The Commission of the City of Bozeman met in regular session in the Commission Room,
Municipal Building, August 27, 1980 at 1:15 o'clock p.m. Present were Mayor MacNab, Commis-
sioner Vollmer, Commissioner Swanson, Commissioner Mathre, City Manager Gesko, City Attorney
Planalp and the Clerk. 1
Commissioner Mathre opened the meeting with a prayer whereupon the minutes of the regu-
lar meeting held on Wednesday, August 20, 1980 were approved as submitted.
Open Construction Bids - SID No. 619 - Water Main Construction on Lea Avenue
This was the time and place set for opening bids for the Water Main construction on Lea
Avenue.
The affidavit of publication for the "Call for Bids" as advertised was presented.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the bids be
opened and read. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Vollmer, Commissioner Swanson, Commissioner Mathre, and r~ayor MacNab; those

The following bids were then opened and read:
Mike Boylan Construction -- Gallatin Gateway - $14,802.50
Tom Roe & Sons Construction -- Big Timber - 13,775.83
Underground Construction -- Bozeman - 14,893.25
It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the bids be
referred to the consulting engineers, Thomas, Dean & Hoskins, Inc., for tabulation and a recom-
mendation to be made on Wednesday, September 3, 1980. The motion was carried by the following

Public Hearing - proposed appropriation ordinanace - Fiscal year 1980-1981 1
This was the time and place scheduled for the public hearing on the appropriation ordinance
for the fiscal year 1980-1981.
The City Manager explained the budget proposal for the fiscal year ending June 30, 1981.
The estimated mill levy is 105.38 pending receipt of the certified mill levy submitted by the
Gallatin County Assessor.
Very little comment was made from citizens attending the meeting.
Mayor MacNab closed the public hearing and the proposed appropriation ordinance comparison
with the City Manager's recommendation operating budget expenditure summary for the fiscal year
1980-1981 will be published on Friday, August 29, 1980, in accordance with the law.
Cooperative Agreement with Blue Ribbons
The proposed Cooperative Agreement between Blue Ribbons of the Big Ski Country Areawide Plan-
ning Organization and the City of Bozeman for the purpose of implementing the Blue Ribbons Water
Quality Management Plan was presented.
FOllowing discussion, the Commission concurred in the recommendation of the City Manager,
that they delay action on the proposed Cooperative Agreement for a period of one week for staff
review.
Propose Pool Fees - Swimming Pool
Jim Rivenes, Chairman of the Blue Ribbons Committee and Karen Williamson of the Swim Committee
appeared before the Commission to discuss the study promotion of the Bozeman Swim Center for the
specific purpose of proposed pool fees for the coming season. I
The recommended fees to be charged at the Swim Center effective September 1, 1980, are as
follows:

Following discussion, it was moved by Commissioner Mathre, seconded by Commissioner Vollmer,
that the fees at the Swim Center be approved as recommended by the Recreation Board. The motion
was carried by the fOllowing Aye and No vote: those voting Aye being Commissioner ~1athre, Commis-
sioner Vollmer, Commissioner Swanson, and Mayor MacNab; those voting No, none.
*****Because of receiving federal funds, the City is virtually compelled to adopt procedures which
comply with federal standards.
The City Engineer explained that the Public Service Commission is required to review the
I sewage rates for Bozeman.
Following discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Swanson,
that the Commission direct the City Attorney to draw up an ordinance amending Chapter 10.16 of
the Bozeman Municipal Code for the purpose of design and construction of the sanitary sewers,
buildings, sewers, and connections. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Mathre, and ~1ayor
MacNab; those voting No, none.
Proposed Ordinance - Enacting the procedure for determining equitable cost levied on Industrial
Concern which discharges wastewater to system
A proposed ordinance enacting the procedure for determining equitable cost recovery charges
to be levied on any industrial concern which discharges industrial wastewater to the wastewater
system operated by the City of Bozeman, and providing certain prohibitions was presented.
The purpose of the ordinance is to recover the proportional share of the Federal Grant from
users discharging industrial wastewater to the wastewater system. An industrial user's share
shall be based on factors which significantly influence the cost of the treatment works. Such
factors include volume, strength, and delivery flow rate characteristics.
Following discussion, it was moved by Commissioner Swanson, seconded by Commissioner Mathre,
that the Commission direct the City Attorney to draft an ordinance enacting the procedure for
determining equitable discharges industrial wastewater to the wastewater system operated by the
City of Bozeman, and providing certain prohibitions. The motion was carried by the following

Proposed Ordinance - to replace Section 10.19.020 & 10.19.030, Chapter 10.19 service charges to
be levied on all users which discharge wastewater to the wastewater system

A proposed ordinance repealing 10.19.020 and 10.19.030 and enacting the procedure for deter-
mining equitable service charges to be levied on all users which discharge wastewater to the
wastewater system operated by the City of Bozeman and prOViding certain prohibitions, was pre-
sented.
*****Proposed Ordinance - Amendment to Bozeman Sewer Ordinance - Chapter 10.16
A proposed ordinance amending Chapter 10.16 of the Bozeman Municipal Code for the purpose of
design and construction of the sanitary sewers, buildings, sewers, and connections was presented.

