HomeMy WebLinkAbout1980-07-23 77 Bozeman, Montana July 23, 1980 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, July 23, 1980 at 1:15 o'clock p.m. Present were Mayor MacNab, Commis- sioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, City Manager I Gesko, Acting City Attorney Johnstone, and the Clerk. Commissioner Mathre opened the meeting with a prayer whereupon the minutes of the regu- lar meeting held on Wednesday, July 16, 1980 were approved as submitted. World Family School -(Carol Dietrich) - request renewal of permit and removal of any specific time period for the duration of school The request from Carol Dietrich of the World Family School, to renew their permit to use the home at 120 East Story for its school was referred to the staff for a study and a recom- mendation to be made this date. The City Manager said he had no objection to the school. His only concern is the fire safety. He said they would have to comply with the off-street parking requirements. The Attorney representing the school requested that the renewal be approved contingent upon the inspection of the fire marshall. The Commission acknowledged receipt of the petition signed by sixteen adjOining property owners protesting the continuance of the World Family School. Several property owners were also present for the hearing. The protestors said their reason for protesting was the off-street parking and poor maintenance of the grounds. Lee Lewis of the Fire Department advised the Commission that they had inspected the prop- erty and denied the request. Commissioner Swanson suggested that the Building Inspector and the Fire Marshall inspect the property. I It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the decision be delayed for a period of one week for direction from the Fire Department and the Building Inspection Department. The motion was carried by the fOllowing Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. Variance to Building Code - R. Evans & DiBerardinis - rebuilding of balcony Sometime ago the Commission granted a variance for the "Union Hall" restaurant, on the second floor of Bob Evans' building adjacent to the former Unemployment Office. At the time the variance was granted, a balcony was to be built or restored, which would maintain the architecture of the building as originally planned. At the time the variance was granted, the Commission speCifically prohibited the consumption of beverages or food on this balcony. It was to be a balcony for ornamental purposes only. However the minutes did not reflect this and the City Manager requested that it be made a part of the minutes in order that the staff can legitimately enforce the prohibition. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the balcony be purely ornamental, and that no person or persons be allowed on the balcony at any time. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none. Heritage Homes - (Maurice Klabunde) - petition for Sewer SID - Triangle Area Annexation to I Bozeman - 6.4 acres A letter recieved from Maurice J. Klabunde, Heritage Homes, petitioning the City of Bozeman to create a special improvement district for the purpose of sewer construction in the Triangle Area Annexation to Bozeman, was presented. It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commis- sion acknowledge receipt of the petition and refer it to staff for study and a recommenda- tion. The motion was carried by the fOllowing Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, and Mayor MacNab; those voting No, none. -." 78 R. L. Stratford - petition for storm sewer - MT. Bell Property A letter received from R. L. Stratford, petitioning the City of Bozeman to create a special improvement district for the purpose of installing a storm sewer across the Mt. Bell property, was presented. It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the Commission acknowledge receipt of the petition and refer it to staff for study and a I recommendation. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab; those voting No, none. Request for reimbursement - construction program - Federal Grant - C300208 Step 2 - EPA An Outlay Report and request for reimbursement for construction programs, Federal Grant No. C300208 - Step 2 was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the EPA Federal Grant No. C300208 - Step 2, reimbursement in the amount of $14,650.00 be approved and the City Ma~ager be instructed and directed to sign the outlay report and request for reimbursement for construction programs for the City of Bozeman. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner ~1athre, and Mayor MacNab; those voting No, none. Request for Federal Assistance - Waste Water Treatment Works Construction Grant An application requesting Federal Assistance for the construction and inspection Step III for new outfall sewers and Sewer Rehabilitation in connection with the Waste Water Treatment Works Construction Grant, was presented. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission approve the application for Federal Assistance and the Mayor be instructed and directed to sign the Grant application for the City of Bozeman. The moti on was carri ed by the fo 11 ow- ing Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, I Commissioner Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none. Thomas, Dean & Hoskins, Inc., - Amendment No.8 - Engineering Contract development of engineer- ing plan - installation of a 20 inch outfall Hyalite interceptor sewer, and the Rouse Avenue rehabilitation Amendment No.8, to the Engineering Contract between the City of Bozeman and Thomas, Dean & Hoskins, Inc., was presented. Amendment No.8 involves the Hyalite interceptor sewer, and the Rouse Avenue rehabilitation, all in accordance with the Facility Plan. The total payment to the engineer for the work complete under this Agreement shall not exceed $29,100, with the exception that final payment may be adjusted, with Owner approval, to reflect the actual work accomplished. It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission approve Amendment No.8 to the engineering contract between the City of Bozeman and Thomas, Dean & Hoskins, Inc., and direct the Mayor and Clerk of the Commission to sign the contract on behalf of the City of Bozeman. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, Commis- sioner Stiff, and Mayor MacNab; those voting No, none. Easement & Right of Way for Sewer Trunk - Valley Unit Subdivision (McMillan) A letter of understanding regarding the future annexation of the McMillan Property to be limited to 3.54 acres of existing homestead where a waiver of protest will be required to I hook this home to the City Sewer, was presented. It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the Commis- sion concur in the recommendation of the City Manager and approve the Waiver of Protest as presented. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab; those voting No, none. 79 Recommendation from Park Board - Kiwanis picnic shelter -Beall Park Showing of Films -Bogart Park Swimming Pool Fees The City Manager advised the Commission that the new picnic shelter being constructed by the Kiwanis Club will be erected on the Southeast corner of Beall Park. Summer Film - 80 - Moti on pictures in Bogart Park - I James Nicoloro addressed a letter to the Bozeman Park Board, requesting permission to show motion picture films at Bogart Park on Wednesday, August 6, 1980, Wednesday, August 20, 1980 and Wednesday, September 3, 1980. These films are shown free of charge. The Park board approved the request and recommended that the City Commission grant per- mission for the Friends of Film to show the films at Bogart Park on the above dates. It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that permission be granted to show motion picture films at Bogart Park on the above dates. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab; those , voting No, none. Swimming Pool Fees - The Swimming pool fees were discussed at the Park Board meeting held on Thursday, July 17, at which time the City Manager suggested a blue ribbon committee to consider publicity and promotion of the Bozeman Swim Center. Mr. Gesko advised the Commission that the Board readily accepted the idea and said they would assist in any promotional effort which will increase utilization of the facility. Following discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Recreation Board Swim Committee appoint a blue ribbon committee to consider publicity and promotion of the Bozeman Swim Center. The motion was carried by the fOllowing Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, I Commissioner Mathre, and Mayor MacNab; those voting No, none. Rick Mayfield Assoc., Inc. - petition annexation of portion of Story Hills A letter received from Rick Mayfield petitioning the City of Bozeman to annex a portion of Tract 1, all of Tract 2, a portion of Tracts 19 and 20 and the open space adjacent and contiguous to the hereinabove mentioned tracts, and known as the Story Hills, was presented. It was moved by Commissioner Stiff, seconded by Commissioner Mathre, that the Commission acknowledge receipt of the petition and refer it to the City staff for a report and a recom- mendation. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner ~,1athre, Commissioner Vollmer, and Mayor MacNab; those voting No, none. Verification of Pledged Securities - June 30, 1980 In compliance with the provisions of Section 7-6-201/212 MCA, Commissioner Mathre and Commissioner Vollmer, had examined the receipts of Depository Bonds and Securities held by the Director of Finance as security for City funds deposited in Bozeman Banks. The depository bonds and securities were found to be in order. It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the depository bonds and pledge securities be approved and a list of these set forth in the minutes of the meeting. All expenses will be paid by the Academy except for the $120.00 meal fee. