Amend 3 - Sand Stewart - Front Street ConnectorCommission Memorandum Front Street Connector Trail Project – PSA Amendment with Sanderson Stewart Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Carolyn Poissant – Manager of Trails, Open Space and Parks Design and Development Mitch Overton – Director of Parks, Recreation, and Cemetery SUBJECT: Amendment No. 3 to Professional Services Agreement with Sanderson Stewart for Front Street Connector Trail Design and Engineering MEETING DATE: September 12, 2016 AGENDA ITEM TYPE: Consent RECOMMENDATION: Approve the correction to Amendment No. 2 to the Professional Services Agreement with Sanderson Stewart for Design and Engineering of the Front Street Connector Trail for an amount not to exceed $58,920 and authorize the City Manager to execute the amended agreement. BACKGROUND: Resolution 4621A authorized funding of the Front Street Connector Trail project from the 2012 Trails, Open Space and Bond in the amount of $178,106. A Professional Services Agreement with Sanderson Stewart was approved on May 23, 2016, which erroneously stated the amount of the contract as $29,970.15. This amount is the direct cost portion of the proposal but does not include the firm’s overhead (“multiplier”). The correct amount is $58,920. The reasons for the significant expense relative to the size and budget of the project are due to the hydrologic modeling and engineering required to prepare local, state, and federal permit applications for the bridge over Bozeman Creek, which crosses a Federal Emergency Management Agency (FEMA) designated floodway. A FEMA Letter of Map Revision (LOMR) also needs to be prepared and filed after completion of the project. A portion of the fee ($7000) was able to be reduced due to not needing to perform a full wetland delineation and from previous preliminary design work that had been done in association with the Oak Street design work. UNRESOLVED ISSUES: An encroachment permit is being negotiated with the adjacent property owner which calls for relocation of fencing and materials that are currently in city right-of-way where the trail is to be constructed. The Montana Dept. of Transportation is in the process of acquiring right-of-way from this property owner at the Rouse-Oak intersection, with improvements at that intersection scheduled to be completed in 2018. We will install a gravel fines trail for this small section and coordinate with MDT to install the asphalt trail. ALTERNATIVES: As directed by Commission. 114 Commission Memorandum Front Street Connector Trail Project – PSA Amendment with Sanderson Stewart FISCAL EFFECTS: The contract amount of $58,920.00 is covered by the Trails, Open Space, and Parks bond allocation of $178,106 (Resolution 4621A) for the Front Street Connector Trail. No additional funding is required at this time. However, the trail construction budget will effectively be reduced from $163,000 to $133,000. Depending on the bids received, additional funding may become necessary at a future date. Box 1230 Bozeman, Montana, 59771-1230 (OWNER) and Sanderson Stewart, 106 E. Babcock, Bozeman, Montana, 59715 (CONSULTANT). WHEREAS, the parties have entered into a Professional Services Agreement dated March 16, 2015, for design and engineering services, for the Oak Street Improvements Project; and WHEREAS, Sanderson Stewart has provided preliminary design and survey work for the Front Street Connector Trail, which will connect to the Oak Street multi-use path; and WHEREAS, the parties desire to further amend the provisions of this Agreement. NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED HEREIN, the parties agree as follows: The conditions and provisions set forth in the attached Scope of Work for the Front Street Connector Trail are hereby incorporated in and made part of this agreement. The Scope of Services and Consulting Fees are increased as per Exhibit A. Payment: Consultant shall complete design and engineering and construction administration services for the Front Street Connector Trail project, as approved by Commission Resolution 4621A to be funded by the Trails, Open Space, and Parks 2012 Bond in an amount not to exceed $58,920. CITY OF BOZEMAN SANDERSON STEWART BY: __________________________________ BY:___________________________________ (City Manager) Title:_______________________ DATE:________________________________ DATE:_________________________________ ATTEST: BY:____________________________________ (City Clerk) 117 Exhibit A Oak Street Improvements Scope of Work – Front Street Pathway Revised 8/9/16 Sanderson Stewart is pleased to provide this scope of work for the Front Street Pathway as an amendment to the existing Oak Street Improvements contract. We understand the project generally includes survey, design, permitting, and construction administration for an asphalt pathway extending east from the Oak Street/Rouse Avenue intersection along Birch Street and the Front Street right-of-way and ending at Wallace Avenue for a total length of approximately 1250 lineal feet. The project includes a bridge across Bozeman Creek and sidewalk along Wallace Avenue will be extended to connect to the existing Story Mill Spur trail. A detailed list of assumptions and scope of services for the project are outlined below. Assumptions: 1. KLJ is currently working on the Wallace Avenue improvements, which will overlap with the improvements on the east end of this project. We will coordinate with them as needed throughout the design process, but we understand that KLJ will design the realignment of the Kenyon Noble approach to Wallace as well as the ADA accessibility ramps and crosswalk for the trail crossing on the north side of the approach. They will also design the railroad crossing and Sanderson Stewart will design the additional sidewalk/trail to make the connection between the north side of the railroad crossing and the Story Mill Spur Trail. 