HomeMy WebLinkAbout1982-08-30 13" .,~, <) MINUTES OF THE MEETING OF THE CITY COMMISSION BOZEMAN, MONTANA August 30, 1982 ********************** The Commission of the City of Bozeman met In regular session In the Commission Room, Municipal Building, August 30, 1982 at 4:00 p.m. Present were Mayor Stiff, Commissioner I Weaver, Commissioner Anderson, Commissioner Mathre, City Manager Evans, Assistant City Manager Barrick, City Attorney Planalp and Clerk of the Commission Sullivan. Commissioner Vant Hull was absent In compliance with Section 7-3-4322, M. C.A. The meeting was opened with the Pledge of Allegiance and a prayer by Commissioner Mathre. The minutes of the regular meeting of August 23, 1982 were approved as corrected. None of the Commissioners requested that any of the Items listed under Consent Items be removed for discussion. Decision - permission to conduct one-mile run for United Way - eastbound lanes of Main Street - October 2, 1982 - 9: 00 a. m. to 10: 30 a. m. City Manager Evans stated that the original request submitted by United Way was to conduct a one-mile run on the two eastbound lanes of Main Street. At last week's meeting, the use of Mendenhall was suggested rather than the use of Main Street. Mr. Herb Agocs has reviewed possible alternative routes. He stated that the best alternative route Is Babcock Street, beginning immediately west of South Eighth Avenue and terminating at Wallace Avenue. The City Manager stated that he has contacted the Police Division, and they expressed minor objections due to the location of the Post Office on Babcock Street. The Police Division does feel that Babcock Street would provide the most feasible route for the one-mile run. It was moved by Commissioner Weaver, seconded by Commissioner Anderson, that the Commission approve the request on behalf of United Way to conduct a one-mile run on Babcock I Street from just west of South Eighth Avenue to Wallace Avenue on October 2, 1982 between the hours of 9:00 a.m. and 10:30 a.m. The motion carried by the following Aye and No vote: those voting Aye being Commissioner Weaver, Commissioner Anderson, Commissioner Mathre and Mayor Stiff; those voting No, none. Authorize Mayor to sign - Community Development Block Grant - proposal for the repair of Mystic lake Dam City Manager Evans presented to the Commission the application for Community Develop- ment Block Grant funds for the repair of Mystic lake Dam, as prepared by Assistant Planner Mike Money. The City Manager stated that the proposal appears to be in order and recommended that the Comm isslon authorize the Mayor to sign the document. He further noted that the ap- plication must be postmarked no later than Tuesday, August 31, 1982. It was moved by Commissioner Anderson, seconded by Commissioner Mathre, that the Commission authorize and direct the Mayor to sign the proposal for Community Development Block Grant funds, to be used for the repair of Mystic Lake Dam. The motion carried by the following Aye and No vote: those voting Aye being Commissioner Anderson, Commissioner Mathre, Commissioner Weaver and Mayor Stiff; those voting No, none. Application for Raffle License - Montana Bowling Council - September 18, 1982 City Manager Evans presented to the Commission an application for a Raffle license, I along with the required fee, on behalf of the Montana Bowling Council for a raffle to be held on September 18, 1982. To be raffled are numerous prizes with a total value of no more than $200.00. The proceeds of this raffle will be used to support the cost of sending Senior Bowlers to the National Bowling Tournament. It was moved by Commissioner Mathre, seconded by Commissioner Weaver, that the Commission approve the application for a Raffle License on behalf of the Montana Bowling Council for a raffle to be held September 18, 1982. Kenyon Noble Lumber Company request for vacation of Church Avenue from Juniper Street North to Front Street, easterly 189 feet of Hemlock Street between Church Avenue and Front Street, and alley In Block 112 I City Manager Evans presented to the Commission a petition on behalf of Kenyon Noble Lumber Company for vacation of North Church Avenue from Juniper Street north to Front Street; vacation of the east 189 feet of Hemlock Street between Church Avenue and Front Street; and vacation of the alley in Block 112 In the Northern Pacific Addition to the City of Bozeman. The City Manager recommended that the Commission acknowledge receipt of the petition and set the public hearing date for September 20, 1982. It was moved by Commissioner Weaver, seconded by Commissioner Anderson, that the Commission acknowledge the petition on behalf of Kenyon Noble Lumber Company for vacation of North Church Avenue from Juniper Street north to Front Street; vacation of the easterly 189 feet of Hemlock Street between Church Avenue and Front Street; and vacation of the alley located In Block 112 of the Northern Pacific Addition to the City of Bozeman, and that the public hearing date be set for September 20, 1982. The motion carried by the following Aye and No vote: those voting Aye being Commissioner Weaver, Commissioner Anderson, Comlssloner Mathre and Mayor Stiff; those voting No, none. Application for Raffle License - Ducks Unlimited - September 10, 1982 City Manager Evans presented to the Commission an application for a Raffle License, along with the required fee, on behalf of Ducks Unlimited for a raffle to be held on September 10, 1982. To be raffled are assorted items donated