I~~ t L MINUTES OF THE MEETING OF THE CITY COMMISSION BOZEMAN, MONTANA December 16, 1981 *********************** The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, December 16,1981, at 1:15 p.m. Present were Mayor MacNab, Commissioner I Vollmer, Commissioner Stiff, Commissioner Swanson, Commissioner Mathre, City Manager Evans, Assistant City Manager Barrick, City Attorney Planalp and the Clerk. The meeting was opened with the Pledge of Allegiance and a prayer by Commissioner Stiff. The minutes of the regular meeting of December 9, 1981, will be submitted at next week's meeting for action. Decision - Conditional Use Permit - Bryan Curran - Convenience Store This was the time and place set for a decision on the request on behalf of Bryan Curran for a Conditional Use Permit for adding a convenience store to the Town Pump. The proposed development is located on Tract 5 in the northwest corner of the SW! of the SE! of Section 11, T2S, R5E, P.M.M., Bozeman, Gallatin County, Montana. It is more commonly known as 2607 West Main Street. The site is approximately 1.6 acres in size and is currently zoned B-2-T (Highway Commercial). City Manager Evans recommended conditional approval of the request for a Conditional I Use Permit. Commissioner Vollmer stated that if something is grandfathered, it is pretty much ac- cepted. He doesn't feel that it is fair to place a condition on an item which has been grand- fathered. He further asked if the City Commission can legally place a three-year limit on an item which has been grandfathered. City Manager Evans stated that the appl icant has the right to accept or not accept the Conditional Use Permit with the established conditions. Commissioner Mathre asked if the City Commission could legally place a time limit on the mobile home, since it is grandfathered. City Attorney Planalp stated that as long as the use remains the same, the mobile home is g rand fathered forever. However, if a change in use is proposed, it is possible to place a time limit upon the mobile home. He noted that the use is being changed since one present use is being expanded, and the other existing use is being removed. I t was moved by Commissioner Stiff, seconded by Commissioner Swanson, that the Commission approve the request for a Conditional Use Permit on behalf of Bryan Curran with the following conditions: I 1. That the project be reviewed and approved by the Department of Health prior to occupancy of the building. 2. That the paving and drainage plan be reviewed and approved by the City Engineer. Access must be approved by the City Engineer and the Montana State Highway Department 3. That the applicant provide the following information on the final site plan: 183 (a) A snow removal and storage area; (b) A detailed drawing of the screening for the dumpster area; and (c) A detai led drawing of the landscape protection devices to be utilized for protection of the non paved areas from unwanted vehicular traffic. 4. Three (3) copies of a final site plan containing all conditions corrections and modifications recommended and approved by the I City Commission shall be reviewed and approved by the Planning Director prior to the issuance of a building permit for the project. One (1) signed copy shall be retained by the Planning Director; one (1) signed copy retained by the Building Department; and one (1) signed copy retained by the applicant. 5. All on-site improvements (i.e., paving, landscaping, etc.) shall be completed within eighteen (18) months of approval of the Conditional Use Permit and as shown on the approved final site plan. 6. The Conditional Use Permit shall be valid for a period of only eighteen (18) months following institution of the use and shall be submitted to the City Commission for renewal as specified on the Conditional Use Permit. Failure of the applicant to satisfy all conditions within the designated time period may be grounds for terminating the Conditional Use Permit. If all required conditions have been satisfied, the permit shall be permanently renewed. 7. That the mobi Ie home presently located on the site be screened from public view-- east, north and south--by means of a solid fence not less than eight (8) feet in height. 8. That the mobi Ie home presently located on the site may not be replaced by another mobile home, and it shall be removed not later than three (3) years from the date of approval of this Conditional Use by the City Commission. 