Gary Schaefer was present and advised the Commission that applicant Vaughn
Johnson's land changed hands on October 7, 1980, and he would like to meet with the new owner
before the continued hearing.
Several property owners were present to object to the Zone Map Change. Their main
concern was flooding of that area. One property owner said it would affect the aesthetic
beauty of their area.
Carl Isaacson submitted two (2) petitions which had been signed by property owners in
that area who protested the Zone Map Change.
Bud Blazier felt that a zone map change for a trailer park is not within the best
interest of the residents of Bozeman.
Carl Isaacson talked about the Rocky Creek flooding and high ground water.
Ski:Shields talked about the water and sewer services and road accesses.
John Dougherty showed pictures of flooding in that area.
The hearing will be continued until a later date.
Plans and specifications - Parking Lot Landscaping
Plans and specifications for landscaping and sprinkling equipment for the parking lots
on the corner of Tracy Avenue and Mendenhall Street, and Black Avenue and Mendenhall Street
1 as prepared by the office of the Architect, Cecilia R. Vaniman, 5020 Westlake Road, was
presented.
It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission
approve the plans and specifications as presented and the Clerk of the Commission be authorized
and directed to issue a "Call for Bids" for the landscaping and sprinkling equipment for the
parking lots, with an opening date of October 29, 1980. The motion was carried by the follow-
ing Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Com-
missioner Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none.
Rental housing rehabilitation program for expansion
The Loan/Grant Review Committee, at their meeting on September 25, 1980, expressed the
accord of the committee to expand the program design of the HOUSing Rehabilitation Program to
include rental properties.
There was considerable discussion in regard to making this move and although the committee
members expressed concern about the benefit to landlords, they felt that these reservations
were overridden by the benefit to low and moderate renters and to the housing stock of the
community.
Following discussion, the Commission requested that the Planning staff investigate the
information received from cities utilizing such loans and grants and report back to the
Commission on Wednesday, October 15, 1980.
Set interest rate for those connecting to Daum Sanitary Sewer
1 The Commission asked the City Manager to continue negotiations/discussions with
Mr. Harry Daum and his Attorney, Mr. Bolinger and report back to the City.
EPA Grant Amendment No. 1 - Federal Sewage Works - C 300208-13 (Step 3)
The EPA Assistance Agreement/Amendment No.1 for the construction of rehabilitation
measures as provided in plans and specifications prepared under EPA Grant No. C 300208-13,
was presented.
***Continued hearing - Zone Map Change - Kirkwood Baptist Church - R-3 to B-2-T
The request of Kirkwood Baptist Church for a Zone Map Change from R-3 to B-2-T is to be continued.

The total grant earned is $3,417.00 less than the present grant. The grant offer of
$280,500.00 is, therefore, decreased by $3,417.00 or a total of $277,083.00. This is 75
percent of the final value of the work in place.
It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Mayor
be instructed to sign and date the forms, and return them to the Montana Department of Health
and Environmental Sciences for final payment. The motion was carried by the following Aye I
and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner
Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none.
Proposed resolution - establishing policy for acquisition of water rights for owners of
real property.
The Water Users Association & Agricultural Preservations Association asked that they
be allowed to look at the proposed policy and have an opportunity to comment on it before it
is adopted.
Repurchase Agreement as procedure for investment of City funds
Commissioner Stiff advised the Commission that he and John Evans are to meet with the
Gallatin County Auditor, Ken Mosby and his assistant Doug Kosty along with Janet Lakey,
BOOkkeeper/accountant for the Clerk and Recorder, and Loy Carroll, Chief Deputy to the
County Treasurer, on Tuesday, October 14, 1980 to study the desirability of a Repurchase
Agreement with local banks to enhance the investment of City money.
Commissioner Stiff - concern over personnel in the finance department
Commissioner Stiff expressed his concern over the finance department personnel.
Commissioner Stiff feels the Commission should have been advised of the loan of an accountant.
The City Manager apologized for not letting the Commission know about the loan of
Amy Swan.
Proclamation - National Cosmetology Week - October 5-11, 1980 I
Mayor MacNab proclaimed the week of October 5-11, 1980 as National Cosmetology Week in
the City of Bozeman and commended it and its theme, "Cosmetology Makes Life More Beautiful",
to the attention of the Citizens in order to recognize cosmetologists for their dedicated
services to the grooming of men and women for a greater quality of life.
It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the
Commission endorse the Mayor's proclamation. The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner
Vollmer, Commissioner Stiff, and Mayor MacNab; those voting No, none.
Revision of lesson fees - Bozeman Swim Center
The City Manager recommended consideration by the Commission of two aspects of Bozeman
Swim Center operation. They were:
1. That persons be authorized to purchase six-month passes for exactly
one-half the season ticket price;
2. That those possessing six-month season passes be charged one-half the
regular fee for swim lessons.
After discussion, the Commission approved both proposals and requested them to be put
into effect.
Camp Fire Girls - Candy Sale - 15-26 October, 1980
A letter received from Vicki Frazier, Executive Director of the Headwaters Council of
Camp Fire requesting permiSSion to hold its annual Candy Sale on October 15-26, 1980 was
presented. 1
It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that permission
be granted the Headwaters Council of Camp Fire to hold its annual Candy Sale. The motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Mathre,

Building Inspectors Conference - Great Falls, October 17, 1980
A Building Inspectors Conference has been scheduled to be held in Great Falls on
October 17, 1980, and Don Barrick asked permission to attend the conference.
It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that Building
1 Inspector Don Barrick be granted permission to attend the conference and, it being in the
public interest his expenses be paid out of the appropriate fund. The motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner
Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none.
National Fire Academy - Emmitsburg, MD - October 27-31, 1980 - Dewey Johnson
Dewey Johnson has been accepted to attend the National Fire Academy in Emmitsburg, MD
and requested permission to attend the course on Arson Detection to be held from October
27-31, 1980.
It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that Dewey
Johnson be granted permission to attend the academy and, it being in the public interest his
expenses be paid out of the appropriate funds. The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner
Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none.
Report - Building Inspector for September
The report of the Building Inspector was presented for comment on October 15, 1980.
Letter of condolence to family of Joe May
The Mayor directed the Clerk of the Commission to address a letter of condolence to
the family of Joe May on behalf of the City Commission.

With no further business to come before the Commission at this time, it was moved by
