Sundance CUP Continuation Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Tom Rogers, Associate Planner Chris Saunders, Interim Director of Community Development SUBJECT: Continue the public hearing on application 15439, the Sundance Apartments Conditional Use Permit and Site Plan from August 8, 2016 to August 15, 2016. MEETING DATE: August 8, 2016 AGENDA ITEM TYPE: Consent RECOMMENDATION: Staff recommends that the Commission continue the public hearing to August 15, 2016. RECOMMENDED MOTION: If the Commission moves this item to the Action agenda the following motions is suggested, “I hereby continue the public hearing on application 15439, the Sundance Apartments Conditional Use Permit and Site Plan application from August 8, 2016 to August 15, 2016.” BACKGROUND: This is an application for a conditional use permit and site plan for the construction of a 216 unit apartment complex with parkland, open space and related site improvements. The conditional use permit is to allow ground floor residential use in a B-2 District (Community Business). The applicant is requesting a second continuation of the public hearing to August 15, 2016. Public notice of the hearing was given. On July 11, 2016 the public hearing was continued to August 8, 2016. Staff re-noticed the project to insure adequate public participation. On July 7, 2016 the applicant was informed that four (4) Commissioners would be present at the August 8, 2016 hearing. On July 18, 2016 the development team determined continuing the hearing one week would be preferable. The request is attached to this memo. UNRESOLVED ISSUES: None. ALTERNATIVES: The City Commission has the following alternative actions available: 1. Set an alternate date for the public hearing. FISCAL EFFECTS: None identified at this time. However, Commissioner Pomeroy will be absent on August 8. Please discuss with your team and confirm whether or not having 4 of 5 Commissioners will work for you.
