The Commission of the City of Bozeman met in regular session in the Commission
Room, Municipal Building, December 30,1981, at 1:15 p.m. Present were Mayor MacNab, I
Commissioner Stiff, Commissioner Vollmer, Commissioner Swanson, Commissioner Mathre, City
Manager Evans, Assistant City Manager Barrick, City Attorney Planalp and the Clerk.
The meeting was opened with the Pledge of Allegiance and a prayer by Commissioner
Mathre.
The minutes of the regular meeting of December 9, 1981, were approved as submitted;
and the minutes of the regular meeting of December 22, 1981, were approved as corrected.
Ordinance No. 1073 - Zone Code Amendment - 18.84 - Screening, landscapin , off-street
parking lots approved anuary 18, 1980
City Manager Evans presented Ordinance No. 1073, as prepared by the City Attorney,

Commission adopt Ordinance No. 1073, amending Section 18.84.040 of the Bozeman Municipal
Code to provide greater flexibility for screening and landscaping for the off-street paving

Ordinance No. 1091 - Amendment to Traffic Ordinance
City Manager Evans presented Ordinance No. 1091, as prepared by the City Attorney,
entitled:

AN ORDINANCE AMENDING SECTION 11.04.815, SCHEDULE VI AND SECTION
11.04.820, SCHEDULE VII OF THE TRAFFIC ORDINANCE OF THE BOZEMAN I
MUNICIPAL CODE AND REPEALING ALL ORDINANCES AND PARTS OF ORDI-
NANCES IN CONFLICT HEREWITH.
Assistant City Manager Barrick stated that these amendments to the traffic ordinance
are the result of discussions and decisions made at the Commission meeting held on December
9,1981.
It was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the
Commission adopt Ordinance No. 1091, amending Section 11.04.815, Schedule VI and Section
11.04.820, Schedule VII of the Traffic Ordinance. The motion carried by the following Aye

City Manager Evans stated that there seem to be several establishments that have
caused problems for the City as well as residents in the area. He feels that bar owners
have a responsibility to the community, as well as having the privilege to sell alcoholic
beve rages. He suggested that the City Commission may have to adopt a solution with some
type of leverage for this type of problem.
Mayor MacNab noted that problems created by certain bars in the city have been dis-
cussed the past several years. He also noted that these bar owners have been sent letters
stating the City's concerns. The Mayor stated that a letter could be sent with the license
renewals, and that the license could be suspended through the operation of the business
establishment being a public nuisance.
I Commissioner Stiff noted that the matter is not simply one of being a public nuisance,
especially when a man killed himself with a gun during the past week in one of Bozeman's
establ ishments. He stated that this incident is merely indicative of how poorly some of the
bars are policing themselves. This also shows how the conditions in the various bars in
Bozeman are deteriorating.
Mayor MacNab asked if the Fire Marshall has made spot checks to see if these estab-
lishments are filled beyond capacity.
City Manager Evans noted that the City has reason to believe that some of the estab-
lishments are over capacity. He stated that a contributing factor is the lowering of the legal
age for drinking and the type of community that Bozeman is.
City Attorney Planalp researched the Bozeman Municipal Code and quoted a portion of
Section 4.04.190. He suggested that the City send a letter to the owners of those establish-
ments about which the City Staff has concerns, stating that the granting of the renewal of
the liquor license is with the recognition that problems exist within the establishment and
with the understanding that the City is in no way waiving its rights to suspend the license.
The City Attorney further noted that, if a license is to be suspended, a letter must be sent
I to the owner of the establishment, letting him know of the problem and ordering him to
appear before the City Commission to show cause why the license should not be suspended.
City Manager Evans stated that he would consult the City Attorney prior to sending
letters to any of the bar establishment owners.
It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the
Commission approve the applications for beer, wine and liquor licenses for calendar year

1982, and that the City Staff be directed to send letters to those establishments about which
numerous complaints have been received. The motion carried by the Aye and No vote:
those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer,

Authorize Mayor to sign - Change Order No. 2 - Sanitary sewer improvements, Schedule III I
- Johnston I::xcavatmg, I nc. - No change in contract price, extends contract period for 12
calendar days
The City Manager presented to the Commission Change Order No. 2 for Sanitary
Sewer Improvements. Schedule III, for Johnston Excavating, Inc. with no change to contract
price, but extending the contract period for 12 calendar days.
It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the
Commission authorize the Mayor to sign Change Order No. 2 for Sanitary Sewer Improvements,
Schedule II, for Johnston Excavating, Inc, with no change to the contract price, but ex-
tending the contract period for 12 calendar days. The motion carried by the following Aye
and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner
Vollmer, Commissioner Stiff and Mayor MacNab; those voting No, none.
Reappointments
Mayor MacNab announced his appointments and reappointments to the various boards
as follows:

Claims
Claims for the past two weeks were presented. The City Manager had checked the
claims and found them to be true and correct and recommended that the Director of Finance I
be instructed to issue warrants in payment thereof.

claims be approved as submitted. The motion carried by the following Aye and No vote:

Pledged Securities
In compliance with the provisions of Sections 7-6-201 to 7-6-212, M.C.A., Mayor
MacNab and Commissioner Vollmer had examined the receipts of Depository Bonds and
Securities held by the Director of Finance as security for City funds deposited in Bozeman
banks. The Depository Bonds and Securities were found to be in order.

SID Interest Payments Procedure
City Manager Evans requested that the City Commission authorize the City Manager
and Director of Finance to: (1) register warrants against the SID Revolving Fund; and/or
(2) make such transfers of monies to the SID Revolving Fund as deemed feasible and
necessary within funding capabilities and limitations. The City Attorney has stated that the
City has an obligation to pay the interest on the bonds if at all possible. The use of one or
both of the above- suggested methods would provide the means to pay as much of the interest
as possible.
It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the
Commission authorize the City Manager and Director of Finance to: (1) register warrants
against the SID Revolving Fund; and/or (2) make such transfers of monies to the SID I
Revolving Fund as deemed feasible and necessary within funding capabilities and limitations.

Mr. Ray Myers - re water pipe along Sourdough Road
Mr. Ray Myers stated that in the late 1950's, the City put in a water pipeline along
Sou rdoug h Road. However, that pipeline was placed without an easement. He noted that
the City is once again beginning to dig along Sourdough Road. He stated that he and the
neighbors want cooperation from the City on this process, and they will cooperate with the
City.
City Engineer Arthur Van't Hul stated that the digging which is taking place now is
to check the pipeline which presently exists. When the specifications are drawn for the in-
stallation of a new water pipeline, the specifications will include provisions for Sourdough
Road and the condition in which it is left.
City Manager Evans stated that the City Staff is willing to meet with Mr. Myers and I
his neighbors to reach a mutually agreeable solution to the problems involved with Sourdough
Road.

of Libraries for November 1981 appeared to be in order and recommended that it be accepted
and ordered filed.

Information Item - Montana League of Cities and Towns District meeting
City Manager Evans stated that the Montana League of Cities and Towns is holding a
District No. 10 training session for newly elected officials on Friday, January 15, 1982.
This meeting is to be held in the Commission Room, in the City Hall Building in Bozeman,
beginning at 10:00 a.m. The City Manager encouraged all interested persons to attend this
meeting.