by various stores valued at $200.00. It was moved by Commissioner Anderson, seconded by Commissioner Mathre, that the I Commission approve the application for a Raffle License on behalf of Ducks Unlimited for a raffle to be held on September 10, 1982. The motion carried by the following Aye and No vote: those voting Aye being Commissioner Anderson, Commissioner Mathre, Commissioner Weaver and Mayor Stiff; those voting No, none. Establishment of an administrative to Special Improvement lstrlcts and trans ers to the City Manager Evans stated that the City has historically transferred 6 percent from the Individual special improvement districts to the General Fund to reimburse the City for past, present and future costs of administering these special Improvement districts. This cha rge has not been documented in the past. The City staff is now proposing that 3 percent be transferred from an individual special improvement district to the General Fund to cover administrative costs, and 3 percent be transferred to the SID Revolving Fund. Director of Finance Swan stated that some SID's are constructed at a cost lower than the bond Issue. She stated that the implied intent of the proposal is to assess the 6 percent charge against the lower of (1) the actual cost of construction or (2) the amount of the bond issue. Commissioner Mathre stated that a smaller SID has a smaller base upon which to charge a static percentage than a larger SID has. She questioned if a base rate or a sliding scale would be better. Mayor Stiff noted that base data for this charge is being gathered In the admlnistra- I tive charge study being done by Mr. Gil Crain. He stated that establishment of a policy of transferring 3 percent from each individual SI D Into the General Fund and 3 percent Into the SID Revolving Fund will be an interim policy until the study Is completed. The Mayor instructed the City Staff to prepare a resolution to be considered at next week's meeting. 08-30-82 13-.' City Manager Evans recommended provisional passage of the Commission Resolution. Report from Recreation Board regarding purchase of property at the northwest corner of North Rouse Avenue and East Lamme Street City Manager Evans stated that the Recreation Board considered the purchase of the property located at the northwest corner of North Rouse Avenue and East Lamme Street at its last meeting for parkland purposes. The Recreation Board recommends approval of the pur- chase of the property using $10,000.00 from the Parkland Trust Fund. The City Manager I recommended that the Commission appropriate the monies from the Parkland Trust Fund for the $10,000.00 purchase price, and that the Commission authorize the City Manager to proceed with purchasing procedures of the property from Mrs. Ella Chapman. Mayor Stiff asked if other costs will be incurred In this purchase. City Manager Evans stated that minor costs may arise. He noted that Mrs. Chapman wants $10,000.00 net from the sale of the property. Costs incurred from closing costs can be carried through the budget. 08-30-82 11 I _ _ 'ie Mayor Stiff asked if the structures currently located on the property will be de- molished. City Manager Evans stated that a portion of the structures could possibly be used for salvage. If the buildings must be demolished, the operating crews for the City may be used for the demolition. The City Manager requested authorization to proceed with the clearing of the site and stated that if any significant costs are to be incurred In the removal of the structures, he will present it to the Commission before action is taken. I It was moved by Commissioner Anderson, seconded by Commissioner Mathre, that the Commission appropriate $10,000.00 from the Parkland Trust Fund for the purchase of the property located at the northwest corner of North Rouse Avenue and East Lamme Street from Mrs. Ella Chapman, to be used for parkland purposes; and authorize and direct the City Manager to proceed with the purchase of the property and subsequent removal of structures from the site. Schaplow and or easement City Manager Evans presented to the Commission a water line easement between Milton F. and Peggy Westlake Schaplow and the City of Bozeman. This water line easement Is located at the upper end of Sourdough Road and would be used for the construction of the new 30-lnch transmission line. The City Manager recommended that the Commission authorize the Mayor to sign the easement and authorize the payment of $1,000.00 for this easement. It was moved by Commissioner Mathre, seconded by Commissioner Weaver, that the Commission authorize and direct the Mayor and Clerk of the Commission to sign the easement with Milton F. and Peggy Westlake Schaplow; and authorize the payment of $1,000.00 for this easement. Present were Mr. Jafay, Mr. Rutzick, City Manager Evans, Assistant City Manager Barrick, Duncan MacNab, Bob Correa from the Chamber of Commerce, and County Commissioner Buttleman. This was the first time Mr. Jafay and Mr. Rutzick had been In Bozeman, and they had very little knowledge of the area. This trip to Bozeman was strictly exploratory for these gentlemen. They will now determine whether or not to conduct a feasibility study. The City Manager stated that any further action will be at some time in the future, definitely not immediately. Appointment to Library Board Mayor Stiff announced his appointment of Mr. Tom Crumbaugh to replace Mrs. Rexal (Verlene) Troth on the Library Board, with a term to expire on June 30, 1983.
