TO 8:00 O'CLOCK A.M. AS AUTHORIZED BY SECTION 23-5-307, MONTANA CODE ANNOTATED, AND REPEALING SECTION 13 OF ORDINANCE NO. 1117, SECTION 2 OF ORDINANCE NO. 1159, SECTIONS 3, 4, 5 AND 6 OF ORDINANCE NO. 11 81 , AND ORDINANCE NOS. 111 2, 11 32, 11 86 ,1 207, 1 236 AND 1257. I PREAMBLE The purpose of this ordinance is to maintain, in the jurisdictional limits of the City of Bozeman, the status quo for the hours of operation of live card games authorized by law, which I ive card games have been operating without periods of closing in the City of Bozeman since 1974, and to repeal local gambling regulations and licensing requirements to comply with State law which becomes effective on October 1, 1989. I BE IT ORDAI N ED by the City Commission of the City of Bozeman, Montana, as follows: Section 1 That Section 1 be, and the same is hereby enacted into law: Hours of operation of authorized live card games. Pursuant to Section 23~5-307, Montana Code Annotated (MCA), the hours during which live card games authorized by the State of Montana may be played within the jurisdictional limits of the City of Bozeman, Montana, include the hours between 2: 00 o'clock a. m. and 8: 00 o'clock a. m., thereby extending the playing time beyond the 2: 00 o'clock a. m. to 8:00 o'clock a.m. closing times established by State law. Section 2 The all ordinances and parts thereof in confl ict herewith are hereby repealed and that the following ordinances and parts thereof and all subsequent amendments thereto be, and the same are hereby, specifically repealed: Ordinance No. 1257, entitled "AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING SECTIONS 5.56.100 AND 5.56.146 AND ADDING SECTION 5.56.145 TO THE BOZEMAN MUNICIPAL CODE TO REVISE THE REGULATIONS FOR LICENSES ISSUED FOR CARD TABLES AND ELECTRONIC KENO MACHINES AND THE OVERALL LIMITATION ON GAMING DEVICES PER ESTABLlSHMENT", enacted on the 31st day of May 1988 and not yet codified in the Bozeman Municipal Cod~. Ordinance No. 1236, entitled "AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING SECTIONS 5.06.042 and 5.06.044 OF THE BOZEMAN MUNICIPAL CODE REVISING THE FEE STRUCTURE FOR LICENSES ISSUED FOR VIDEO DRAW POKER AND ELECTRONIC KENO MACHINES TO COMPLY WITH STATE LAW", enacted on the 29th day of June 1987 and not yet codified in the Bozeman Municipal Code. Ordinance No. 1207, entitled "AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING SECTIONS 5.06.042 AND 5.06.044 OF THE BOZEMAN MUNICIPAL CODE REVISING THE FEE STRUCTURE FOR LICENSES ISSUED FOR VIDEO DRAW POKER AND ELECTRONIC KENO MACHINES", enacted on the 27th day of May 1986 and currently codified as Sections 5.06.042 and 5.06.044 of the Bozeman Municipal Code. Ordinance No. 1186, entitled "AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING SECTIONS 5.06.055,5.56.130 AND 5.56.140 OF THE BOZEMAN MUNICIPAL CODE, REVISING THE FEES AND SPECIFYING THE REQUIREMENT FOR BUSINESS LICENSES ISSUED PURSUANT TO THE 'BINGO AND RAFFLES ACT"', enacted on the 26th day of August 1985 and currently codified as Sections 5.06.055, 5.56.130 and 5.56.140 of the Bozeman Municipal Code. Ordinance No. 1132, entitled AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, AMENDING SECTIONS 3.12.050 AND 3.56.100, OF THE BOZEMAN MUNICIPAL CODE, ESTABLISHING THE FEE STRUCTURE FOR GAMING DEVICES AND SETTING THE LIMITATION ON THE NUMBER OF GAMING DEVICES PER ESTABLISHMENT IN THE CITY OF BOZEMAN , MONTANA ", enacted on the 23rd day of May 1983 and currently codified as Sections 5.06.050 and 5.56.100 of the Bozeman Municipal Code.
