HomeMy WebLinkAbout1980-07-09 63 Bozeman, Montana J u 1 y 9, 1980 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, July 9, 1980 at 1:15 o'clock p.m. Present were Mayor MacNab, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, City t1anager Gesko, I Acting City Attorney Johnstone, and the Clerk. Commissioner Vollmer opened the meeting with a prayer whereupon the minutes of the regular meeting held on Wednesday, July 2, 1980 were approved as submitted. Open Construction Bids - New Municipal Library This was the time and place set for opening bids for the construction of the New Municipal Library as prepared by Mattson, Prugh & Lenon, Architects. Affidavit of publication of "Notice to Bidders" was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the bids be opened and read. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner ~1athre, and Mayor MacNab; those voting No, none. The following bids were then opened and read: Base Bid Edsall Construction, Bozeman $ 959,700.00 Kober Construction Co., Billings 939,700.00 Martel Construction, Inc., Bozeman 930,000.00 Stewart & Janes, Kalispell 941,000.00 Robert A. Taylor Construction, Bozeman 973,000.00 Travis, Jam, Inc., Billings 1,028,660.00 The Commission concurred with the recommendation of the City Manager, and it was moved by I Commissioner Stiff, seconded by Commissioner Swanson, that the bids be referred to the Architects and staff for tabulation, consideration, and a recommendation on Wednesday, July 16, 1980. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, and Mayor MacNab; those voting No, none. Close public hearing on Pearson Annexation - Commission Resolution NO. 2181 -to receive protests for a period of twenty days. The hearing on the request of Pearson, et. al. Annexation, having been continued from June 25, was again presented. There being no protests on file and no one present to further protest the annexation, the Mayor declared the hearing closed and the governing body will receive written protests for a period of twenty days. A decision will be forthcoming on July 30, 1980. Continued hearing - Zone Map Change - Rick Mayfield (Story Hills Subdivision) Having continued the publiC hearing on Rick Mayfield's request for a period of one week, it was again presented. The applicant seeks a change to the City.s Official Zoning t1ap which would reclassify the zoning on approximately two hundred eighty-two and eight-tenths acres from RS-2 and R-1 to R-2, B-1 and R-2 and R-1 to R-4. There being no one present to protest, the Mayor declared the hearing closed and a decision will be forthcoming on Wednesday, July 16, 1980. I Public hearing - Conditional Use Permit - Gallatin County Jail - construct detention center This was the time and place set to consider the Conditional Use Permit requested by the Gallatin County. The applicant seeks a Conditional Use Permit which, if granted, would allow the construc- tion of a detention center of 12,420 square feet, including detention areas for men, women and juveniles, as well as the men's work release area. The site, zoned PLI-T is located at 615 South 16th Avenue on approximately 219,504 square feet (5 acres). The site is immediately north of the County Law & Justice Center. d 6'4 The Planning Director presented the staff report which recommended approval thereof with conditions. The City Manager advised the Commission that when the Law & Justice Center was originally proposed, new jail facilities were to have been constructed below the present gymnasium. Place- ment of the new jail on the north side of the present Law and Justice Building will probably preclude any use of that land for park purposes, as originally planned. I There being no one present to protest, the Mayor declared the hearing closed. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the one week waiting period be waived. The motion was carried by the fOllowing Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission approve the Conditional Use Permit with the fOllowing conditions: 1- The final site plan shall be revised per major and minor comment items noted in STAFF FINDINGS. 2. Three (3) copies of a final site plan containing all conditions, corrections and modifications recommended and approved by the City Commission shall be reviewed and approved by the Planning Director prior to the issuance of a building permit for the project. One (1) signed copy shall be retained by the Planning Director; one (1) signed copy retained by the Building Depart- ment; and one (1) signed copy retained by the applicant. 3. All on-site improvements (i.e., paving, landscaping, etc.) shall be com- pleted within eighteen (18) months of approval of the Conditional Use Permit. 4. The Conditional Use Permit shall be valid for a period of only eighteen months following institution of the use and shall be submitted to the City Commission for renewal as specified on the Conditional Use Permit. Failure of the appli- cant to satisfy all conditions within the designated time period may be grounds for terminating the Conditional Use Permit. If all required conditions have been satisfied, the permit shall be permanently renewed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, and Mayor ~1acNab; I those voting No, none. Public hearing - Coniditional Use Permit - Green, Bandel & Biggerstaff - to be continued This was the time and place set to consider the Conditional Use Permit for Green, Bandel & Biggerstaff. The applicant seeks a Conditional Use Permit which, if granted, would allow the con- struction of a seventeen unit townhouse project. The site is located