SUBJECT: Resolution 4703: Story Mill Landfill SVE/LFG Project, Change Order No. 1
MEETING DATE: July 25, 2016
AGENDA ITEM TYPE: Consent
RECOMMENDATION: Adopt Resolution 4703 Authorizing the City Manager to Execute
Change Order No. 1, Story Mill Landfill SVE/LFG Project.
RECOMMENDED MOTION: Upon consideration of staff background and public comment, I move that we adopt Commission Resolution Number 4703, authorizing the City Manager to
execute Change Order No. 1, Story Mill Landfill SVE/LFG Project.
BACKGROUND: This change order accounts for provision of an engineered enclosure with
heating and ventilation for the compressor, receiver and dryer machinery and extends the contract completion time by 35 days. The final recommended changes in cost and time for this
items is reasonable and commensurate with the work involved.
UNRESOLVED ISSUES: None
ALTERNATIVES: As suggested by the City Commission.
FISCAL EFFECTS: This change order increases the contract amount by $64,366.75, which is 6.3% of the total contract amount.

COMMISSION RESOLUTION NO. 4703
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, APPROVING ALTERATION/MODIFICATION OF CONTRACT WITH CK MAY, BELGRADE MONTANA.
WHEREAS, the City Commission did, on the 7th day of December, 2015, authorize award of
the bid for the LFG/SVE Treatment System at the Story Mill Landfill, to CK May Excavating, Belgrade,
Montana; and
WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications and/or plans of the contract be made by resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and/or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman,
a municipal corporation, and CK May Excavating, as contained in Change Order Number 1, attached hereto,
being necessary to the work are hereby approved; and the City Manager is hereby authorized and directed
to execute the contract Change Order for and on behalf of the City; and the City Clerk is authorized and
directed to attest such signature.
