HomeMy WebLinkAbout1981-12-02 159 MINUTES OF THE MEETING OF THE CITY COMMISSION BOZEMAN, MONT ANA December 2, 1981 ********************** The Commission of the City of Bozeman met in regular session in the Commission Room, I Municipal Building, December 2, 1981, at 1: 15 p.m. Present were Mayor MacNab, Commissioner Vollmer, Commissioner Swanson, Commissioner Mathre, City Manager Evans, Assistant City Manager Barrick, City Attorney Planalp and the Clerk. Commissioner Stiff was excused in compliance with Section 7-3-4349, M.C.A. The meeting was opened with the Pledge of Allegiance and a prayer by Commissioner Mathre. The minutes of the regular meeting of November 25, 1981, were approved as corrected. Open bids - Provision of a paved parking area and removal of hedges at Battered Women's Network Shelter - CDBG monies This was the time and place set for the opening of bids for a paved parking area and removal of hedges at Battered Women's Network Shelter to be funded by CDBG monies. The affidavit of publication for the "Call for Bids" as advertised was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the bids be opened and read. The motion carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Swanson, Commissioner Mathre and I Mayor MacNab; those voting No, none. The following bids were then opened and read: Net Bid Big Sky Paving, Bozeman, Montana $1,890.00 H D Company, Bozeman, Montana $3,942.00 Long Construction Co., Inc., $2,640.00 Billings, Montana It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the bids be referred to Staff for review and a recommendation to be made prior to the end of the Commission meeting. The motion carried by the following Aye and No vote: those voting Aye being Commissioner Swanson, Commissioner Mathre, Commissioner Vollmer and Mayor MacNab; those voting No, none. Following review of the bids, Barbara Agocs presented the Staff recommendation that the bids be awarded to Big Sky Paving, Bozeman, Montana, in the amount of $1,890.00. It was moved by Commissioner Swanson, seconded by Commissioner Mathre, that the Commission accept the bid from Big Sky Paving, Bozeman, Montana, in the amount of $1,890.00. The motion carried by the following Aye and No vote: those voting Aye being Commissioner Swanson Commissioner Mathre, Commissioner Vollmer and Mayor MacNab; those I voting No, none. Public hearing - Conditional Use Permit - Donald Turner - Warehouse Construction - (to be continued ) This was the time and place set for a public hearing on the request on behalf of Donald Turner for a Conditional Use Permit for the construction of a building to be utilized 1 ~;i .,~ .."' ".' by three small businesses. The property in question is Lot 4 of the I ndustrial Properties, which is located in the Northern Planning Sector of the City. It is more commonly referred to as 1609 Gold Avenue which is approximately 150 feet south of the Bryant Street and Gold Avenue Intersection. The parcel is approximately 27,509 square feet in size and is currently vacant. The lots to the south and west are occupied by a warehouse and shop respectively, while the property to the north and east is vacant. The appl icant wishes to construct a I 6,000-square-foot building which will be occupied by a carpentry shop, electrical shop and a small manufacturing firm. All of these proposed uses are considered permitted uses within the M-I-T-4 -Zoning District. However, the "T" designation required that the applicant receive approval for a Conditional Use Permit. City Manager Evans stated that the Zoning Commission had continued this item and re- quested that this public hearing be continued to January 20, 1982. Mayor MacNab opened the public hearing. No one was present to speak in support of or in opposition to the request. Mayor MacNab continued the public hearing until January 20, 1982. Public hearing - Conditional Use Permit - Bryan Curran - Convenience Store This was the time and place set for a public hearing on the request on behalf of Bryan Curran for a Conditional Use Permit for adding a Convenience Store to the Town Pump. The proposed development is located on Tract 5 in the N. W. Corner of the SW! of the SEt of Section 11, T2S, R5E, P.M.M., Bozeman, Gallatin County, Montana. It is more commonly I known as 2607 West Main Street. The site is approximately 1.6 acres in size and is currently zoned B-2- T (Highway Commercial). Mayor MacNab opened the publ ic hearing. John Moss presented the Staff Report and stated that the Zoning Commission recom~ mended conditional approval. He noted that the Zoning Commission had concerns about the ingress and egress to the property, the general appearance of the property, and the quality of the drawings submitted. Commissioner Vollmer stated concern about the trai ler presently located on this proper- ty. John Moss explained that the trai ler was being used as an office for the gas station, and that after the store is bui It, it might be used as the manager's residence. Assistant City Manager Barrick stated that the trailer was under the grandfather clause. Commissioner Mathre stated concern about the septic tanks and asked whether they were being used. City Engineer Van1t Hul stated that the sewer is there now, but doesn't know if the I trailer has been changed from the septic tank to the City sewer line. The new building will be hooked up to it. Bryan Curran, Buffa 10 Homes, representing the petitioner, stated that they plan to screen the trailer with cedar fence and clean up the general site. They also plan to change 161 the canopy so that it matches the store. He also stated that the building is an energy effi- cient design. No one was present to speak in opposition to the request. Mayor MacNab closed the public hearing. Mayor MacNab stated that a decision will be forthcoming next week. I Public hearing - Zone Map Change - Dan Kamp - AS to B-2 This was the time and place set for a publ ic hearing on the request for a Zone Map Change from AS to B-2 on behalf of Dan Kamp. The parcel of land is located in the E! of Section 8, Township 2 South, Range 5 East, P.M.M., Bozeman, Gallatin County, Montana. It is more common Iy known as being situated between U. S. Highway #10 and Interstate 90, just west of Bozeman's eastern