Apartments Conditional Use Permit and Site Plan from August 15, 2016 to
October 3, 2016.

RECOMMENDATION: Staff recommends that the Commission continue the public hearing to October 3, 2016. RECOMMENDED MOTION: I hereby continue the public hearing on application 15439, the
Sundance Apartments Conditional Use Permit and Site Plan application from August 15, 2016 to
October 3, 2016. BACKGROUND:
This is an application for a conditional use permit and site plan for the construction of a 216 unit
apartment complex with parkland, open space and related site improvements. The conditional use permit is to allow ground floor residential use in a B-2 District (Community Business).
Due to an unforeseen emergency the applicant is requesting a third continuation of the public
hearing to October 3, 2016.
UNRESOLVED ISSUES: None. ALTERNATIVES: The City Commission has the following alternative actions available:
1. Set an alternate date for the public hearing.
FISCAL EFFECTS: None identified at this time. Report compiled on: August 15, 2016

Tom,
We have had a last minute emergency causing us to miss the meeting scheduled for Aug 15th. Would it be
possible to be moved to the 29th of August Commission meeting? The 22nd would also work for us if you
don’t need to deliver a new notice.

Mr. Broadbent,
Attached you find the Planning Dept. DRC memo. I apologize for the delay in sending this to your
attention. The complexities involved and effort to review the project and come to a conclusion have
been time consuming.
As you will read we cannot support the project as submitted. We will discuss further this morning at
the DRC meeting. In short, I am unable to determine the application will not adversely affect the
community under the current circumstances to meet the CUP criteria and without a complete
subdivision plat that supports the proposed plan.