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that Captain Dan Figgins be granted authorization to attend the school and, it being in the public interest, the $120.00 meal fee be paid out of the appropriate fund. Western Fire Chiefs Conference - Salt Lake City, UT - August 17-21 The Western Fire Chiefs Conference is scheduled to be held in Salt Lake City, Utah, August 17-21, and Fire Chief Simpson and Deputy Chief Lewis have requested authorization to attend the conference. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that Fire Chief Simpson and Deputy Chief Lewis be granted authorization to attend the conference and, it being in the public interest, their expenses be paid out of the appropriate fund. Montana State Fire Fighters Convention, Fairmont Hotsprings - July 23-26 I The t10ntana State Fire Fighters Convention is scheduled to be held at Fairmont Hotsprings on July 23-26, and Captain Dan Figgins and Skip Hougland requested permission to attend the convention. It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that permission be granted Captain Figgins and Fire Fighter Hougland to attend the convention and, it being in the public interest, their expenses be paid out of the appropriate fund. The Contract Documents for the construction of the New Municipal Library, as prepared by Mattson, Prugh & Lenon, were presented. The City attorney reviewed the contract documents and recommended that they be approved in the amount of $990,900.00 as submitted by Martel Construction, Inc. Bozeman Lions Club - License for Circus - July 26-27 The Bozeman Lions Club requested permission to sponsor the Big John Strong Circus on July 26-27, 1980 with a license fee reduction. Following an extensive discussion, the Commission concurred in the recommendation of the City Manager, and it was moved by Commissioner Mathre, seconded by Commissioner Vollmer that due to extenuating circumstances, they deny the Bozeman Lions Club request for waiving or reducing the license fee. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab; those voting No, none. It was suggested that a letter be drafted to all service clubs, suggesting that any type of road show pay their own fee for the issuance of a license. Application for Gambling License - Lady Luck Gaming Parlor - $500.00 - 2 tables The City Manager presented the gambling license application along with the appropriate fee of $500.00 from the Lady Luck Gaming Parlor (formerly The Dark Horse) for the year 1980- I 1981. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Commission approve the application for the issuance of the gambling license. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. Hyalite Subdivision - Drainage, SID 605 - Graf's First Several of the residents from the Hyalite Subdivision, along with their legal counsel, Edmund P. Sedivy, Jr., attended the meeting to plead with the City Commission to have the Park and Recreation Board consider the storm drainage project for SID No. 605 as proposed with the pond eliminated and replaced with the overflow system. The City Manager pointed out that the Park and Recreation Board would be meeting the following night. FOllowing considerable discussion, it was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the consulting engineer, Jim Cummings, instruct the contractor to go ahead with the earth work and to lay the drainage crosspipe and inlet basins in SID No. 605, but wait for any further work for a period of one week. Appointment to Parking Commission - Effective July 1, 1980 - William Ewasiuk Mayor MacNab announced his appointment of William Ewasiuk to the Parking Commission effec- tive July 1, 1980 to June 30, 1984. I Mr. Ewasiuk replaces H. B. Landoe who did not wish to be reappointed to the Parking Commis- sion at this time. It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the Commission endorse Mayor MacNab's appointment. Claims The general claims for the month of June, 1980 were presented. The City Manager had checked the claims and found them to be true and lawful claims against the City of Bozeman, and recom- mended they be approved and the Director of Finance be instructed to issue the warrants in pay- 84 ment. Weed Control Policy I The City staff pursued the possibility of weed mowing on empty lots and advised the Commission that nothing would be done this year. The City Manager said the weed control program would not be in effect this season, but that it should be made a budget item in 1981. Discuss reappointment & membership on City/County Planning Board and Zoning Commission A short discussion was held in regard to the reappointment and membership on the City/ County Planning Board and Zoning Commission. The City Attorney explained that the two functions are different, and it would be unwise to combine the two commissions into one. Budget for 1980-1981 A short discussion was held in regard to the 1980-1981 budget.
