HomeMy WebLinkAbout16- Memorandum of Agreement - Triangle Planning Coordination Committee - Bozeman, Belgrade, Four CornersMEMORANDUM OF AGREEMENT FOR ESTABLISHMENT OF A PLANNING COORDINATION COMMITTEE FOR THE PURPOSE OF COORDINATING PLANNING IN THE BOZEMAN/BELGRADE/FOUR CORNERS TRIANGLE This Memorandum of Agreement is entered into this s��fi _E day of , 2016 by and between the City of Bozeman, hereinafter called Bozeman; Gallatin County, hereinafter called the County; and the City of Belgrade, hereinafter called Belgrade. WHEREAS, between 2000 and 2010, the population of Belgrade and Bozeman increased by 29% and 36% respectively, and the population of Gallatin County increased by 32% over the same decade; and WHEREAS, the "Triangle" area of the Gallatin Valley, an area loosely described as the portion of the Valley within and between Bozeman, Belgrade, and the unincorporated community of Four Corners, has experienced a tremendous amount of growth and development in recent decades, with such activity expected continue into the future; and WHEREAS, when growth and development affect multiple jurisdictions, cooperation among those affected communities in planning for land use, infrastructure, and public services can have positive results in governmental effectiveness and improved service delivery to citizens; and WHEREAS, the parties to this agreement acknowledge that coordination between all three entities is an integral part of continuing comprehensive planning, and desire to cooperatively plan for future development, infrastructure, and other planning projects and processes in the Triangle area; and WHEREAS, Growth Policies for each of the partners recognize the importance of creating and implementing strategies for the development, maintenance, and replacement of public infrastructure such as: drinking water and wastewater treatment systems; transportation systems; fire protection; solid waste facilities; and parks, recreation, open space, and trails; and WHEREAS, all parties recognize the need to coordinate the design and construction standards of public infrastructure and facilities between the partners to ensure new growth is compatible between the jurisdictions so that citizens and taxpayers are spared the expense of major infrastructure overhauls at a later time and that new growth provides adequate and concurrent infrastructure to support desired densities while minimizing impacts to existing neighborhoods; and WHEREAS, Sanderson Stewart, an engineering firm in Bozeman, conducted a year-long study of planning issues in the Triangle, culminating in the Gallatin Triangle Planning Study. The Study recommended several actions for Belgrade, Bozeman, and the County to take; foremost among these was the recommendation to form a Planning Coordinating Committee; and WHEREAS, the Bozeman Planning Board, the Gallatin County Planning Board, and the Belgrade City/County Planning Board each adopted resolutions supporting development of a Planning Coordinating Committee between Belgrade, Bozeman, and the County. NOW, THEREFORE, IT BE RESOLVED that the parties herein do mutually agree as follows: Establishment of Planning Coordinating Committee A Planning Coordinating Committee (PCC) is hereby established to provide a forum for planning -related coordination in the Triangle between Bozeman, Belgrade, and the County. The Planning Coordinating Committee shall be advisory in nature only, without any authority over planning -related decisions in any of the participating jurisdictions. Membership. The Planning Coordinating Committee shall consist of a commission/council member, planning board member, and staff member from each of the three jurisdictions, for a total of nine members. Each signatory to the agreement shall determine the method to select their representative members. Ill. Jurisdiction. The jurisdiction of the PCC is generally considered the "Triangle" area of the Gallatin Valley, an area loosely described as the portion of the Valley within and between Bozeman, Belgrade, and the unincorporated community of Four Corners. They may also consider and discuss subjects outside of the "Triangle" area which affect the area within the "Triangle." The PCC shall adopt a boundary map which should be reviewed and, if necessary adjusted, at a regular interval. IV. Duties and Responsibilities. The PCC is generally intended to serve as a forum for Belgrade, Bozeman, and the County to share planning -related information that is of mutual interest to the parties. The PCC shall draft and adopt bylaws that more specifically define its scope. V. Meetings. The PCC shall determine its meeting schedule and place of meetings. Dates and locations may vary from time to time as deemed appropriate by the PCC. Meetings of the PCC are public meetings subject to the requirements of state law. VI. Citizen Participation. The Planning Coordinating Committee will provide for public involvement and input in the local planning process by inviting comments from local citizens on PCC agenda items. The method and scope of participation shall be determined by the PCC and may vary from subject to subject. VII. Changes in Agreement. Any alteration, extension, or supplement to the terms of this agreement, as detailed herein, shall be agreed to in writing by the signatory parties. VIII. Termination of Agreements. A signatory party may terminate its interest and obligations under this Agreement by giving at least sixty (60) days notice in writing to the other parties.