2. The bridge across Bozeman Creek will be prefabricated by Contech (or an approved equal) and it will be acceptable to work with Contech engineers during the design phase. As sub-consultants to Sanderson Stewart, STE Engineering will complete the structural design of the bridge foundation and Terracon will complete the required geotechnical analysis. 3. Based on correspondence with Brian Heaston from the City of Bozeman, we understand that the proposed Front Street pedestrian bridge will need to be permitted based on the draft new floodplain maps for Bozeman Creek. The draft floodplain maps are currently under QA/QC review by FEMA and are expected to be available within the next couple of months to be used as “Best Available Data”. The new floodway width at the proposed bridge crossing is approximately 65 feet wide based on the draft mapping. If a floodway encroachment analysis determines that the new bridge crossing does not encroach upon the floodway, a conditional letter of map amendment (CLOMR) is not required prior to construction; however, a letter of map revision (LOMR) will likely be required after construction. We have assumed that the floodway encroachment analysis determines that the bridge crossing will not encroach upon the floodway in order to avoid the CLOMR process and simplify the floodplain permitting prior to construction. 118 4. After construction, a LOMR will be required. Based on correspondence with Brian Heaston, we understand the LOMR would be based on the draft new floodplain maps for Bozeman Creek (not the current effective floodplain maps). Scope of Work: Sanderson Stewart will provide the following services as part of its basic services: Phase 1 - Project Initiation This phase of the project will include project initiation and planning tasks, including scoping, contract preparation, meetings with the City of Bozeman and coordination with sub-consultants. All project management tasks, client meetings and sub-consultant coordination for tasks beyond project initiation will be allocated to the remaining project phases. Phase 2 - Topographic Survey and Base Mapping A detailed topographic survey of the pathway alignment will be conducted, including pre-survey research of the property boundary and control information, setting control as needed, and a corner search to establish right-of-way. Base drawings will be prepared/updated in Autocad format following the completion of the topographic survey, and additional pick-up topo will be conducted as needed throughout the duration of the project. Public and private utilities will be located prior to the survey via one-call for inclusion in base drawings. The topographic survey phase will also include up to eight (8) cross sections across Bozeman Creek for the bridge design and hydraulic modeling for the LOMR. This assumes we can tie-in to cross section L (4766) upstream and cross section 4023 downstream on the draft new floodplain map. We will prepare a survey base map to be used for the floodplain permitting, hydraulic modeling, floodway encroachment analysis and LOMR. We will also survey the as-built location of the bridge after construction to be used for the LOMR. Phase 3 - Floodplain Permitting and LOMR This phase consists of preparing the necessary floodplain permit documents for submittal to the City of Bozeman and preparation of the hydraulic models that are required by FEMA for their review of the LOMR. We will utilize the draft study data flow information provided by FEMA for the 10-year, 50-year, 100-year, and 500-year peak discharges. The LOMR will be based on the draft new floodplain maps and not the current effective floodplain maps. This phase also consists of preparing the LOMR application (MT-2 application) for review and approval by FEMA for the new bridge. This phase of the project includes the following tasks:  Preliminary hydraulic modeling of bridge crossing to verify bridge span width and deck height based on the new draft floodplain maps. We understand that an encroachment analysis will be required to show that the bridge crossing does not encroach upon the floodway.  Prepare Joint Application for Permitting in Montana Streams.  Prepare Floodplain Exhibit showing floodplain fringe and floodway boundary and location of new bridge. 119  Provide details of bridge and abutment and abutment scour protection. STE Engineering will be the structural engineering sub-consultant for design of the bridge foundation and we have assumed that Contech would provide details for the bridge deck.  Prepare City of Bozeman Stormwater Management Permit Application.  Submit permit information to the City of Bozeman for review.  We will also submit the Joint Application to the appropriate agencies for the 404 permit and 318 authorization to determine if these permits are required as well and will obtain these permits if deemed required by the jurisdictional agency.  Review draft new floodplain mapping and modeling.  Prepare Duplicate Effective Model by importing the cross sections from the draft hydraulic model from FEMA into the Hec-RAS Version 4.1 hydraulic model.  Prepare Corrected Effective Model/Pre-Project Conditions model.  Prepare Post-Project Conditions Model to include the new bridge. This model will need to tie-in to the draft new floodplain at a published FEMA cross section within the tolerances allowed by FEMA. We have assumed that we can tie-in to cross section L (4766) upstream and cross section 4023 downstream on the draft new FIRM map.  Prepare output tables and figures from hydraulic modeling in spreadsheet format to compare changes from the draft model to the new model.  