The City of Bozeman or the City Engineer shall determine the total annual costs of operation
and maintenance of the wastewater system which are necessary to maintain the capacity and per-
formance, during the service life of the treatment works, for which such works were designed and
constructed.

that the Commission direct the City Attorney to draft an ordinance for determining equitable 1

1980-1981 City/State Agreement for sigpal maintenance reimbursement
An Agreement made and entered into by and between the City of Bozeman and the Montana Depart-
ment of Highways, was presented.
The cost to maintain the traffic signals on Main Street - flashing lights at High School,
signals at ten intersections, 11th Avenue to Rouse Avenue; North 7th Avenue - signals at Menden-
hall, Durston, and flashing school crossing lights at Villard Street; Rouse Avenue - flashing
lights school crossing Lamme Street is to be reimbursed by the Montana Department of Highways.

Clerk of the Commission be directed to sign the signal maintenance Agreement contingent upon
the signal light on Willson Avenue and Babcock Street, and the flashing light on Babcock Street
behind the school being included. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Mathre, and
Mayor MacNab; those voting No, none.
Montana Conference of Seventh Day Adventists - Easement and Riqht-of-Way Agreement Sewer Trunk
"Letter of Understandingll
An Easement and Right-of-Way Sewer Trunk "Letter of Understanding" to set forth a specific
agreement between the City of Bozeman and the Montana Conference of Seventh Day Adventists, was 1
presented.
The easement is granted for the purpose of constructing a new trunk sewer on the east side
of town from Hyalite View Subdivision generally northward and across Interstate 90, presently
owned by the Montana Conference of Seventh Day Adventists and Carol J. Hunt. A letter of
understanding is desired in addition to granting the easement, for the purpose of ensuring use
of this trunk sewer when deemed necessary by the landowners.
FOllowing considerable discussion, it was moved by Commissioner Swanson, seconded by Commis-
sioner Vollmer, that the Commission approve the Easement and Right-of-Way Sewer Trunk "Letter
of Understanding" as set forth in full:
In consideration of the execution of the easement and right-of- way
agreement by the Conference and Carol Hunt, the City of Bozeman does
agree to allow this parcel of land reasonable access to this sewer
line upon the proper execution of the waiver of protest of annexa-
tion approved by the City as is normally required and the payment
of normal connection charges and expenses. Should this property be
annexed to the City of Bozeman prior to development, a waiver of pro-
test will not be necessary and sewer service will be available upon
request subject to the normal connectton,; charges and expenses.

Petition - Requesting SID Improvements - Eugene Graf - Block 9, Figgins Addition
A letter received from Eugene Graf, Jr. petitioning the City of Bozeman to create a special I
improvement district for the purpose of construction of water, sewer, and paving on Block 9 of
Figgins Addition, was presented.
It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the Commission
aCknowledge receipt of the request and refer it to the staff for review and a recommendation.
The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Mathre, Commissioner Vollmer, Commissioner Swanson, and ~1ayor MacNab; those voting No, none.

EPA Grant - ~artial payment outlay report and request for reimbursement for construction
program C300 08 - Step 2, Sewage Treatment - for signature
Grant Agreement No. C300208-Step 2 Engineering services as per contract Amendment No. 7
dated October 10, 1979 for the secondary treatment plant, in the amount of $26,300.00, was
presented.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Grant
I Agreement be approved and the Mayor and Clerk of the Commission be directed to sign the
documents for the City of Bozeman. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Mathre,

Gambling permit - The Bowl to June 30, 1981
The City Manager presented the gambling license application for the Bowl, 414 E. Babcock
along with the appropriate fee of $500.00 from the TOI for the year 1980-1981.
It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission
approve the application for the issuance of the gambling license. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre,
Commissioner Vollmer, and Mayor MacNab; those voting No, none.
Petition - Summit Engineering - creation of Special Improvement District
A letter received from John D. Duncan, President of Summit Industrial Products, petition-
ing the City of Bozeman to create a special improvement district for the purpose of paving
Seventh Avenue from Kagy to Summit Industrial 2311 South Seventh Avenue.
Any further expansion of growth of Summit in Bozeman will depend upon whether reasonable
access to their facilities can be established in the near future. This will require not only
making Seventh Avenue passable from Summit to Kagy but its extension south to Third AVenue.
It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission
aCknowledge receipt of the petition and refer it to the staff for review and a recommendation,
1 and that Mr. Graf be contacted to possibly work something out. It was also suggested that Mr.
Tietz be contacted. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Vollmer, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those
voting No, none.
Contract Agreement - Rouse Avenue from Main to Sabcock Street - Long Construction

The contract documents for the paving improvements on South Rouse AVenue between Babcock
and Main Street, as prepared by Thomas, Dean & Hoskins, Inc., in the amount of $9,450.00,
were presented.
The City Manager recommended that the Contract Documents in the amount of $9,450.00, as
submitted by Long Construction Company, Billings, be approved.
It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission
approve contract documents of Long Construction Company and instruct the Mayor and Clerk of the
Commission to sign the contracts for the City of Bozeman, and that Long Construction be author-
ized and directed to proceed with the construction. The motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner
Vollmer, and Mayor MacNab; those voting No, none.
Claims
The claims for the month of August were presented. The City t1anager had checked the claims
against the City of Bozeman and recommended they be approved and the Director of Finance be
instructed to issue warrants in payment thereof.
