From reliable sources I have been informed that attempts have and will continue for another liquor wine
and beer license for use on the main floor of the Bozeman Hotel. Most of you are aware that there are
already four establishments in the building serving liquor, beer and wine. Three of these,the Zebra,
Colonel Black's and the 317 Pub are almost exclusively drinking bars. Only one,the Pourhouse, serves as
a restaurant and bar.
The 317 Pub and the Pourhouse usually start up their operations in the late morning or around mid-
day. All of these establishments can continue their operations until 2 am each day. This means that
alcohol is available in the Bozeman Hotel for up to 16 hours a day, enough to allow many inebriated
drinkers loose on the property. I am opposed to another( fifthl bar coming into the Hotel for the
following reasons:
1. We already have four bars which exceeds the tipping point for a commercial building on Main
Street, Bozeman. A fifth bar in the building is unnecessary, unreasonable, unwise,and I believe,
threatening to the integrity and well-being of all in the building.
2. The Bozeman Hotel is primarily an office building. All of the condominium units on the 2cd,3`d,
and Vhfloors and office penthouses are occupied by office tenants, like yourselves. You
occupy over 60 to 65%of the entire Bozeman Hotel.
3. As tenants you have the right to the reasonable use and professional quality of your office
space. I fear that another bar in the building will affect your right to the quiet and peaceful use
of your office, including disruptive bar noise and music.
4. Another bar will create additional problems regarding the limited space available for parking in
the parking lot. I am already concerned that you would prefer that there are more parking
spaces available for yourselves and your clients rather than fewer.
5. Several of you have expressed to me that you do not like to go into and across the parking lot
at night, especially late night,when the bars are at full tilt. You have expressed that you do not
feel comfortably safe. This concern has been exasperated since Bar IX (formerly the Horny
Moose) has been inexistence. I share concern for all of you.
6. Over the last several years,there have been many incidents which have been very disturbing to
me. Some of these include overly inebriated drinkers who have climbed the fire escapes to get
onto the roof,or the top of the roof above the first floor. These include two males who jumped
or fell from the top roof of the building onto the Bozeman Hotel Annex. These two required the
Fire Department to break through walls of a third floor office to rescue them and take them to
the hospital. On a number of occasions, other drunks both male and female have climbed over
the wooden fence behind Bar IX to get onto the roof above the Bozeman Hotel first floor. On
several occasions offices have been broken into off of that lower roof. On another occasion a
drunk male walked out of one of the bars in the building,directly up the stairwell and opened
the water main valve on the fourth floor,causing water damage from the fourth floor through
all the lobbies to the main floor. This cost tens of thousands of dollars for repairs.
Unfortunately we were not able to ever identify the individual. On several other occasions we
have had break-ins into offices in the building. We have tried to remedy this by putting locks
on all offices in the building, but I still remain concerned because of the bar population.
7. 1 have been told that the most police calls on Main Street Bozeman are for incidents occurring
primarily at Bar IX, but some also in the Bozeman Hotel bars.
8. Finally, I apologize for the length of this writing, but I want you to be fully informed of my
concerns. I also request that you each express your concerns and personal views on the
following survey. Please ask any employee or staff to also complete the survey.

NOTICE OF PUBLIC HEARING FOR A CONDITIONAL USE PERMIT APPLICATION
A Conditional Use Permit (CUP) application was submitted to the Department of
Community Development requesting permission for the sales of alcohol for on-
premise consumption in the bar and restaurant tenant spaces in the Bozeman Hotel
building located 321 East Main Street.A CUP is required for on-premise consumption
of alcohol in all zoning districts.
The property at 321 East Main Street and is legally described as Bozeman Multilevel
Condo Lot 17-19, Lot 22-24,parts of Lots 15-16, 20 and 21,Block D,Bozeman Original

The purpose of the public hearing is to consider the Conditional Use Permit
Application 16084 for the 321 East Main Street on-premise consumption project,
requested by Pub 317 Business Owner Bar Keeper, LLC 321 East Main Street,
Bozeman, MT 59715 and representative and applicant, Hip and Humble
Architecture 418 South Fifth Avenue, Bozeman MT 59715, pursuant to Chapter 38
(Unified Development Code - UDC) of the Bozeman Municipal Code (BMC).
