HomeMy WebLinkAbout1980-08-06 90 " - Bozeman, Montana August 6, 1980 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, August 6, 1980, at 1:15 o'clock p.m. Present were Mayor MacNab, Commis- sioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, City Manager Gesko, City Attorney Planalp, and the Clerk. I Commissioner Stiff opened the meeting with a prayer whereupon the minutes of the regular meeting held on Wednesday, July 23, 1980 and Wednesday, July 30, 1980 were approved as sub- mitted. Open Construction Bids - Street Improvements - South Rouse Avenue This was the time and place set for opening sealed bids for the construction of Street Improvements for South Rouse Avenue. The affidavit of pUblication for the "Call for Bids" as advertised was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the bids be opened and read. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. The following bids were then opened and read: Big Sky Paving - Bozeman $11,205.00 Long Construction Company - Billings 9,450.00 It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the bids be referred to the consulting engineers Thomas, Dean & Hoskins, Inc., for tabulation and a recom- mendation to be made on Wednesday, August 13, 1980. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none. Award Bids - two 1980-1981 4 door sedans - Police Department I The Police department reviewed the bids as submitted and recommended the bid be awarded to Gallatin Motors based upon their low bid, it meeting or exceeding specifications in the "Call for Bids". The Commission concurred in the recommendation of the Acting Police Chief, also con- curred in by the City Manager, and it was moved by Commissioner Swanson, seconded by Commis- sioner Mathre, that the Commission., accept the Bid of Gallatin Motors in the amount of $12,388.05 for the purchase of two AMC Concorde Four Door Sedans to be used by the Police Department. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, and Mayor MacNab; those voting No, none. Free Parking until new two-hour parking limit signs are installed The City Manager requested the Commission to approve free parking in the downtown area for the balance of this week. The signs for the off-street parking should be ready by next week. Following discussion, it was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the parking meters be terminated effective Thursday, August 7, 1980. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none. The Commission urged the people not to abuse the two hour parking, and asked that employees not use the parking spaces. Status of drainage project SID 605 - Graf's First Addition-Via Hyalite Subdivision I The City Engineer advised the Commission that he met with Walt Anderson, Roy Wells, and Dick Fisher in regard to the drainage project, SID No. 605, Graf's First Addition. Walter Kelly of 1127/~pp~j~~ar6~to~~i~~e Commission on behalf of the property owners in the Hyalite Subdivision. He advised the Commission that they rejected any proposal that does not carry the storm drainage water completely through the confines of the Hyalite Subdivision. Walter Kelly said the people want to be sure there is a child-proof grate at the bottom of the pipe, and that the culvert under Holly Drive be kept clear of debris at all times. 91 It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the Commission approve the recent revision which allows extending the pipe to the bottom of the gUlly and thence to the gully to a point midway between South Pinecrest and Holly Drive. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab; those voting No, none. I Decision - Conditional Use Permit - Green, Bandel, Biggerstaff - Townhouse Planned Unit Development The decision on the request of Green, Bandel, Bigerstaff for a Conditional Use Permit, having been delayed for a period of one week, was presented for a decision. The applicant seeks a conditional use permit for a Townhouse Planned Unit Development which, if granted, would allow the construction of a fifteen unit townhouse project. Following discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Commission approve the Conditional Use Permit with the following conditions: 1. The final site plan shall be revised per major and minor comment items noted in STAFF FINDINGS. 2. Three (3) copies of a final site plan containing all conditions, corrections and modifications recommended and approved by the City Commission shall be reviewed and approved by the Planning Director prior to the issuance of a building permit for the project. One (1) signed copy shall be retained by the Planning Director; one (1) signed copy retained by the Building Department; and one (1) signed copy retained by the applicant. 3. All on-site improvements (i.e., paving, landscaping, etc.) shall be completed within eighteen (18) months of approval of the Conditional Use Permit. 