9. That the applicant for this Conditional Use Permit shall submit a statement, in writing, agreeing to all of the conditions imposed by the City Commission. Such statement must be submitted prior to the issuance of any permit, and shall be retained on file in the I Bui Iding Division. Commissioner Swanson noted that the entire change of the land use and bui Idings should be considered. Commissioner Stiff asked if a longer period for removal of the mobi Ie home would be better. He also noted that if the mobile home is allowed to remain until it is no longer ten- able, it would become a matter of judgment, and the City Commission should be concerned with upg rading the community. The motion was then amended by Commissioner Stiff, seconded by Commissioner Swanson, as follows: 1. Public hearing - Commission Resolution No. 2368 - Final Assessment, SID 599 for final I passage - Paving - Bomont Center and Industrial Properties - $239,772.93 This was the time and place set for a public hearing on Commission Resolution No. 2368, entitled: COMMISSION RESOLUTION NO. 2368 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 599 IN THE CITY OF BOZEMAN, COUNTY OF GALLA TI N, STATE OF MONT ANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 599. Public hearing - Commission Resolution No. 2372 - Final Assessment, SID 616 for final passage - Paving - Koch, 20th to 23rd - $81,622.62 This was the time and place set for a public hearing on Commission Resolution No. 2372, entitled: COMMISSION RESOLUTION NO. 2372 I A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 616 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 616. Mayor MacNab opened the public hearing. 187 Mr. Maurice Klabunde asked if his property is involved in this Special Improvement District. Following review of the legal description, it was determined that his property is within the boundaries of this Special Improvement District. Mr. Joseph Sabol, Attorney at Law, stated that he would be speaking for more than just this Special Improvement District. He is representing those owners of record and those I who are purchasing on contracts for deed for Special Improvement District Nos. 616, 621, 622, 623, 624, 625, 627, 629 and 630. He noted that all comments will be made during the public hearing for Special Improvement District 616, but will be directed to the other districts as above-enumerated. Mr. Sabol noted that he has discussed most of his comments with various members of the City Staff. He noted that his comments address some issues that are minor and some that are major. Mr. Sabol noted that the purpose of these public hearings is to allow owners of prop- erties within the Special Improvement Districts an opportunity to protest the final adoption of the Commission Resolutions which were provisionally adopted at the regular Commission meeting held on December 2, 1981. Mr. Sabol stated that he would speak to deficiencies in the process which has been followed in the procedures. Mr. Sabol noted that the State Code states that the Clerk of the Commission will publish a Notice, stating that the Commission Resolution is available for public inspection for a period of five days. The Notice was published on December 9, 1981, which allowed only 4t days for inspection. Mr. Sabol also noted that all information should be available at the time I of publ ication. On December 10, he requested to see copies of Commission Resolution Nos. 2372, 2374, 2375, 2376, 2377, 2378, 2380, 2381 and 2382, which levy assessments against the properties in the above-enumerated Special Improvement Districts. At that time, Schedule "A" was not attached. He asked for copies of Schedule "A II for the above-enumerated Commission Resolutions as soon as same were prepared. He noted that at the beginning of this Commis- sion meeting, he saw a copy of the Schedule "A" and noted that the amount of the assessment is not included in the listing. Mr. Sabol noted that this is a material defect in the Commis- sion Resolution. Mr. Sabol noted that those Commission Resolutions levying an estimated amount used the amount of the bond sale. He noted that this practice appears to be incorrect and is not allowed by State Statutes. He feels that the actual amount of expenditures to date should be used in the Commission Resolutions levying an estimated amount. He noted that the State Statutes provide for the reassessment of a Special Improvement District so that the governing body may correct any errors which it may have made. Mr. Sabol stated that he, therefore, objects to any and all Commission Resolutions which levy an estimated assessment based upon the amount of the bond sale. I Mr. Sabol once again stated that he is opposed to levying assessments based upon the amount of the bond sale. He noted that SID Nos. 624, 625, 629 and 630 have all been finalized. He stated that the City should be able to use the correct figure when levying the assessments, rather than using the amount of the bond sale. He further noted that the work has been completed and all bills paid for SID No. 622. He noted that the bond sale was for $315,000.00 and the actual costs were approximately $329,000.00, with the balance being paid 1 n~' H. '~,'" .! from a Certificate of Deposit which the City had requested for the express purpose of covering the extra costs incurred. He stated that the costs for SID No. 622 had been finalized on December 10, 1981, so using the amount of the bond sale is incorrect. Mr. Sabol noted that the assessments being considered in the public hearings today will be due and payable in the future. He noted that the work will be completed on SID Nos. 623, 624 and 625 during calendar year 1982. Mr. Sabol stated that the Commission