Prepare certified topographic map with floodplain and floodway delineations including transitions back to the draft floodplain boundary.  Prepare annotated FIRM map showing changes in the floodplain.  Prepare project narrative summarizing the work done on the project.  Prepare MT-2 application form.  Submit MT-2 (LOMR) application to City of Bozeman and FEMA. Once the LOMR application has been submitted to the City of Bozeman and FEMA, we will be available to answer questions they have about the project and the LOMR application. We have assumed up to five separate teleconference calls with the City of Bozeman or FEMA to discuss the project. Assuming there will be review comments from FEMA, we have included one re-submittal of the revised LOMR application materials to address their comments. Phase 4 – Preliminary Wetland Review A preliminary wetland assessment will be conducted by Hyalite Environmental to determine whether impacts to wetlands would occur as a result of the proposed bridge design across Bozeman Creek. The remainder of this scope is based on the assumption that a full wetland delineation and associated permitting will not be required. If it is determined that a wetland delineation is needed, Sanderson Stewart can provide these services as additional services. Phase 5 - Geotechnical Analysis Soils and pavement design evaluations will be conducted and recommendations for the pathway surfacing section and bridge abutment design will be prepared by Terracon. Three soil borings will be drilled for this project: one on either side of Bozeman Creek for the bridge design and a third near the Kenyon Noble lumber 120 yard to determine the asphalt pavement section. Terracon will prepare a geotechnical report summarizing their findings that will be submitted with the preliminary plans. Phase 6 – Pathway Design Pathway design tasks for this phase of the project will include setting the horizontal and vertical alignment of the pathway and preparation of plan/profile sheets and cross-sections. It will also include design of the sidewalk extension along Wallace Avenue north of the railroad crossing for connection to the Story Mill Spur Trail. The pathway design phase will also include coordination with the Wallace Avenue improvements project currently underway by KLJ. As needed, the pathway design will include preparation of signing and striping plans, sidewalk, crosswalks and ADA accessibility ramp design, and design details. Public and private utilities will be shown for coordination and identification of conflicts. Phase 7 –Preliminary PS&E Submittal All of the above information will be compiled into a preliminary set of plans, specifications and opinion of probable cost for review by the City of Bozeman and GVLT. Plans will include plan/profile sheets, cross- sections, typical sections, signing and striping plans, an erosion control plan and details. Sanderson Stewart will prepare special provisions and a specifications manual including the templates for bid documents. The engineer’s opinion of probable cost including a 15% contingency will also be provided with this review submittal. Landscape and irrigation plans are not included in this scope of work. Phase 8 – Final PS&E Submittal Sanderson Stewart will address all review comments received from the City of Bozeman and prepare final plans, specifications and engineer’s opinion of probable cost. The final deliverable will include electronic copies of all submittal documents, as well as six hard copies. Phase 9 – Construction Bidding Sanderson Stewart will provide assistance throughout the construction bidding process. Anticipated tasks include the following:  Prepare bid advertisement  Prepare bid sets of plans and project manual for contractor pick up  Facilitate pre-bid meeting and distribute meeting minutes  Answer contractor questions and prepare bid addenda, as required  Attend bid opening, prepare bid tabulation and recommendation of award letter  Prepare six copies of contract documents, obtain bonding and insurance certificates, and route contracts for execution by all parties Phase 10 – Construction Administration and Observation Sanderson Stewart will provide construction administration and observation services throughout the duration of construction. Anticipated tasks include:  Facilitate pre-construction meeting and distribute meeting minutes  Shop drawing review  Construction observation (anticipated to be part-time for a 30-day construction contract focused primarily on milestone tasks) 121  Construction testing coordination and review. Testing will be completed by a qualified sub-consultant and is anticipated to include: concrete strength, air content and slump; embankment, trench backfill, and gravel and pavement densities; aggregate gradations; plant mix strength, flow and asphalt content.  Process pay applications and change orders  Substantial completion walkthrough and punch list, verify completion  Prepare as-built drawings  Two-year warranty inspection and punch list The Scope of Work for this project does not include:  Landscape and irrigation plans.  SWPPP permit application/administration.  LOMR based on the current effective floodplain maps.  Additional cross sections or hydraulic modeling that may be required to tie-in to the draft floodplain maps upstream of cross section L (4766) upstream and cross section 4023 downstream.  Individual permit from the Army Corps for the 404 permit if disturbance of wetlands is greater 0.1 acres.  Cash fees for review and applications (by Client direct to agencies). The estimated LOMR application fee to FEMA is $8,250.  Full wetland delineation, permit applications and mitigation plan.  Construction staking.  Other items not specifically listed in Phases 1 through 10 above.