4. The Conditional Use Permit shall be valid for a period of only eighteen (18) months following institution of the use and shall be submitted to the City Commission for renewal as specified on the Conditional Use Permit. Failure of the applicant to satisfy all conditions within the designated time period may be groundS for terminating the Conditional Use Permit. If all required conditions have been satisfied, the permit shall be permanently renewed. Public hearing - Conditional Use Permit - Carol Dietrich-use ofaprivate school -Block B of Hoffman's Addition - to be continued This was the time and place set for the pUblic hearing to consider the Conditional Use Permit requested by Carol Dietrich of the World Family School. The applicant seeks a conditional use permit which, if granted, would allow the use of a private school. The lot area is approximately 10,220 square feet (0.235 acres). The building areas equal 1,069 square feet. The application provides two off-street parking spaces. ~. The Zoning Commission asked that the matter be continued to allow more time for considera- tion with various City staff. Public hearin - Conditional Use Permit - Maurice Klabunde - construction of bank - west arcel of Lot 1, Block 2 of the Trlang e Annexatlon This was the time and place set for the pUblic hearing to consider the Conditional Use Per- mit requested by Maurice Klabunde. The applicant seeks a conditional use permit which, if granted, would allow the construction of a bank with building area of 4,846 square feet. The lot area is 2.392 acres. The Assistant Planning Director presented the staff report which recommended approval subject to conditions. Dick Whiteaker was present to advise the Commission that he supported the Conditional Use I Permit. There was no one present to protest the Conditional Use Permit. The Mayor declared the hearing closed and a decision will be forthcoming on Wednesday, August 13, 1980. Public hearing - Conditional Use Permit - Motel 6, Inc., - construction of 122 unit motel - west parcel of Lot 1, Block 2 of the Triangle Annexation This was the time and place set for a publiC hearing to consider the Conditional Use Permit requested by Motel 6, Inc. 92 The applicant seeks a conditional use permit which, if granted, would allow the construction of a motel with one hundred and twenty-two guest rooms. The total building area equals 15,825 square feet on the ground floor. The off-street parking requirement is one hundred and twenty- two spaces. The Assistant Planning Director presented the staff report which recommended approval sub- ject to conditions. I There was no one present to protest the Conditional Use Permit. The Mayor declared the hearing closed and a decision will be forthcoming on Wednesday, August 13, 1980. Continued hearing - Zone Code Amendment - Southwest Montana Homebuilders - Chapter 18.76.050, 18.76. 070, 18.76.150, and 18.69.180 - modification in Townhouse Development standards and curb cuts Having continued the pUblic hearing on the Zone Code Amendment of the Southwest Montana Homebuilders to allow further review and consideration of optional guidelines, it was reconvened. FOllowing discussion, the Commission concurred in the recommendation of the Zoning Commission, that this request for townhouse zone code modifications be cont'd until the August meeting of the Zoning Co~ission. Ordinance No. 1056 - Pearson et. al. - Annexation Ordinance No. 1056 declaring that the City of Bozeman and the inhabitants of a tract of land contiguous to the said City of Bozeman, known as the Pearson, et. al., (West Babcock) Annexation, as prepared by the City Attorney, was presented, entitled: ORDINANCE NO. 1056 AN ORDINANCE OF THE CITY OF BOZEMAN DECLARING THAT THE CITY OF BOZEMAN AND THE INHABITANTS THEREOF, AND OF THE INHABITANTS OF A TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN, KNOWN AS THE PEARSON, ET. AL., (WEST BABCOCK) ANNEXATION, AND HEREIN MORE PARTICULARLY DESCRIBED, TO EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGU- I OUS TRACTS WITHIN THE CORPORATE LIMITS THEREOF. It was moved by Commissioner Swanson, seconded by Commissioner Vollmer, that Ordinance No. 1056 be passed and adopted, and that the effective date of Annexation be September 6, 1980. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, and Mayor MacNab; those voting No, none. Commission Resolution No. 2218 - Create SID 619 - Lateral Water Mains Lea Avenue Commission Resolution No. 2218 creating Special Improvement District No. 619, for the pur- pose of construction and installation of Water Lateral Mains and appurtenances thereto on Lea Avenue, as prepared by the City Attorney, was presented. COMMISSION RESOLUTION NO. 2218 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 619 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF WATER LATERAL MAINS AND APPURTENANCES TO SERVE THE ADJOINING PROPERTIES MORE SPECIFIC- ALLY AS FOLLOWS: A LATERAL MAIN AND APPURTENANCES ON LEA AVENUE, IN THE CITY OF BOZEMAN. THE CONSTRUCTION AND INSTALLATION TO INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIALS, WATER PIPE, VALVES, FITTINGS, SERVICE LINES AND OTHER NECESSARY APPUR- TENANCES. I It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that Commission Resolution No. 2218 creating Special Improvement District No. 619 be passed and adopted. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and r1ayor MacNab; those voting No, none. Plans & Specifications - SID No. 619 - Call for Construction Bids August 27, 1980. Call for Bond Sale - September 3, 1980 The City Manager recommended that the plans and specifications for SID No. 619 Lateral Water Main Construction on Lea Avenue, as prepared by Thomas, Dean & Hoskins, Inc., be approved. Upon recommendation by the City Manager, it was moved by Commissioner Vollmer, seconded 93 by Commissioner Stiff, that the plans and specifications be approved as presented, and that the Clerk of the Commission be authorized and directed to issue a "Call for Bids" for the construction of SID No. 619, with an opening date of August 27, 1980, and that she be author- ized and directed to advertise for the sale of bonds in the amount of $24,300.00 to be received on Wednesday, September 3, 1980. The motion was carried by the following Aye and I No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. Proposed affirmative action Plan A proposed Affirmative Action plan to be utilized when seeking and retaining new City employees was submitted on July 30, 1980. The reasons for considering adoption of the Affirmative Action plan, are two-fold: first, because of the State statute included with the draft; and secondly because receipt of federal monies eventually--invariably requires adoption of such an Affirmative Action program. This is ObViously to ensure the retention of minority groups and women on public payrolls. FOllowing discussion it was suggested that action be delayed for a period of one week. Selection of persons - Committee for Housing Rehabilitation Program There are vacancies on the Loan/Grant Review Committee in conjunction with the housing rehabilitation program, as well as the Citizens Advisory Committee. It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that Robert Blumen- feld, and Amy Swan be appointed to the Loan/Grant Review Committee. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab; those voting No, none. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that Dennis Hardin, Ken Western and Angie Knox be appointed to the Citizens Advisory Committee. The motion was car- ried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. I City Manager's estimate of expenditures & revenues A discussion was held on the City Manager's estima'te of expenditures and revenues. A copy of the proposed budget for the year 1980-1981 was presented to all members of the Commission for their study in preparation for the special meeting to be held on Tuesday, August 11, 1980 at 7:00 p.m. Dennis Blackketter - draft report of solid waste recovery & energy generation system Dennis Blackketter appeared before the Commission to explain the solid waste recovery and energy generation system and answer any questions that might arise. A decision will be forthcoming on Wednesday, August 20, 1980. File Police Court reports - February through June 1980 The City Manager commented on the Police Court Reports for the months of February through June 1980 and recommended they be accepted and ordered filed. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the reports be accepted and ordered filed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none. Report - Building Inspector The report of the Building Inspector for the month of July 1980 will be listed on the agenda next week for aCknowledgement and filing. I Agreement - between City of Bozeman & Story Mill Fire District A proposed Agreement by and between the City of Bozeman and the Story Mill Fire District whereby the district desires to employ, for a fee, City personnel and equipment to provide emergency fire protection within the District, was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Commission approve the Agreement between the City of Bozeman and the Story Mill Fire District. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, :none. -- 94 - - Absence of Mayo~ MacNab, August 13, 1980 Upon recommendation of the City Manager, it was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the absence of Mayor MacNab, from the meeting of August 13, 1980 be authorized in compliance with Section 7-3-4319, MCA, and that Commissioner Vollmer be appointed as President ProTempore during his absence. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner I Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none.