should I hold the public hearings prior to November 30 of each year. He noted the process which is now being followed by the City leads to deficiencies and discrepancies. Mr. Joe Sabol then noted the provisions for considering incidental expenses as costs against Special I mprovement Districts. He noted that SID No. 622 is completed, but there is no tabulation of incidental expenses. He noted that one can review the worksheet for the Special I mprovement District and cannot tell the amount of the incidental costs. He noted that no tabulation of the incidental costs is kept, and he objects to the charging of incidental costs unless and until a tabulation of all costs is kept. Commissioner Swanson asked Mr. Sabol what the ultimate goal of this presentation is. Commissioner Stiff stated he feels that the points which have been presented are simply housekeeping items. Mr. Sabol stated that the matter is being heard because this is a public hearing at which one may speak in support of or in opposition to the final passage of the various Com- mission Resolutions which were provisionally passed on December 2, 1981. He noted that the problems which he has noted are far more than housekeeping details. I Commissioner Stiff stated he thought that Mr. Sabol and the City Attorney had dis- cussed the matter fully and that the matter was now before the Commission with joint con- currence of the two attorneys. Mr. Sabol stated that the matter had been discussed to a point. He stated that he has also asked the City Staff questions. However, he feels he has no choice but to come before the City Commission, even if some of the matters have been handled by the City Staff. He noted that the line between minor and major deficiencies is very fine. Mr. Sabol did state that no doubt the Special Improvement Districts are one of the most burdensome problems which the City has. However, the City should decide that from this time forward, it wi II follow the Special Improvement District process, and do it right. Commissioner Swanson suggested that the remainder of the public hearings be opened and continued to allow the City Staff time to review the Commission Resolutions and see if they follow the letter of the law, and to allow time to correct any discrepancies. Mr. Joe Sabol then addressed the keeping of a record of expenses for each Special Improvement District by the City Engineer. He noted that the expenses are to be certified by the City Engineer to the City Clerk. Mr. Sabol noted that on those Special Improvement I Districts which were being assessed a preliminary cost, no costs have been certified by the City Engineer. He noted that the amounts for the four Special Improvement Districts which have been finalized have been certified to the City Clerk. Mr. Sabol noted that the State Code provides that a record of costs must be kept in the City Engineer's office, including incidental costs. 189 Mr. Sabol noted that the City assesses a 6 percent charge for administrative, en- gineering and legal costs on all Special Improvement Districts. Mr. Sabol stated that it is no surprise that the State auditors, in their audit of Fiscal Years 1977 and 1978; Veltkamp, Dore and Holmes and Turner, in their audit of Fiscal Year 1979; and Coopers and Lybrand in their audit of Fiscal Year 1980, all made a point of stating that the City is using an estimate to I determine the City's costs, which cannot be done. Only the actual costs can be charged. Mr. Sabol noted that each audit contained a recommendation that the 6 percent fee be re- considered because it is not objectively verifiable. He noted that it is extremely difficult to estimate the cost of sending out bills for the next twenty years on each of the Special Improve- ment Districts. Mr. Sabol noted that Veltkamp, Dore and Holmes and Turner suggested a breakdown of the 6 percent fee into 3 percent for engineering, 1 percent for legal fees and 2 percent for administrative costs. Mr. Sabol noted that the 6 percent figure is one which has been arrived at over the years. Mr. Sabol stated that this should be actual costs, not an estimate. He noted that this would be difficult to do since records don't exist to support these charges. Mr. Sabol stated that he feels Commission Resolution No. 2366, adopted on November 25, 1981, attempts to correct some of the problems which exist with the administrative charge on Special Improvement Districts. However, the 6 percent does not seem to be consistent with administrative costs. Mr. Sabol noted that on SID No. 622, the 6 percent administrative charge is based on I the amount of the bond sale, which is approximately $14,000.00 less than the actual costs for the district. Mr. Sabol stated that there is no way to verify the fact that the administrative charges may have caused the overrun on this Special Improvement District. Mr. Sabol requested that the Commission consider postponing the final adoption of the Commission Resolutions for SID Nos. 616, 621, 622, 623, 624, 625, 627, 629 and 630 until all problems can be corrected and it can be done in a proper