Resolution 4718, TOP Funding Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Carolyn Poissant – Manager of Trails, Open Space, and Park Development Mitch Overton – Director of Parks and Recreation SUBJECT: Resolution 4718 authorizing the allocation of additional funding from the Trails, Open Space and Parks bond for the Bozeman Creek Enhancements at Bogert Park Project and Notice of Award for the Project MEETING DATE: August 22, 2016 AGENDA ITEM TYPE: Action RECOMMENDATION: Approve Resolution 4718 authorizing an additional $50,000 for the construction contingency funding for the Bozeman Creek Enhancement Project. Any remaining funds will be returned to the unallocated TOP Bond Fund. Award the full contract (schedules 1 – 7) so the project may be completed as designed. RECOMMENDED MOTIONS: 1) Having considered all information provided relevant to this request, I hereby move to approve Resolution 4718 for an additional allocation of $50,000 from the 2012 Trails, Open Space, and Parks Bond fund for construction of the Bogert Creek Enhancement project, for a total allocation of $490,000, with any remaining funds to be returned to the unallocated balance of the Bond Fund following completion of the project. 2) I hereby move to approve the Notice of Award in the amount of $443,905 for the Bozeman Creek Enhancements at Bogert Park project. BACKGROUND: Resolution 4492 approved the allocation of Trails, Open Space and Parks (TOP) bond funding in an amount not to exceed $440,000 for the design and construction of stream channel enhancements along approximately 800 feet of the Bozeman Creek through Bogert Park to return it to a more ecologically sustainable condition, adding floodplain, hydraulic flow controls, and stabilizing vegetation to eliminate bank scouring. A new pedestrian bridge will be installed to replace the existing wooden bridge, and a small, barrier-free fishing platform will be installed near the Bogert pavilion. The widened creekbed will enhance safety and usability of the creek by reducing stream velocity during annual spring run-off and providing healthier habitat for fish and wildlife. The project is sponsored by the Bozeman Creek Enhancement Committee (BCEC), a partnership of city, state and federal agencies, community groups and individuals, including the Bozeman Parks 31 and Recreation Department, Downtown Bozeman Partnership, Friends of Bogert Park, Gallatin Local Water Quality District, Gallatin Valley Land Trust, Greater Gallatin Watershed Council, and Montana Fish, Wildlife and Parks. The project is consistent with the Bozeman Creek Enhancement Plan, adopted by the Bozeman City Commission on July 23, 2012, the Bogert Park Master Plan, the Downtown Improvement Plan and the Bozeman Community Plan. The total project budget is $659,000. The City Commission approved $440,000 in TOP Bond funding. Additional funds were provided by severable reimbursable grants: a $100,000 grant from Montana Department of Natural Resources and Conservation (DNRC) and $119,000 in grants from partnering agencies, including the Friends of Bogert Park ($10,000); GVLT ($12,000); Montana Fish, Wildlife, and Parks ($30,000); Montana Recreational Trails ($45,000); and $20,000 from the 2014 City of Bozeman Park Improvement Grant unallocated balance. The budget available for construction is $457,342. Bids were obtained on August 2, 2016 and the lowest responsible bidder contract price is $443,905. The work involves stream dewatering and floodplain restoration and needs to be completed this fall. A large rainstorm or other unforeseen event could generate the need for additional work not currently in the contract. Given the critical nature and timing of the work in the floodplain, the project engineer and city’s project manager recommend that up to a 15% contingency be available. An additional $50,000 was recommended to be allocated by the Trails, Open Space, and Parks Committee during their meeting on August 4, 2016 with a unanimous vote by the three members in attendance. This would provide a $14.2% contingency ($50,000 + $13,437 project balance = $63,437 / $443,905 = 14.2%). UNRESOLVED ISSUES: None. ALTERNATIVES: Award the contract with less contingency. FISCAL EFFECTS: This funding request ($50,000) will leave an unallocated balance in the Trails, Open Space and Parks Bond Fund of approximately $870,000. Attachments: Resolution 4718; Attachment A – Notice of Award; Attachment B – Bid Tabulation Report compiled on: August 12, 2016 32 COMMISSION RESOLUTION NO. 4718 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, TO AUTHORIZE ADDITIONAL FUNDING FROM THE TRAILS, OPEN SPACE AND PARKS BOND FUND FOR THE BOZEMAN CREEK ENHANCEMENT PROJECT AT BOGERT PARK WHEREAS, Resolution 4492 approved and authorized funding in the amount of $440,000 for the Bozeman Pond Park Expansion TOP Bond Project (“Project”) based upon a preliminary cost estimates; and WHEREAS, bids have been received for construction of the project; and WHEREAS, the nature of the construction activity within the Bozeman Creek floodway is subject to possible unforeseen circumstances that may require additional services not included in the bid; and WHEREAS, the city’s project engineering consultant and project manager recommend that up to a 15% contingency be readily available should any such unforeseen events occur that may affect the work; and NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 33 Funding / Authority. The Commission hereby authorizes additional funding in the amount of $50,000 from the current balance of the Trails, Open Space and Parks Bond fund for possible change orders to the construction contract for the Bozeman Creek Enhancement Project at Bogert Park. Any remaining funds after completion of the project shall be returned to the bond fund. Section 2 Amendment to Resolution 4492. This resolution serves to amend Resolution 4492 as delineated in Sections 1 above. ADDRESS: 7400 Thorpe Rd., Belgrade, MT 59714 PROJECT: Bozeman Creek Enhancements at Bogert Park CONTRACT FOR: Sitework and Landscaping You are notified that your Bid opened on August 2, 2016, for the above Contract has been considered. You are the apparent Successful Bidder and have been awarded a Contract for the: Bozeman Creek Enhancements Project. The Contract Price of your Contract is: Four hundred forty-three thousand nine hundred five dollars ($443,905.00). Five (5) copies of each of the proposed Contract Documents (except Drawings) accompany this Notice of Award. Three (3) sets of the Drawings will be delivered separately or otherwise made available to you immediately. You must comply with the following conditions precedent within fifteen (15) days of the date of this Notice of Award, that is, by September 6, 2016. 1. You must deliver to the OWNER Five (5) fully executed counterparts of the Agreement including all the Contract Documents and Drawings. 2. You must deliver with the executed Agreement the Contract Security (Bonds) as specified in the Instruction to Bidders (Article 20), and the General Conditions (paragraph 5.01). 3. List other conditions precedent: You must deliver with the executed Agreement the Certificates of Insurance as specified in the General Conditions (Article 5) and Supplementary Conditions (paragraphs SC-5.04 and SC-5.06). Failure to comply with these conditions within the time specified will entitle OWNER to consider your Bid abandoned, to annul this Notice of Award, and to declare your Bid Security forfeited. Within ten (10) days after you comply with these conditions, OWNER will return to you two fully signed counterpart of the Agreement with the Contract Documents attached.