interchange. The tract in question is approximately 8.5 acres in size and is currently zoned as Agricultural Suburban (AS). It is located in the Burrup Annexation which was added to the City in 1979. Mayor MacNab opened the public hearing. Mike Money presented the staff report and stated that the Zoning Commission recom- mended approval of the application. Dan Kamp presented to the Commission a small map which expanded upon the requested Zone Map Change. Mr. Kamp also noted that this parcel of land is unique as its location relates to the freeway. He stated he would like to plan a use that would accentuate this I locat ion. Commissioner Mathre asked the Planning Staff if a "T" designation was discussed at the Zoning Commission meeting, since this parcel is located at an entrance to the City. Planning Director John Moss stated that the Zoning Commission did not discuss the possibility of attaching a liT" designation to this requested Zone Map Change. He further stated that, at the present time, the Planning Staff is reviewing and modifying the use of the "T" designation. No one was present to speak in opposition to the request. Mayor MacNab closed the public hearing. He stated a decision wi II be forthcoming in one week. Status report - Downtown Development Association - Urban Renewal Plan Tim Fitzgerald stated that they will have a narrative ready (excluding graphics) and a copy will be sent to the City by 1 :00 p.m. on Friday, December 4, 1981. Printing of the draft plan wi II be completed by Tuesday. He stated that this is a draft and is subject to review and change. He also noted that the Downtown Development Association plans to conduct I another public meeting on December 15,1981, at 7:00 p.m. in the Community Room of the Library. Commission Resolution No. 2367 - Finally approvin the Montana Bank Industrial Development Revenue Bond project and setting ecember 10, 1981, City Manager Evans presented Commission Resolution No. 2367, entitled: 1" '"', ',) L. COMMISSION RESOLUTION NO. 2367 RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CONFIRMING RESOLUTION NO. 2358 OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, APPROVING THE ISSUANCE AND SALE OF $3,000,000 AGGREGATE PRINCIPAL AMOUNT OF INDUSTRIAL DE- VELOPMENT REVENUE BONDS (BOZEMAN BANCORPORATION, INC. PROJECT) SERIES 1981 AND SETTING THE INTEREST RATE THEREON. Commissioner Swanson stated that he would abstain from voting on this matter, due to I his involvement in the sale of property to the Montana Bank. It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the Commission adopt Commission Resolution No. 2367, finally approving the Montana Bank Indus- trial Development Revenue Bond project and setting December 10, 1981, for closing of the bond purchase. The motion carried by the following Aye and No vote: those voting Aye being Commissioner Mathre, Commissioner Vollmer and Mayor MacNab; those voting No, none. Commissioner Swanson abstained. - City Manager Evans presented Commission Resolution No. 2368, entitled: COMMISSION RESOLUTION NO. 2368 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 599 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 599. City Manager Evans stated that this Resolution, along with the fourteen that follow, I set the annual assessment for each of the Special I mprovement Districts. The City Manager noted that the Commission should also establish December 16, 1981, as the date for public hearing on each of these Resolutions. This public hearing will allow the public an opportuni- ty to protest the assessment if they so desire. Commissioner Swanson questioned what would occur if a property owner1s protest were legitimate. City Manager Evans stated that the State Code provides a savings clause. Any pro- tests would not invalidate a Special Improvement District; the City Commission could adjust the assessment so that it is correct. It was moved by Commissioner Vollmer, seconded by Commissioner Swanson, that the Commission adopt Commission Resolution No. 2368, levying and assessing a final special assessment of taxes upon all the property in Special Improvement District No. 599, and set the public hearing date for December 16, 1981. City Manager Evans stated that the Library Board felt that insect screens are not necessary in an air conditioned building. The City Manager recommended that the Commission authorize the Mayor to sign this Change Order. City Manager Evans presented to the Commission a Certificate of Substantial Completion for the New Public Library from Martel Construction, Inc., notifying the City that the struc- ture has been completed in accordance with plans and specifications. This final acceptance does not relieve the contractor of responsibility of negligence or I faulty materials or workmanship within the standard period provided for by law. The contractor has furnished a performance bond to guarantee materials and workmanship for a one-year period to commence upon final acceptance. The City Manager recommended that the Commission authorize the Mayor to sign this Certificate of Substantial Completion. Request permission to travel - Don Stran and Art Van1t Hul with Wayne Dean of TD&H - I Seattle, ashington - to study water I tration plants and available systems - ecember 7-9, 1981 - City Manager Evans presented to the Commission a request on behalf of Don Strang and Arthur Van't Hul for permission to travel to Seattle, Washington, with Wayne Dean of TD&H to study water filtration plants and available systems on December 7-9, 1981. The City Manager felt that this trip would be very worthwhi Ie and recommended approval of the request. It was moved by Commissioner Mathre, seconded by Commissioner Vollmer, that the Commission approve the request on behalf of Don Strang and Arthur Van't Hul to travel to Seattle, Washington, to study water filtration plants and available systems on December 7-9, 1981 and, it being in the public interest, their expenses be paid out of the appropriate fund. To be raffled is a large afghan valued at $200.00. Acknowledge report - Police Court for October 1981 I City Manager Evans stated that the monthly report for the Police Court for October 1981 appeared to be in order and recommended that it be accepted.