manner. Mr. Sabol stated that he hopes the comments are taken in the manner in which they are intended. He said there is no point in going back to 1976 to correct errors, but from this point forward, and on these Commission Resolutions, the City can do no less than to do them properly. Commissioner Stiff asked when the first payment on the above-referenced Special Im- provement Districts is due. Director of Finance Amy Swan stated that the first payment on the bonds is due on January 1, 1982. The first payment on the Special Improvement Districts will be due and payable on November 30, 1982. Commissioner Swanson asked if action in December or January would make any differ- I ence. Director of Finance Swan stated that it would make no difference, as these Special Improvement Districts will not be billed until November 1, 1982. Mr. Joe Sabol stated that the City now has problems to correct. Time is available now to correct these problems before the assessments are due in 1982. He also suggested that the 1 q'-'; .' t,.~ City wait until all of the work is completed on these Special Improvement Districts before the final assessment is made. City Attorney Planalp noted that the exact procedure for the assessment of SID's that has been discussed is based on actual costs. He noted that on a Special I mprovement District to be completed in 1982, a hearing is held on the estimated assessment. This is based on the amount of the bond sale, which is the last known figure. The following year, basically the I same hearing is held, after the work is completed and is based upon the actual final cost of the Special I mprovement District. Director of Finance Swan stated that she understands when the City cannot assess over the amount listed in the Commission Resolution which creates the Special Improvement District, the overrun then comes from the City's General Fund. This overrun, then, actually is deducted from the 6 percent administrative charge against that Special Improvement District. Ms. Swan also noted that it has been the City's policy to wait ninety days after receiving the City Engineer's certification of the final costs for a Special Improvement District before finalizing the assessment. Commissioner Stiff asked if the problems could be resolved so that the present City Commission could act upon these Commission Resolutions at one of its final two meetings. Director of Finance Swan noted that time would be a prohibiting factor. She stated that most of the actual costs have been included, except for the time that she and the City Engineer have accrued. She stated that she would like a month in which to complete these calculations. I City Manager Evans stated that he sees no problem with doing things right. He stated that Bozeman is the sixth or seventh largest city in the state, and is approaching a city four times its size in the number of Special Improvement Districts outstanding. He stated that this large number of SI D's has caused an overload on the administrative capabilities of the City. He noted that Special Improvement Districts are probably the biggest problem for the City and wi I( continue to be. The City Manager noted that the creation of Special Improvement Districts will be a long process in the future because everything will be done to the letter of the law. He further noted that the City is the agent between the landowners and the bond buyers. He stated that the way to determine the incidental expenditures is to do a cost study. The City Manager stated he would recommend that these publ ic hearings be continued until such time as the City Staff is comfortable with the Commission Resolutions to be acted upon. City Manager Evans further noted that the City may possibly get behind on paying the bonds and coupons. Some of them become due and payable on January 1, 1982; however, if the City does not have the money, they wi II not be pa id. He noted that the reason for I levying assessments on the bond amount is to provide monies with which to pay the bonds and coupons on the various Special Improvement Districts as they become due and payable. Mayor MacNab requested that the minutes reflect that the comments made by Mr. Joe Sabol have been appl ied to this Commission Resolution and to each of the Commission Resolu- tions which follow. Status report - Downtown Development Association - Urban Renewal Plan Mr. Tim Fitzgerald presented an update of the Urban Renewal Plan. He stated that the Downtown Development Association had conducted an informational meeting on Tuesday I evening which was attended by approximately 75 people, including three Commissioners and two Commissioners-Elect. Mr. Fitzgerald feels that there are fears and doubts remaining about the Urban Renewal Plan. Commissioner Stiff felt that the information meeting was very good. He stated that it had answered some of the questions which he had about the Plan. Commissioner Stiff then asked Mr. Fitzgerald to give a brief summation of what would happen during the first eighteen months if the Plan is adopted. Mr. Fitzgerald stated that application