BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA:
Section 1
That Chapter 15.12 of the Bozeman Municipal Code be and the same is hereby amended to
read as follows:
15.12.010 Document Adopted by Reference--Copies on Fi Ie.
A certain document, three (3) copies of which are on file in the office of the Bui Iding
Official of the City of Bozeman, Montana, and at the offices of the City Clerk of the City of
Bozeman, 411 East Main Street, Bozeman, Montana, being marked and designated as the Uniform
Mechanical Code, 1988 Edition, published by the I nternational Conference of Bui Iding Officials,
be and the same is hereby adopted as the Mechanical Code of the City of Bozeman for regulating
and controlling the design, construction, installation, quality of materials, location, operation
and maintenance of heating, venti lation, cool ing, refrigeration systems, incinerators, and other
miscellaneous heat-producing appliances in the City of Bozeman; providing for issuance of
permits and collection of fees therefore; providing penalties for viola.t,;on of such code; and each
and all of the regulations, provisions, penalties, conditions and terms of such II Uniform
Mechanical Code, II 1988 Edition, published by the International Conference of Bui Iding Officials,
'Un fi Ie in the office of the Bui Iding Official, are hereby referred to, adopted and made a part
hereof as if fully set out in this ordinance; save and except such portions thereof as have been
deleted, modified, or amended as hereinafter set forth.

ORDINANCE NO. 1288
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, ADOPTING THE 1988 EDITION OF THE UNIFORM MECHANICAL CODE,
REGULATING AND CONTROLLING THE DESIGN, CONSTRUCTION, QUALITY OF
MATERIALS, ERECTION, INSTALLATION, ALTERATION, REPAIR, LOCATION,
RELOCATION, REPLACEMENT, ADDITION TO, USE OR MAINTENANCE OF
HEATING, VENTILATING, COOLING, REFRIGERATION SYSTEMS, INCINERATORS,
OR THEIR MISCELLANEOUS HEAT-PRODUCING APPLIANCES IN THE
JURISDICTIONAL LIMITS OF THE CITY OF BOZEMAN, MONTANA; PROVIDING
FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFOR;
PROVIDING FOR PENALTIES FOR THE VIOLATION THEREOF; AND AMENDING
ORDINANCE NO. 1204 OF THE CITY OF BOZEMAN AND ALL OTHER ORDINANCES
AND PARTS OF ORDINANCES IN CONFLICT THEREWITH.

Preamble
The purpose of this Code is to provide minImum standards to safeguard life
or limb, health, property and public wel fare by regulating and controlling the
design, construction, installation, quality of materials, location, operation, and
maintenance of heating, venti lating, cooling, refrigeration systems, incinerators,
and other miscellaneous heat-producing appliances within this jurisdiction.
Violation.
It shall be unlawful and punishable by fine not exceeding Five Hundred Dollars ($500.00)
for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve,
remove, convert or demolish, equip, use or maintain any mechanical systems or equipment or
cause or permit the same to be done in violation of this code. Every day said violation
continues shall be deemed a separate offense.
Section 3
Savings Provision.
This ordinance does not affect rights and duties that matured, penalties that were
incurred or proceedings that were begun before the effective date of this ordinance.
Section 4
Severabi I ity .
I f any provISion of this ordinance is declared unconstitutional, or the applicability thereof
to any person or circumstances is held invalid, the constitutionality of the remainder of the
ordinance and applicability thereof to other persons and circumstances shall not be affected
thereby.
