HomeMy WebLinkAbout1980-05-28 - ~ 23 Bozeman, Montana May 28, 1980 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, May 28, 1980, 1:15 o'clock p.m. Present were Commissioner Vollmer, Commis- sioner Stiff, Commissioner Swanson, Commissioner Mathre, City Manager Gesko, City Attorney I Planalp, and the Clerk. Commissioner Mathre opened the meeting with a prayer whereupon the minutes of the regu- lar meeting held on Wednesday, May 21, 1980 were approved as submitted. Open Bids -- Bituminous Plant Mix This was the time and place set for opening bids for 4,500 tons of bituminous plant mix material to be used for street maintenance and reconstruction and to be paid out of Gas Tax HB-254 Funds. Affidavit of pUblication of "Notice to Bidders" was presented. It was moved by Commissioner Mathre, seconded by Commissioner Stiff, that the bids be opened and read. The motion was carried by the fOllowing Aye and No vote: those voting Aye being Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, Commissioner Swanson; those voting No, ,none. The fOllowing bid was then opened and read: Pioneer Ready Mix - Bozeman $66,000.00 It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the bid of Pioneer Ready Mix, it being the only bid submitted, the one week interval be waived, and Pioneer Ready Mix be awarded the bid for 4,500 tons of bituminous plant mix material at a total cost of $66,000.00. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer; those voting No, none. Public Hearing - Commission Resolution No. 2185, SID 599, paving Bomont Center - Commission Resolution No. 2194, Creating SID 599, Paving Bornont Center I This was the time and place set in Commission Resolution No. 2185, to hear protests to the creation of Special Improvement District NO. 599, paving Bomont Subdivision. Affidavit of publication of Notice and the Clerk's mailing certificate stating all prop- erty owners had been notified as required by law were presented. There were no written protests on file and no one appeared to protest verbally. The Acting Mayor declared the hearing closed. There being no objections to the creation of the district, it was moved by Commissioner Swan- son, seconded by Commissioner Mathre, that the one week waiting period be waived. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff~ those VOting No, none. Commission Resolution No. 2194, creating SID No. 599, paving Bomont Subdivision, as pre- pared by the City Attorney, was presented, entitled: COMMISSION RESOLUTION NO. 2194 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA TO CREATE A SPECIAL IMPROVEMENT DISTRICT NO. 599 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF THE ASPHALTIC CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND GUTTERS, STORM DRAINS AND NECESSARY APPURTENANCES THERETO ON BOND STREET, GOLD AVENUE AND BRYANT STREET ON BOMONT CENTER AND INDUSTRIAL PROPERTIES SUBDIVISIONS IN THE CITY OF BOZEMAN. I It was moved by Commissioner Mathre, seconded by Commissioner Stiff, that Commission Reso- lution No. 2194, creating SID No. 599, be passed and adopted. Commission Resolution No. 2195, creating SID No. 605, paving Graf's First Addition, as prepared by the City Attorney, was presented, entitled: COMMISSION RESOLUTION NO. 2195 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE- MENT DISTRICT NO. 605 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF AN ASPHALTIC-CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND GUTTERS, STORM DRAINS AND NECESSARY APPURTENANCES THERETO ON KENYON, BAXTER, CHAMBER AND O'CONNELL DRIVES, ALL IN GRAF'S FIRST ADDITION TO THE CITY OF BOZEMAN. It was moved by Commissioner Swanson, seconded by Commissioner ~1athre, that Commission Resolution No. 2195, creating SID No. 605, be passed and adopted. Waiver of Protest to creation - Valley Unit SID's A waiver of protest to the creation of the Special Improvement Districts for the Valley Unit Subdivision (Virgil & Phyllis Jahnke) was presented. This involves a tract of land located in the Southeast Quarter and Northeast Quarter, T2S, R5E, Section 10, M.P.M., Gallatin County, Montana, known and described as the "Valley Unit Subdivision". I The Commission acknowledged receipt of the Waiver of Protest to the creation of the Special Improvement Districts for the Valley Unit Subdivision and directed the City staff to come in with a recommendation. Preliminary Plat of the Amended Plat of Block "A" Graf's Second Subdivision One individual objected to the preliminary plat of Block "A" of Graf's Second Subdivision at the Zoning Commission hearing. The City Manager advised the Commission that the individual who had objected and indicated the desire to appear at the City Commission meeting was not present. Therefore, it was not necessary for the Commission to take any action. Bid - Sale of one 1961 Howe Two Stage 1000 gallon pump truck (Fire Department) This was the time and place set to sell one 1961 Howe Two Stage 1000 Gallon Pumper VCO 196 International 549 Fire Department Engine. Affidavit of pUblication of "Notice of Sale" of the truck was presented. The Bid of Sula Rural Volunteer Fire Department, Sula, Montana in the amount of $15,000.00, was presented. It was moved by Commissioner Mathre, seconded by Commissioner Stiff, that the bid be referred to the staff for evaluation and a recommendation on Wednesday, June 4, 1980. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Mathre, Commis- sioner Vollmer, Commissioner Stiff, Commissioner Swanson; those voting No, none. Commission Resolution No. 2193 - SID 599 - rescribin form and terms and covenants Awarding I sale of 250,000.00 bonds Commission Resolution No. 2193 awarding sale of $250,000. for Special Improvement District No. 599 bonds, and prescribing their form and terms and covenants of the City for the security of the holders thereof was presented. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission approve Commission Resolution No. 2193. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Commissioner Vollmer; those voting No, none. ---- --------~-- - 25 Easement and Right of Way Agreement - Ronald Milledge and Neal Ganser An Easement and Right of Way Agreement by and between Ronald Milledge and the City of Bozeman, and Neal Ganser and the City of Bozeman, for the purpose of installing, operating, using, repairing, replacing, maintaining, and removing said asphaltic pavement and appur- tenances and for such other rights of access and incidental rights as are hereinafter des- I cribed to serve various properties located within the northeast portion of the City of Bozeman, was presented. Upon concurrence of the City Manager, it was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the easement and right-of-way Agreements, having been executed by Ronald Milledge and Neal Ganser, be approved and the Acting Mayor and Clerk of the City Commis- sion be authorized and directed to sign for the City. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, and Commissioner Stiff; those voting No, none. Application for Kennel license - Mrs. William Stewart - 119 E. Dickerson The City Manager presented an application from Mrs. William Stewart, 119 E. Dickerson, along with the appropriate fee for a kennel license. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission concur in the recommendation of the Police Chief, also concurred in by the City Manager and approve the kennel license application as presented. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Commissioner Vollmer; those voting No, none. Request - Annual Sweet Pea Parade - August 7, 1980 A letter received from Bill Neff, Parade Coordinator, requesting permission to conduct the Sweet Pea Parade on August 7, 1980, was presented. It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission approve the Annual Sweet Pea Parade. The motion was carried by the following Aye and No vote: I those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer, and Commissioner Stiff; those voting No, none. The Commission recommended that the parade fee be taken under advisement. Landfill Discussion The City Manager made a short report on the landfill study. He advised the Commission that he met with the Hebgen area and the Logan Landfill personnel. He also stated a number of people met with the City and County Commissioners of Park County and discussed how both Park and Gallatin County might become involved. Fire/Arson Detection School - Emmitsburg, Maryland - June 16-20, 1980 A Fire/Arson Detection School is scheduled to be held in Emmitsburg, Maryland on June 16-20, 1980, and First Class Fireman Gordon Duntsch has been accepted to attend the school. All expenses will be paid by the Academy except for the $60.00 meal fee. FOllowing discussion, it was moved by Commissioner Mathre, seconded by Commissioner Stiff, that First Class Gordon Duntsch be granted authority to attend the National Fire Academy Fire/ Arson Detection School. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Mathre, Commissioner Vollmer, Commissioner Stiff, and Commissioner Swanson; those voting No, none. Claims The payroll claims and the general claims for the month of May, 1980 were presented. The I City Manager had checked the claims and found them to be true and lawful claims against the City of Bozeman and recommended they be approved and the Director of Finance be instructed to issue warrants in payment. It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the claims be approved. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, and Commissioner Vollmer; those voting No, none. .. 2'6! Report - Director of Public Service The City Manager commented on the report of the Director of Public Service and recommended it be accepted and ordered filed. It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the report of the Director of Public Service be accepted and ordered filed. The motion was carried by the fOllowing Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner I Mathre, Commissioner Vollmer, and Commissioner Stiff; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Mathre, seconded by Commissioner Stiff, that the Commission meeting be adjourned.
