HomeMy WebLinkAboutOrdinance 89- 1290 Repeals and replaces Ch. 15.05, family dwelling code ORDINANCE NO. 1290 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, ADOPTING BY REFERENCE THE 1986 CABO ONE & TWO FAMILY DWELLING CODE, TOGETHER WITH ITS 1987-1988 AMENDMENTS: AND REPEALING ORDINANCE NO. 1245, AND PROVIDING A PENALTY FOR VIOLATION THEREOF. Preamble I The purpose of this Code is to provide mInimum standards for the protection of life, limb, health, property, environment and for the safety and welfare of the consumer, general public and the owners and occupants of residential buildings regulated by this Code. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 That Title 15 of the Bozeman Municipal Code is amended follows: Adoption of the 1986 CABO One and Two Family DweUiAgCode with its 1987-1988 amendments by reference. That certain documents, three (3) copies of which are on file in the office of the Building Official of the City of Bozeman, Montana, and at the offices of the City Clerk of the City of Bozeman, 411 East Main Street, Bozeman, Montana, being marked and designated as the 1986 CABO One and Two Fami Iy Dwelling Code with its 1987-1988 amendments is hereby adopted by the City Commission of the City of Bozeman, Montana, for the construction, prefabrication, alteration, repair, use, occupancy and maintenance of detached one and two fami Iy dwellings that certain code and standard known as the 1986 CABO One and Two Family Dwelling Code, along with its 1987-1988 amendments and the same is hereby adopted and incorporated by reference as fully set forth herein, and said provisions thereof shall be controlling within the jurisdictional limits of the City of Bozeman, MQntana. Section 2 I Violation. It shall be unlawful and punishable by a fine not exceeding Five Hundred Dollars ($500.00), for any person firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any building or structure or cause or permit the same to be done in violation of this code. Each day said violation continues shall be deemed a separate offense. Section 3 Savings Provision. This Ordinance does not affect rights and duties that matured, penalties that were incurred or proceedings that were begun before the effective date of this ordinance. Section 4 Severability. I f any prOVISion of this Ordinance is declared unconstitutional, or the applicability thereof to any person or circumstances is held invalid, the constitutionality of the remainder of the ordinance and applicability thereof to other persons and circumstances shall not be affected thereby. Section 5 I Ordinances Repealed. That Ordinance No. 1245 of the City of Bozeman entitled AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, ADOPTING BY REFERENCE THE CABO ONE AND TWO FAMI L Y DWELLI NG CODE, 1983 EDITION WITH THE 1984 AMENDMENTS be and the same is hereby repealed. All other ordinances and parts of ordinances in conflict with the provisions of this ordinance are also hereby repealed. ORDINANCE NO. 1290 I 1.' 't j ROBIN L.
