HomeMy WebLinkAbout16- Amendment 1 to Task Order 7 - DOWL - Streets and Utilities Land Agent ServicesAMENDMENT #1 TO TASK ORDER NUMBER 07 Issued under the authority of Professional Services Master Task Order Agreement between the City of Bozeman and DOWL for: Professional and technical services for the acquisition of right of way, easements and real property to allow for the construction of various street and utilities improvements within the City of Bozeman This Amendment to Task Order No. 7 is dated July 29, 2016 between City of Bozeman (City) and DOWL (Contractor). The following representatives have been designated for the work performed under this Task Order: City: Bob Murray, P.E. Contractor: Tony Gaddo, P.E. SCOPE OF WORK: The scope of work for Task Order No. 7 -Amendment #I is detailed in the attached Project Scope of Services. COMPENSATION: Contractor shall be reimbursed on a lump sum basis for the additional services with the original budget increased by $2,625.00, to a revised total cost of $46,324.00. The total cost for Task Order No. 7 - Amendment #1 is detailed in the attached Project Cost Estimate. Contractor shall invoice no more often than monthly for services provided in the prior month. The provisions of the Professional Services Master Task Order Agreement and any Special Terms and Conditions and/or Exhibits or Attachments to this Task Order shall govern the Work. No. 92-0166301 July 31, 2016 Professional Services Agreement for Streets and Utilities Land Agent Services Project Scope of Services Task Order No. 7 Amendment #1 The scope of services for this City of Bozeman (City) Project is to finalize the construction plans to expand North 27th Avenue, acquire the necessary rights-of-way, prepare and administer the bidding documents and process, and perform construction administration services. The City will be constructing new roadway improvements soon and intends to have the project construction ready for this season. This project will serve as the final engineering, right-of-way and construction process for the roadway improvements project for the northbound lanes of North 27th Avenue from Oak Street to Tschache Lane in Bozeman, Montana. This amendment will expand the project scope of services to include the design of additional street lights along the east side of North 27th Avenue from Tschache Lane to Baxter Lane. It is anticipated three additional street lights will be included in the project plans. The intent of this scope of services and corresponding cost estimate is to provide preconstruction survey, engineering, and acquisition services on a lump sum basis for activities 1.0-9.0. Construction administration services in activities 10.0-12.0, construction survey staking, and the construction lab services are on a time and materials basis. Additional costs related to the actual land purchase price, relocation costs paid to property owners, and any costs associated with eminent domain proceedings are not included in this scope of services or cost estimate. This proposal is for electrical engineering design services, bidding coordination and construction administration as described below. Scope of Work The original scope of work for the project includes developing construction documents for the street lighting as shown in the documents received on March 31, 2016. The added scope of work is to provide street lighting from Tschache Lane North to Baxter Lane. In addition the electrical service pedestal will be relocated and conduit and conductors will need to be recalculated. An additional lighting sheet will be provided to show the additional scope. Electrical design will include work required for the street lighting including lighting photometric calculations, fixture selection, circuitry/voltage drop design and electrical service design/coordination. Specifications will be generated to convey project requirements. Bidding coordination including prior product approvals, coordination of contractor's questions and preparation of addendum(s) are included. Shop drawing review will be conducted for the project. Construction administration may be requested per the additional services rates as described below. Design Requirements The following items will be required at the start of the project. 1. CAD drawings of the proposed streets and site plans. 2. Equipment cut sheets, plans and specifications will be required as soon as possible. 3. Site utility drawings showing locations, sizes and depths. Exclusions The following items are not included in the scope of work. 1. Mechanical engineering 2. Site utilities except lighting design. 3. Reproduction of check sets or final documents. Proposal — North 271h Avenue Bozeman Lighting Project Page 1 Proposal Consulting Design Solutions, Inc. proposes to provide the work as described above for a lump sum total of: Electrical Design and Bidding: $2,000 Additional services for work beyond the scope of work for this project will be billed at our standard hourly rates as listed below. Prior to beginning additional service work, authorization will be required and requested. Additional Service Rates: Principal: $100/hr Engineer: $85/hr Drafting: $60/hr Additional Construction Site Visits: $200/trip Schedule Upon receipt of signed authorization to proceed and receipt of all required project information work will begin. It is estimated the design will take approximately 3-4 weeks depending on current work load, plan changes, owner review, unforeseen issues and especially the timely receipt of required building and equipment information. Every reasonable effort will be made to meet the project schedule. Progress work will be billed monthly. Terms are net 30 days with a 1% per month service charge for all accounts over 30 days. The signed copy will serve as authorization to proceed and as a contract for the project or provide an alternate contract. To the maximum extent permitted by law, the Client agrees to limit the Consultant's liability for the Client's damages to the sum of $50, 000 or the Consultants fee, whichever is greater. This limitation shall apply regardless of the cause of action or legal theory pled or asserted. Third Party Liability: It is expressly understood and agreed that this Agreement is entered into solely for the mutual benefit of the parties herein and that no benefits, rights, duties or obligations are intended by this Agreement as to third parties not a signatory hereto. Damages Waiver.- Notwithstanding anything to the contrary contained in this Agreement, no party to this Agreement shall be liable for any consequential, special, indirect, incidental, exemplary or punitive damages of any kind or nature whatsoever, or any lost income or profits regardless of whether arising from breach of contract or tort, even if advised of the possibility of such loss or damage or if such loss or damage could have been reasonably foreseen.
