HomeMy WebLinkAbout1980-06-25 50 Bozeman, Montana June 25, 1980 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, June 25, 1980, at 1:15 o'clock p.m. Present were Mayor MacNab, Commis- sioner Vollmer, Commissioner Stiff, Commissioner Swanson, City Manager Gesko, City Attorney Planalp, and the Clerk. I Commissioner Stiff opened the meeting with a prayer whereupon the minutes of the regu- lar meeting held on Wednesday, June 18, 1980 were approved as submitted. Absence of Commissioner Mathre - June 25, 1980 It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the absence of Commissioner Mathre, from this meeting, be authorized in compliance with Chapter 7-3-4319 M.C.A. The moti on was carri ed by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and ~1ayorMacNab; those voting No, none. Negotiated Bond Sale - SID 620 - pave portion of Blackmore Place - $14,000.00 The City Manager recommended that a decision on the negotiations for the Bond sale on Special Improvement District No. 620 be delayed for a period of one week due to a complica- tion. Award Construction bids - SID No. 616 - Long Construction - $75,675.00 The consulting engineer having reviewed the bids submitted on Special Improvement Dis- trict No. 616 - paving and storm drain on Koch Street between 20th and 23rd Ave., recommended awarding the bid to Long Construction Company based on their low bid of $75,675.00 Following discussion, it was moved by Commissioner Swanson, seconded by Commissioner Vollmer, that Long Construction be awarded the bid for paving SID 616 in the amount of $75,675.00, it being the lowest bid submitted and equaling or exceeding the speCification in the "Call for Bids". The motion was carried by the following Aye and No vote: those voting Aye being I Commissioner Swanson, Commissioner Vollmer, Commissioner Stiff, and Mayor MacNab; those vot- ing No, none. Continued public hearing - Commission Resolution No. 2187- Sebena Annexation Having continued the pUblic hearing on Commission Resolution No. 2187 - declaring its intention to extend the boundaries of the City of Bozeman so as to include a tract of land known as the Sebena Annexation and containing approximately 2.8 acres, for a period of one week to give the City Attorney, the Attorney representing William Sebena, and the Attorney for the Northeast Neighborhood Alliance an opportunity to review the legal aspects, it was again brought before the Commission. The City Attorney said the Commission did not request the annexation. A letter dated April 24, 1980 from Attorney Joseph W. Sabol, for and on behalf of William Sebena, requesting the City Commission of the City of Bozeman to consider annexing Mr. Sebena's property to the City of Bozeman was presented. A drawing prepared by Thomas, Dean & Hoskins, Inc., indicating that the proposed site could accommodate all structures and equipment was presented. Rand Frohm of 518 South Eighth was present to oppose the annexation. Fire Chief Simpson told the citizens there was no problem with extinguishing the fire. He recommended that a two-wheel chemical cart would be advisable and speculated that Mr. Sebena would probably be quite receptive to prOViding such a device. The City acknowledged a letter dated June 14, 1980 from Martin A. Hamilton. Mr. I Martin Hamilton expressed his opposition to the annexation. Several other citizens were also present to protest the annexation. The Planning Director advised the Commission that he had discussed the latest plans with the Attorney representing Mr. Sebena. He said there had been some changes submitted and they had all been approved and signed. Commissioner Swanson said the City is annexing the land at this time, not the land use. 51 FOllowing a thorough discussion, the Mayor declared the hearing closed and a decision will be forthcoming on Wednesday, July 2, 1980. Commission Resolution No. 2167 - Barrick, et. al. annexation The City Manager along with Messrs. Barrick and Pearson met with the County Commission in regard to the roadway which would serve Mr. Barrick's annexation as proposed. The exact I right-of-way width on which Babcock Street is situated is unknown. The County Commission requested an opinion from the County Attorney, which hopefully would determine what the extent of the right-of-way actually is at this time. The width of the right-of-way is significant, because it is not apparent from distances between fence lines or from the traveled roadway or from the width of ditches on either side. After visiting with the County Commissioners the City Manager visited the entire area with the petitioners, and had a much better appreciation for their problem and the City's prob- lems as well. The City Manager conceded that roadway problems are more generally associated with the subdivision of land than with annexation. Accordingly, if the Commission were to consider annexation at this time, certain conditions should be recognized and made a matter of record. The City Manager recommended that no subdiViding or use of the land annexed should be allowed, until some satisfactory resolution of the road problems is aCknowledged by the Commission. On this basis and with this specific understanding, it was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Commission approve the extension of the boundaries of the City of Bozeman to include the Barrick Annexation, and instruct the City Attorney to draw up an ordinance to be brought in for action. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swan- son, and Mayor MacNab; those voting No, none. Decision - Pearson, et. al. Annexation - Commission Resolution No. 2181 The City Manager along with Messrs. Continued hearing Zone Map Change - Eugene Graf - AS to R-2, south of Summit Engineering, east of Figgins Addition The decision on the request of Eugene Graf for a Zone Map Change from AS to R-2, having been delayed for more than thirty days, was again presented. Following discussion, it was moved by Commissioner Swanson, seconded by Commissioner Vollmer, I that the decision on the Zone Change from AS to R-2 be delayed. Don Norem - request permission to use overhead aerial bombs in conjunction with pre-Fourth of July car sale and promotion A letter received from Leon Gover, Sales Manager for Don Norem Chevrolet, requesting per- mission to use overhead aerial bombs similar to the display used at the Bobcat football games 52 in conjunction with their pre-Fourth of July car sale and promotion, was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the request for the overhead aerial bombs be denied. The motion was carried by the fOllowing Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab; those voting No, none. Verification of Depository Bonds and Pledge Securities - December 31, 1979 I In compliance with the provisions of Section 7-6-201/212 M.C.A., Commissioner Mathre and Commissioner Vollmer had examined the receipts of Depository Bonds and Securities held by the Director of Finance as Security for City funds deposited in Bozeman Banks. The depository bonds and securities were found to be in order. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the deposit- ory bonds and pledge securities be approved and a list of these set forth in the minutes of the meeting.**The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Vollmer, and Mayor MacNab; those voting No, none. Swimming pool fees for both indoor and outdoor pools. A memo received from Community Recreation Director A. Glen White advising the City Manager that the Community Recreation Board Swimming Committee recommended that the City Commission approve increased pool fees effective 1 July 1980, was presented. Following discussion, the Commission concurred in the recommendation of the City Manager, and it was moved by Commissioner Swanson, seconded by Commissioner Vollmer, that the Commission approve the fOllowing pool fees effective July 1, 1980: Bogert Pool 17 & under from $ .25 to $ .50 18 & over from $ . 50 to $1. 00 Coupons (good at both pools) $5.00 a booklet at $6.50 value The motion was carried by the following Aye and No vote: those voting Aye being Commissioner I Swanson, Commissioner Vollmer, Commissioner Stiff, and Mayor MacNab; those voting No, none. Authorization to negotiate appraisals as submitted, regarding Sewage Treatment Plant The City secured appraisals on the property needed to prOVide for tertiary treatment at the Sewage Treatment Plant. These appraisals were distributed to the Commission, and direction was given to put the appraisals into the hands of the landowners involved. Having done the above, the City Manager asked for permission to begin negotiation with those landowners on the basis of the appraised prices. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the City Manager begin negotiation with the landowners on the basis of the appraised prices. Commission Resolution No. 2211 - adopt resolution awarding the sale and authorizing issuance of General Obligation Library Building Bonds Series 1980 Commission Resolution No. 2211 awarding the sale and authorizing the issuance of the General Obligation Library Building Bonds Series 1980/~RtfReJ~~~u~t d~8~l,460,OOO, as prepared by DeMuth, Kemp & Backus of Denver, Colorado, was presented. COMMISSION RESOLUTION NO. 2211 AWARDING THE SALE AND AUTHORIZING THE ISSUANCE BY THE CITY OF BOZEMAN, MONTANA, OF ITS GENERAL OBLIGATION LIBRARY BUILDING BONDS, SERIES 1980, IN THE PRINCIPAL I AMOUNT OF $1,460,000. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission pass and adopt Commission Resolution No. 2211. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Vollmer, and Mayor MacNab; those voting No, none. Audit Committee - re structure Commissioner Stiff gave a short report on the proposed document which defines the structure, role and scope of the Audit Committee. He said the audit is going according to schedule. He **List - P. 55- 57 53 feels as though the committee is working together very well. He said everything should be put in writing for the use of the Committee in 1981. Sweet Pea Parade - August 7, 1980 at 3:00 p.m. A letter received from Bill Neff, Parade Coordinator of the Sweet Pea Festival, requesting permission to schedule a parade for the 3rd Annual Sweet Pea Festival on Thursday, August 7, 1980, I was presented. The parade will form at Buttrey's at 3:00 p.m. and commence at 4:00 p.m. It will travel down Main Street and disperse at Bogert Park. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that permission be granted to conduct the parade as stated above. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab; those voting No, none. Livingston - request for use of Landfill The City of Livingston requested permission to use the City of Bozeman Landfill on a tem- porary bas is. Following discussion, it was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission accept the City Manager's recommendation to allow the City of Livingston to use the Landfill on a temporary basis, and that they pay a fee of $18.00 per packer per load delivered. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Vollmer, and Mayor MacNab; those voting No~ none. Request from George Roemhild for City Water off of North 17th Avenue A letter received from George Roemhild requesting permission to receive City water was pre- sented. The property is adjacent to the Covered Wagon Trailer Court and is presently being supplied I with water by a well on the front portion of the property. On the rear portion of the property there is a four-plex that Mr. Roemhild and his partner are contemplating converting to a condo- minium, and in order to do so, they would like the property to have its own water supply. The City water lines come practically right down to the southern boundary line on this property on North Seventeenth Avenue. Mr. Roemhild and his partner would like to receive the City water and are willing to be annexed to the City when they are adjacent to the City, and would be willing to sign a Waiver of Protest. Following discussion, it was moved by Commissioner Swanson, seconded by Commissioner Vollmer, that the Commission approve the request for City water service SUbject to receiving a Waiver of Protest from the property owners - Mr. Roemhild and partner. Woolco Dept. Store - request permission to serve beer at Lindley Park 7-20-80 A letter received from the Woolco Dept. Store, requesting permission to serve beer at a family picnic to be held at Lindley Park, on Sunday, July 20, 1980, was presented. It was moved by Commissioner Swanson, seconded by Commissioner Vollmer, that permiSSion be granted the Woolco Dept. Store to serve beer at a family picnic at Lindley Park contingent upon receiving a state and city beer license. I Commission Resolution No. 2210 - designate Mayor to sign Dept. of Health & Environmental Sciences Project No. C300208-2 Commission Resolution No. 2210 designating Duncan S. MacNab, Mayor of the City of Bozeman to sign Department of Health & Environmental Sciences Project No. C300208-2, was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Commission pass and adopt Commission Resolution No. 2210 designating Duncan S. MacNab, Mayor of the City of Bozeman as the authorized representative for the above-referenced project and designating a president pro-tempore to sign in his absence. The motion was carrried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson, and Mayor MacNab; those voting No, none. .- 54 Permission - MSU Shakespeare inParks program - June 28, August 8-9 A letter received from the Department of Theatre Arts requesting permission to schedule the MSU Shakespeare in the Parks program in the parks of Bozeman, was presented. The department will begin the season in Cooper Park, Saturday, June 28 and conclude the season with two performances in Lindley Park on August 8th and 9th in conjunction with the Sweet Pea Festival. I It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Depart- ment of Theatre Arts be granted permission to schedule the MSU Shakespeare in the Parks pro- gram. Proclamation - Ringing of Bells -July 4th (Independence Day) The Mayor, in response to a request from the President of the United States and Governor Judge, proclaimed July 4, 1980 - Independence Day as "Ring Out for Freedom Day" in the City of Bozeman, and urged everyone to ring bells of all sizes and descriptions at 12:00 Noon on that day. It was moved byCbmmi'S:SibnerVollmer, seconded by Commissioner Stiff, that the Commission endorse the Mayor's proclamation. Request for funds & permission to paint mural Eagles building Two university students received permission from the Eagles to paint a mural on the entire east wall of their building. The students requested the City to appropriate funds to paint the mura 1. They also asked that an account be established at a local paint store, plus a $1,000 fee for the two artists involved. Following discussion, it was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission deny the request to paint the mural on the east wall of the Eagles building. Claims The general claims for the month of June 1980 were presented. The City Manager had checked the claims and found them to be true and lawful claims against the City of Bozeman and recommended they be approved and the Director of Finance be instructed 55 to issue the warrants in payment. It was moved by Commissioner Swanson, seconded by Commissioner Vollmer, that the Commission approve the claims. File Reports - Library - Police Department The City Manager commented on the report of the Librarian and the Police Department and recommended they be accepted and ordered filed. It was moved by Commissioner Vollmer, seconded by Commissioner Stiff, that the Commission accept the Library Report and the report of the Police Department and order them filed.
