HomeMy WebLinkAboutOrdinance 89- 1284 Repeals and replaces Ch. 15.24, abatement of dangerous buildings code (2) ORDINANCE NO. 1284 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, ADOPTING BY REFERENCE THE 1988 EDITION OF THE UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS PROVIDING FOR THE PROPER LEGAL STEPS IN ABATING DILAPIDATED, DEFECTIVE BUILDINGS WHICH ENDANGER LIFE, LIMB, HEALTH, MORALS, PROPERTY, SAFETY, OR WELFARE OF THE GENERAL PUBLIC OR THEIR OCCUPANTS; AND AMENDING CHAPTER 15.24 OF THE BOZEMAN MUNICIPAL CODE AND REPEALING ORDINANCE NO. 1205, AND PROVIDING A PENALTY FOR VIOLATION THEREOF. I Preamble It is the purpose of this Code to provide a just, equitable and practical method, to be cumulative in addition to any other remedy provided by the Bui Iding Code, Housing Code or otherwise available at law whereby buildings or structures which for any cause may endanger the life, limb, health, morals, property, safety or welfare of the general public or their occupants may be required to be repaired, vacated, or demolished. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA AS FOLLOWS: Section 1 At Chapter 15.24 of the Bozeman Municipal Code be and the same is hereby amended: 15.24.010 Adoption by reference of the 1988 Uniform Code for the Abatement of Dangerous Bui Idings: I A certain document, three (3) copies of which are on file in the office of the Building Official of the City of Bozeman, being marked and designated as the "Uni form Code for the Abatement of Dangerous Buildings," 1988 Edition, published by the I nternational Conference of Building Officials, be and the same is hereby adopted as the Abatement of Dangerous Buildings Code of the City of Bozeman for regulating the alterations, additions, and repairs of all structures in the City of Bozeman; providing for the proper legal steps in abating di lapidated, defective bui Idings which endanger life, limb, health, morals, property, safety, or welfa re of the general public or their occupants; providing penalties for the violation of such code; and each and all of the regulations, provisions, conditions and terms of such "Uniform Code for the Abatement of Dangerous Bui Idings," 1988 Edition, published by the I nternational Conference of Building Officials, on fi Ie in the office of the Bui Iding Official, are hereby referred to, adopted and made a part hereof as if fully set out in this ordinance; save and except such portions thereof as have been deleted, modified, or amended as hereinafter set forth. Section 2 Violations. It shall be unlawful and punishable by a fine not exceeding Five Hundred Dollars ($500.00) for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any building or structure, or cause or permit the same to be done in violation of this code. Each day said violation continues shall be deemed a separate offense. Section 3 I Ordinances Repealed. That Ordinance No. 1205 of the City of Bozeman entitled AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING CHAPTER 15.24 OF THE BOZEMAN MUNICIPAL CODE REGULATING THE ALTERATION, ADDITIONS, AND REPAIRS OF ALL STRUCTURES IN THE CITY OF BOZEMAN; PROVIDING FOR THE PROPER LEGAL STEPS IN ABATING DILAPIDATED, DEFECTIVE BUILDINGS WHICH ENDANGER LIFE, LIMB, HEALTH, MORALS, PROPERTY, SAFETY, OR WELFARE OF THE GENERAL PUBLIC OR THEIR OCCUPANTS; AND REPEALING ORDINANCE NUMBERS 1044 and 1122 and all other ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4 Savings Provision. This ordinance does not affect rights and duties that matured, penalties that were incurred or proceedings that were begun before the effective date of this ordinance. ORDINANCE NO. 1284 4U1 PROVISIONALLY PASSED, ADOPTED AND APPROVED by the City Commission of the City of Bozeman, Montana, this 2nd day of October, 1989. I 40i Section 5 Severability. If any provIsIOn of this ordinance is declared unconstitutional, or the applicability thereof to any person or circumstances is held invalid, the constitutionality of the remainder of the ordinance and applicability thereof to other persons and circumstances shall not be affected thereby.