on a 1.261 acre tract known as Certificate of Survey No. 381. The site is commonly known as the Old Ice Pond south of and adjacent to the Bonn Subdivision in the 400 block of East Story Street. The Planning Director gave the staff report which recommended continuing the hearing for a period of one month. Continued public hearing - Zone Code Amendment - Planning staff - revision of zoning fees Having continued the hearing on the request of the Planning staff for a Zone Code Amendment, it was again brought before the Commission. The Zone Code Amendment would revise fees for review of zoning matters. The Zone Code Amendment would increase the fees dramatically, and the process might be considered a sub- stantial departure from present and past practices. The City Manager advised the Commission that the request for revision of the zoning fees is somewhat related to the City/County Planning budget for the fiscal year, and recom- mended that the hearing be continued for a period of one month. Decision - Conditional Use Permit - Joseph Mahurin - construct office and shop - McChesney I Industrial Park Subdivision on Gilkerson Drive The Commission closed the public hearing on the request of Joseph Mahurin for a Condi- tional Use Permit on Wednesday, July 2, 1980. The applicant seeks a conditional use permit which, if granted, would allow the construc- tion of a 2,160 square foot office and equipment maintenance shop located in the McChesney Industrial Park Subdivision on Gilkerson Drive. It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission concur in the recommendation of the City Manager and approve the Conditional Use Permit with the following conditions: 65 1. The filed plat shows the north and south property lines to be 164.96 feet in length. The site plan shows a length of 190 feet. The final site plan will need to conform with the filed subdivision plat. 2. The current utility easements as noted above should be shown and building location revised accordingly. The applicant could, however, delay final site plan approval until the amended plat is filed as previously noted. 3. Parking be allowed along north property line with revised angle parking and I appropriate landscape buffer between parking stalls and north property line. 4. Parking, loading and driveway areas need to be paved with asphaltic or port- land cement concrete. The site plan needs to be reivsed accordingly. 5. Drainage facilities need to be shown on the site plan and reviewed by the City Engineer. 6. Proposed landscaping or other uses within 15 foot easement needs to be reviewed and approved by the City Engineer. 7. Need to submit information clarifying location and width of access ease- ment to A.S.C.S. Building. Also, clarify if Lot 12 can utilize easement. 8. Include in title block address of applicant and project site. 9. Show setback lines with dimensions. 10. Show width and height dimensions for truck entry doors. 11. Outside storage area use limited to parking business vehicles. 12. Need to clarify garbage container location. Outside garbage containers shall be screened per Code requirements. 13. The proposed sign needs to show proposed dimensions, color, materials and light- ing. 14. Need detail cross-section dimensioned drawing of 6-inch high curbing, wheel stops, sidewalk and paving. 15. Clarify south elevation of building. 16. Show percent building coverage of site. 17. Revise landscape information as follows: (a) Show percent of site landscaped. (b) Plant legend showing total number of plants and trees, by common names, and estimated sizes at time of installation and at maturity. (c) Show location I of individual juniper and caragana plants at time of installation. (d) Clearly indicate curb location. (e) Indicate how landscaping in eastern portion will be irrigated. Additional hydrants other than one shown will be needed. 18. Three copies of a final site plan containing all conditions, corrections and modifications recommended and approved by the City Commission shall be reviewed and approved by the Planning Director prior to the issuance of a building per- mit for the project. Decision - Zone Map Change - Jane Jelinski - R-4 to R-3. The Commission closed the public hearing on the request of Jane Jelinski on July 2, 1980. The applicant seeks a Zone Map Change from R-4 to R-3. It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the Commis- I sion concur in the recommendation of the City Manager and approve the Zone Map Change from R-4 to R-3 subject to option No. 2 as described by the exhibit furnished by the Planning Staff and supported by the Zoning Commission. The motion was carried by the fOllowing Aye and No vote: those voting Aye being Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab; those voting No, none. Christian Center - review of variance property located at 921 W. Mendenhall A letter received from the Christian Center School Board requesting the City Commission to review the variance and its provisions on the property located at 921 West Mendenhall, was presented. d "66 . " The City Manager said the Commission had renewed the variance for fifteen months to expire on September 1, 1980, with the limitation that it would be the final variance. A petition protesting an extension to the variance to operate a school was presented. Several property owners were also present to protest the variance. Mr. & Mrs. Oliver Dahl complained that the students created parking problems in the area, as well as creating dis- ruption in the area. I School Administrator Miles Miller was present in regard to the variance. He said the parking problems were created by the public schools instead of the Christian Center School. He told the Commission that they would erect a taller fence if need be. Following discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Commission deny the request for renewal of the variance. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab; those voting No, being Commis- sioner Mathre. Ordinance No. 1055 - Barrick et.al. - Annexation Ordinance No. 1055 annexing certain described lands contiguous to the City of Bozeman, Montana to be known as Barrick, et. al. Annexation, as prepared by the Acting City Attorney was presented, entitled: ORDINANCE NO. 1055 AN ORDINANCE ANNEXING CERTAIN DESCRIBED LANDS CONTIGUOUS TO THE CITY OF BOZEMAN, MONTANA TO BE KNOWN AS BARRICK ANNEXATION SO AS TO INCLUDE CERTAIN CONTIGUOUS TRACTS WITHIN THE CORPORATE LIMITS THEREOF. It was moved by Commissioner Stiff, seconded by Commissioner Swanson that Ordinance No. 1055 be passed and adopted to become effective August 8, 1980. I Commission Resolution No. 2213 - Housing Rehabilitation Grant Program Rationale The Housing Rehabilitation Program originated by the Department of Housing and Urban Development and connected by the City of Bozeman was established to restore a quality pro- gram of housing to the City of Bozeman, improve neighborhoods within the City of Bozeman, and prOVide funds to low and moderate income homeowners to upgrade their homes to safe, sani- tary and decent standards. Commission Resolution No. 2213 fixing the criteria used in establishing income eligibility for the Housing Rehabilitation Program as prepared by the City Attorney, was presented, entit- led: COMMISSION RESOLUTION NO. 2213 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, FIXING THE CRITERIA USED IN ESTABLISHING INCOME ELIGIBILITY FOR THE HOUSING REHABILITATION PROGRAM OF THE CITY OF BOZE- ~~AN . It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that Commission Resolution No. 2213 be passed and adopted. Commission Resolution No. 2214 - Purchase of Road Oil for fiscal year 1980 - 1981 Commission Resolution No. 2214 authorizing the purchase of not to exceed 25,000 gallons I of Road Oil during the fiscal year July 1, 1980 to June 30, 1981, for use by the Street Department in repairing pavement and for sealing certain sections of existing pavement within the City from the Montana Highway Department was presented. It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that Commission Resolution No. 2214 be passed and adopted and purchase be made from HB254 and SB 362 "Gas Tax Funds II. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab; those voting No, none. ;67 Contract Documents - SID No. 617 - Big Sky Paving - $21,474.00 The Contract Documents for the construction of paving Block C, Original Townsite - Alley between East Main & Babcock Streets, and Rouse & Bozeman Avenue, as prepared by Thomas, Dean & Hoskins, Inc., were presented. The City Manager recommended that the Contract Documents in the amount of $21, 474.00 as submitted by Big Sky Paving be approved. I It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Contract Documents be approved and the Mayor and Clerk of the Commission be authorized and directed to sign the contracts for the City of Bozeman, and that Big Sky Paving be authorized and directed to proceed with the construction of SID 617. The motion was carried by the follow- ing Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commis- sioner Swanson, Commissioner Mathre, and Mayor MacNab; those voting No, none. Verification of Pledged Securities - March 31, 1980 In compliance with the provisions of Section 7-6-201/212 MCA, Commissioner Mathre and Commissioner Vollmer had examined the receipts of Depository Bonds and Securities held by the Director of Finance as security for City funds deposited in Bozeman banks. The depository bonds and securities were found to be in order. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the depository bonds and pledge securities be approved and a list of these set forth in the minutes of the meeting. Availability of Bozeman Landfill for City of Livingston -solidwaste, via private collection The City of Bozeman authorized the City of Livingston to dispose of its solid waste in the City landfill, for a period not to exceed one year. Livingston individuals are to be charged the same as Bozeman residents. However, the two packer trucks owned by the City of Livingston are to be charged $18.00 per load. These trucks are of 16- and 18- cubic yard capacity. The City Manager advised the Commission that the City of Livingston has taken bids on the disposal of their solid waste, utilizing private contracts for this work. He further advised the Commission that he could see no difference in allowing a private contractor to dispose of Livingston's solid waste material. In all likelihood, larger trucks would be used for the haul to Bozeman and the City Manager suggested perhaps an extension of the previously-quoted price would be in order, namely, $1.00 per cubic yard, or $40.00 for a 40-cubic-yard truckload. The City of Bozeman will work directly with the City of Livingston and they will forward I the money to the City of Bozeman. FOllowing discussion, it was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the private contractor be granted permisSion to pick up the solid waste material for a per- iod of one year at a price of $1.00 per cubic yard, or $40.00 for a 40-cubic-yard truckload. Theatres to serve beer at the picnic to be held at Lindley Park contingent upon receiving a state and city beer license.