for Community Development Block Grant monies could be made immediately, which would possibly enable the beginning of some renovation. He noted that the appl ication would probably contain a certain percentage of the funds to be used for residential purposes. With an approval Urban Renewal Plan, the City would have a better chance of obtaining a grant of substantial amount. These monies would enable the project to get underway prior to the receipt of tax increment monies. Commissioner Vollmer noted that the people in the residential area are concerned about the extended area involved. Mr. Fitzgerald stated that one of the blight conditions involves traffic flow. He stated I the area was widened so that this problem area could be solved, which could not be done within the original boundaries. He noted that any SID's involved would apply only to those property owners immediately affected by the SI D, just as with any other area of the City. He also noted that if an SID is required, tax increment dollars could be used to pay the assessments for low- and moderate-income people within the area. 197 Commissioner Mathre asked how the Community Development Block Grant funds would be used. Mr. Fitzgerald stated that the CDBG funds could be used for remodeling existing structures, similar to the programs the City has had in the past. He noted that the CDBG funds could also be used for site preparation for a new structure, but the property owners I would have to construct the new building with their own funds. Commissioner Mathre asked how much second story space is vacant at the present time. Mr. Fitzgerald estimated that approximately 25 percent of the second story space is vacant, and could be remodeled for either office space or residential areas. He also noted that the monies could be an enticement for property owners to bring second story apartments up to standard. Commissioner Mathre asked if the Downtown Development Association plans to contact the owners of those bui Idings listed as substandard. Mr. Fitzgerald stated that this is a good first step. Commissioner Stiff quoted a statement which was made at the National League of Cities Congress of Cities held in Detroit, in which a speaker stated that a city is usually as good as its downtown core. He noted that the speaker further stated that it is incumbent upon cities to maintain as much as possible because the people who hold it together are invested in the downtown. The outlying areas siphon funds. Commissioner Swanson once again reiterated his concern about the expansion of the I powers of eminent domain. He was not convinced that these powers are right. Mayor MacNab stated that he is proposing an expansion of the Commission table for next week's public hearing so that representatives of the Downtown Development Association can be available to answer questions. Discussion of meeting site for Commission Meeting on December 22, 1981 - public hearing on Urban Renewal District Mayor MacNab requested that the agenda for next week's Commission meeting be kept to a minimum so that the majority of the meeting can be devoted to the Urban Renewal Plan, as proposed by the Downtown Development Association. City Manager Evans stated that he anticipates a larger crowd than the Commission Room will contain and asked if the City Staff should attempt to find another site for the meeting. Mr. Fitzgerald stated that he feels it would be better to have a larger facility for the public hearing. City Attorney Planalp stated that the public hearing notice states that the hearing will I be conducted in the Commission Room in the City Hall Bui Iding. Mr. Fitzgerald asked if an alternate site could be reserved, and the meeting moved if the crowd is too large for the Commission Room. Mayor MacNab stated that, with the holiday season, he would anticipate a large crowd, but not overflowing the Commission Room. Management Letter - Water and Sewer Audits I Commissioner Stiff stated that he has some thoughts about the Management Letter sub- mitted by Coopers and Lybrand on the Water and Sewer audits for Fiscal Year 1981. He stated that these could be addressed during the Commission meeting, or he could meet with the Director of Finance and City Manager and review the Letter. Mayor MacNab stated that he feels it would be better for each Commissioner to read and digest the Management Letter for themselves and then deal with the City Manager and Director of Finance on a one-to-one basis. Commissioner Vollmer noted that he thought the Management Letter was complimentary. Commissioner Mathre stated that she understands that some of the procedures listed are being carried out and said she would like to know which ones. Director of Finance Swan stated that she could address these procedures in a memo to the City Manager, which he could then pass on to the City Commission. Claims Claims for the past two weeks were presented. The City Manager had checked the I claims and found them to be true and correct and recommended that the Director of Finance be instructed to issue warrants in payment thereof.
