HomeMy WebLinkAboutOrdinance 89- 1289 Amends 88 15.16.020 and 15.16.030 and repeals and replaces 8 15.16.010, plumbing code ORDI NANCE NO. 1289 41U AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING CHAPTER 15.16 OF THE BOZEMAN .MUNICIPAL CODE, PROVIDING FOR THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY BY REGULA TI NG THE ERECTION, INSTALLATION , ALTERATION, ADDITION, REPAIR, RELOCATION, REPLACEMENT, MAINTENANCE OR USE OF ANY PLUMBING SYSTEM IN THE CITY OF BOZEMAN, MONTANA; ADOPTING BY REFERENCE THE 1988 UNIFORM PLUMBING CODE; AMENDING SECTION 2 OF ORDINANCE NO. 1203; REPEALING SECTION 1 OF ORDINANCE NO. 1203; AND PROVIDING A PENALTY FOR VIOLATION THEREOF. Preamble I The purpose of this Code is to provide minimum standards to safeguard life or limb, health, property and public welfare. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA: Section 1 That Chapter 15.16 of the Bozeman Municipal Code be and the same is hereby amended to read as follows: 15. 16.010 Document Adopted by Reference--Copies on Fi Ie. A certain documents, three (3) copies of which are on file in the office of the Building Official of the City of Bozeman, being marked and designated as the "Uniform Plumbing Code, II 1988 Edition, as published by the I nternational Association of Plumbing and Mechanical Officials, with Montana amendments which are set forth in Section 8.70.302 of the Administrative Rules of Montana which are attached hereto as Exhibit A and are hereby incorporated by reference as though fully set forth herein, be and the same is hereby adopted as the Plumbing Code of the City of Bozeman for the regulation of plumbing and drainage systems in the City of Bozeman; providing for penalties for violation of such code; and each and all of the regulations, provisions, penalties, conditions and terms of the "Uniform Plumbing' Code, II 1988 Edition, as published by the International Association of Plumbing and Mechanical Officials with Montana amendments adopted previously which are set forth in Section 8.70.302 of the Administrative Rules of Montana which are attached hereto as Exhibit A and are hereby incorporated by reference as though fully set forth herein and on file in the office of the Bui Iding Official, are hereby referred to, adopted and made a part hereof as if fully set out in this ordinance; save and except such portions thereof as have been deleted, modified, or amended as hereinafter set forth and is to be enforced within the jurisdictional limits of the City of Bozeman, Montana. Section 2 That Section 2 of Ordinance No. 1203 be and the same is amended as follows showing deletions through interlineation. 15. 16.020 Additions. The following paragraphs shall be added to the Uniform Plumbing Code. Water services, from property line to and including the water meter, shall be installed by the City Water Department upon proper application by the owner or his agent and receipt of a deposit based upon the estimated cost; provided, that any excess over the actual costs shall be refunded to the applicant upon completion of the work. Should the actual cost be more than the estimated deposit the owner or his agent shall pay the additional fee. I ORDINANCE NO. 1289 Section 3 15.16.030 Schedule of Fees Amended--Plumbing Permit Fees. The schedule of fees in the Uniform Plumbing Code is hereby amended to read as follows: Plumbing Permit Fees Fee I For issuing each permit $20.00 For each plumbing fixture, or set of fixtures on one trap including water, drainage, piping and back- flow protection thereof $ 4.00 For each building sewer and each trailer park sewer $10.00 $ 4.00 For each water heater and vent For each gas piping system: One to four outlets $ 6.00 $ 1.50 Five or more, per outlet For installation, alteration or repair of water piping and/or water treatment equipment $ 4.00 Building storm drains and/or rain water leaders per each $ 4.00 For repair or alteration of drainage or vent piping $ 4.00 For each lawn sprinkler system and/or fire protection system, including backflow devices $ 6.00 I For each mobile home inspection including gas lines, venting and appliances, including issuance of permit $22.50 Section 4 Ordinances Repealed. That Section 1 of Ordinance No. 1203 entitled AN ORDI NANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING CHAPTER 15.16 OF THE BOZEMAN MUNICIPAL CODE, PROVIDING FOR THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY BY REGULATING THE ERECTION, INSTALLATION, ALTERATION, ADDITION, REPAIR, RELOCATION, REPLACEMENT, MAINTENANCE OR USE OF ANY PLUMBING SYSTEM IN THE CITY OF BOZEMAN, AND REPEALING ORDINANCE NUMBERS 1042 AND 1121 is hereby repealed. This repealer shall not be deemed to have any affect on the remaining Sections of Ordinance No. 1203 except as herein specifically amended. Section 5 Violation. It shall be unlawful and punishable by fine not exceeding Five Hundred Dollars ($500.00) for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any building or structure or cause or permit the same to be done in violation of this code. Each day that the violation continues shall be deemed a separate offense. Section 6 I Savings Provision. This ordinance does not affect rights and duties that matured, penalties that were incurred or proceedings that were begun before the effective date of this ordinance. Section 7 Severabi lity. I f any provISIon of this ordinance is declared unconstitutional, or the applicability thereof to any person or circumstances is held invalid, the constitutionality of the remainder of the ordinance and applicability thereof to other persons and circumstances shall not be affected thereby.
